CITY COUNCIL `gLrFOR�� CITY OF SOUTH SAN FRANCISCO WEDNESDAY, JUNE 22, 2022 6:00 p.m. TELECONFERENCE MEETING Via Zoom The City Council may meet by teleconference, consistent with the Brown Act as amended by AB 361 (2021. Under the amended rules, the City will not provide a physical location for members of the public to participate in the teleconference meeting. CALL TO ORDER Mayor Nagales called the meeting to order at 6:00 p.m. ROLL CALL Councilmember Addiego, present Councilmember Coleman, present Councilmember Flores, present Vice Mayor Nicolas, present Mayor Nagales, present PLEDGE OF ALLEGIANCE Mayor Nagales led the pledge. AGENDA REVIEW No changes. ANNOUNCEMENTS FROM STAFF City Manager Futrell invited the community to participate in the new Aquatic Center Community Workshop on Saturday, June 25, 2022, at 10:00 a.m. at the Joseph Fernekes Recreation Building. PUBLIC COMMENTS The following individuals provided public comment: • Matt Klein — resident of the Oyster Cove Marina • Lucia — resident of the Oyster Cove Marina • Gale — resident of the Oyster Cove Marina • Alison Madden — resident of the Oyster Cove Marina • Emilio Casal — resident of the Oyster Cove Marina Members of the City Council acknowledged and thanked the community for their active participation. While the Council cannot respond to public comments, they requested that staff follow-up with the community members. COUNCIL COMMENTS Councilmember Addiego informed the community that the Council attended the BIO International Convention event in San Diego, representing the city. Councilmember Flores thanked Council for their support and shared that the "Every Kid Deserves a Bike" program was nominated for a Summit award through the 2022 Silicon Valley Bicycle Coalition and encouraged the public to vote by visiting the bikesiliconvalley.org website beginning July 8, 2022. Mayor Nagales shared his concern with the anti -Asian attacks in the Bay Area. He noted the recent unprovoked attack against Millbrae City Councilmember Anders Fung in San Francisco and wished him a speedy recovery. He invited the community and the Council to join San Mateo County leaders in condemning hate against Asian and Pacific Islanders. Councilmember Coleman informed the community of the newly formed Commission on Equity and Public Safety tasked with improving equity and inclusivity. He encouraged the community to participate in future meetings and share their input. Vice Mayor Nicolas thanked the members of the Commission on Equity and Public Safety for their willingness to make a difference in the community. She requested to adjourn the meeting in memory of David Barradas, father of Dr. Mark Barradas. CONSENT CALENDAR The City Clerk duly read the Consent Calendar, after which Council voted. 1. Motion to approve the Minutes for the meetings of June 8, 2022, and June 9, 2022. 2. Report regarding Resolution No. 92-2022 amending an existing shuttle services agreement with Parking Company of America, LLC (PCAM) extending the term until December 31, 2022, for the operation of the South City Shuttle. (Marissa Garren, Management Analyst I) 3. Report regarding Resolution No. 93-2022 authorizing the acceptance of $95,643 in SB 1383 Local Assistance Grant Program funding from the California Department of Resources Recycling and Recovery ("Cal Recycle") to support the City of South San Francisco's implementation and procurement requirements per California Senate Bill 1383 and approving Budget Amendment 22.070. (Marissa Garren, Management Analyst I) 4. Report regarding Resolution No. 94-2022 calling for municipal election to elect three members of the City Council for Districts 1, 3, and 5, a City Clerk (at -large) and a City Treasurer (at -large), all to respective four-year terms, setting candidate statement requirements pursuant to section 13307 of the California Elections Code, requesting: (1) that the Board of Supervisors of San Mateo County consolidate the municipal election with the regular election to be held on November 8, 2022; and (2) that the County Registrar perform certain election services in connection with such election including conducting the November 8, 2022 election for the City of South San Francisco; and (3) authorizing the City Clerk to enter into an agreement for the provision of election services and reimburse the County for election service costs. Report regarding Resolution No. 95-2022 approving a First Amendment to the Professional Services Agreement with Athens Administrators, Inc. to extend the agreement for workers' compensation claims administration by one year for a total amount not to exceed $840,208. Report regarding Resolution No. 96-2022 approving the renewal of a Consulting Services Agreement with Townsend Public Affairs for grant writing services on various capital improvements, development, and social service projects for a one-year term in an amount not to exceed $60,000. Report regarding adoption of Resolution No. 97-2022 authorizing the City Manager to execute a Letter of Engagement with the law firm Squire Patton Boggs to extend an existing contract for national advocacy and policy services, for a term through June 2023 and for an amount not to exceed $180,000 (Christina Fernandez, Assistant to the City Manager) 8. Report regarding Resolution No. 98-2022 approving the City of South San Francisco Community Facilities District No. 2021-01 (Public Facilities and Services) levy of special taxes for Fiscal Year 2022-23 (Jason Wong, Deputy Finance Director) 9. Report regarding Resolution No. 99-2022 approving the City's Investment Policy for Fiscal Year 2022-23 (Paul Harris, Financial Services Manager) 10. PUBLIC HEARING Public hearing opened.- 6:36 p.m. 11. Staff Report regarding Resolution No. 101-2022 establishing sewer service rates for the fiscal year 2022-2023 amending the Master Fee Schedule to include the fiscal year 2022-2023 Sewer Service Rates, adopting the Report of Annual Sewer Rentals Charges for the fiscal year 2022-2023. (Mike Futrell, City Manager Jason Wong, Acting Finance Director, and Brian Schumacker, Plant Superintendent). Plant Superintendent Schumacker presented the report and provided an overview of the proposed fees. Mayor Nagales advised the community that the city offers Low Income Sewer Service Rebate programs. Plant Superintendent Schumacker encouraged interested residents to call (650) 877-8550 for more information. City Manager Futrell noted that the Council previously adopted no increase and indicated that the staff would continue to explore ways to lower the cost for residents. Councilmember Flores inquired if the city received written protests. City Clerk Govea Acosta indicated that the City Clerk's office did not receive any. Vice Mayor Nicolas and Councilmember Addiego thanked Plant Superintendent Schumacker and his team for their work. Plant Superintendent Schumacker presented the report and provided an overview of the proposed stormwater management service charges. Councilmember Addiego requested clarification on the Storm Drain maintenance responsibilities and the city's efforts. Plant Superintendent Schumacker provided an overview of the city's maintenance efforts. ADMINISTRATIVE BUSINESS 13. Report regarding Resolution No. 103-2022 approving the Conference Center Authority (Authority) Fiscal Year (FY) 2022 -2023 Budget. (Jim McGuire, South San Francisco Conference Center Executive Director) Conference Center Executive Director Jim McGuire presented the report and noted that occupancy rates are gradually increasing, expressing optimism for years to come. Conference Center Authority Member Richard Garbarino voiced his support for the proposed budget. The Council thanked Executive Director McGuire for his professionalism and commitment to the Conference Center during these challenging times, expressing optimism for increased revenues and a brighter future. Item Not Heard 15. Report adopting Resolution No. 104-2022 approving the City of South San Francisco Operating Budget for Fiscal Year 2022-23 and approving the Gann Appropriations Limit. (Karen Chang, Director of Finance and Jason Wong, Deputy Finance Director) City Manager Futrell indicated that the proposed budget is balanced with revenues projected at $122.3 million and expenditures projected at $122.2 million, noting a surplus of $55,000 due to the city's continued financial recovery from the covid-19 pandemic. He shared that the budget included unfreezing all staff positions put on hold due to the pandemic returning all departments to full staffing, plus the addition of 22 new full-time positions. He introduced the city's new Finance Director, Karen Chang. Finance Director Chang presented the report and provided an overview of the proposed budget. The Council expressed support for the proposed budget and welcomed Finance Director Chang to the City of South San Francisco. Report regarding Resolution No. 105-2022 approving the proposed Capital Improvement Program for fiscal year 2022-23. (Eunejune Kim, Director of Public Works/City Engineer and Matthew Ruble, Principal Engineer) Principle Engineer Matt Ruble presented the report and provided an overview of the Capital Improvement Projects. Director of Capital Projects Jake Gilchrist provided an overview of the Orange Memorial Park Sports Field Renovation and the Orange Memorial Park Aquatic Center. He invited the public to attend a Community Workshop for the New Aquatic Center on Saturday, June 25, 2022, at 10 a.m. at the Joseph Fernekes Recreation Building. Councilmember Addiego thanked the community for their support in passing Measure W, which increased taxes to fund city projects. He requested clarification on the proposed lighting assessment for the downtown areas. Principle Engineer Ruble provided an overview of the project. Vice Mayor Nicolas thanked former council members for their fiduciary oversight to serve community needs. Councilmember Coleman and Flores thanked the staff for their work and noted the benefits of the proposed projects. Report regarding Resolution No. 106-2022 to approve a successor Memorandum of Understanding between the City of South San Francisco and the International Union of Operation Engineers (IUOE) Local 39 for July 1, 2022 - June 30, 2025 (Leah Lockhart, Human Resources Director) Human Resources Director Lockhart presented the report and provided an overview of the compensation study and proposed adjustments. Motion — Councilmember Addiego /Second – Vice Mayor Nicolas: To approve Resolution No. 106-2022, approving a successor Memorandum of Understanding between the City of South San Francisco and the International Union of Operation Engineers (IUOE) Local 39 for July 1, 2022 - June 30, 2025, by roll call vote: AYES: Councilmembers Addiego, Coleman, and Flores, Vice Mayor Nicolas, and Mayor Nagales; NAYS: None; ABSENT: None; ABSTAIN: None. 19. Report regarding an ordinance authorizing the City of South San Francisco to adopt a military equipment use policy, for continued or future use of specifically defined military equipment pursuant to Assembly Bill (AB) 481 as it relates to the funding, acquisition, or use of military equipment. (Adam Plank, Police Captain) Police Captain Adam Plank presented the report and provided an overview of Assembly Bill 481 (AB 481), which restricts law enforcement purchases and the use of military equipment. Mayor Nagales and Councilmember Addiego requested clarification on the department's use of equipment. Police Captain Plank provided an overview of department procedures, and Police Seargent O'Connor provided an overview of the three categories of weapons non -lethal, less lethal, and lethal. Councilmember Flores inquired about the use and purchase of Pepper Ball guns, noting that the department purchased some in 2021. Police Seargent O'Connor indicated that the Pepper Ball has an expiration date and provided an overview of the department's inventory process and changes to comply with legislation. Police Captain Plank indicated that the department would seek approval from Council to purchase or acquire equipment via an annual report allowing for public comment to comply with AB 481 requirements. REGULAR CITY COUNCIL MEETING JUNE 22, 2022 MINUTES PAGE 6 Councilmember Addiego recalled an incident in the city where an Armored Rescue Vehicle was used to ensure officer safety and noted that the vehicle is no longer in the department's inventory. Police Chief Campbell provided an overview of armored vehicles' replacement and licensing. He indicated that the department obtained an Armored Transport Vehicle from the Urban Areas Security Initiative program via a grant at no cost to the city. The vehicle does not require a specialized driver's license or additional training. Police Captain Plank indicated that staff posted the department's response to AB 481 on the website, and staff would subsequently bring annual reports to the Council for approval. Members of the public members can email [email protected] or call (650) 877-8900 to share concerns, comments, or complaints. Mayor Nagales suggested that Police Captain Plank provide a presentation to the Commission on Racial and Social Equity. Vice Mayor Nicolas requested clarification on the process to establish public concerns and complaint process. Police Captain Plank provided an overview. Councilmember Flores discussed the department's requirement of community engagement and suggested outreach be done in English and Spanish.
