AN ORDINANCE OF THE CITY OF SOUTH SAN
FRANCISCO ESTABLISHING A POLICE RESERVE
THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS
FOLLOWS:
SECTION 1. SHORT TITLE.
This Ordinance shall be known and cited as the "Police Reserve Ordinance
of the City of South San Francisco."
SECTION 2. DEFINITIONS.
"Chief" shall mean the Chief of Police of the City of South San

"City Manager" shall mean the City Manager of the City of South San
"Member" shall mean any person who is a member of the police reserve
of the City of South San Francisco.
E. "Person" includes any person, firm, partnership, association,
corporation, company or organization of any kind.
F. "Reserve" shall mean the police reserve of the City of South San
Francisco.
SECTION 3. ESTABLISHED.
A. A police reserve organization is hereby created and established in
the City of South San Francisco. The reserve shall be a voluntary organization,
and it is hereby specifically excluded from Civil Service or the Personnel
system of the City and from the Public Employees' Retirement System of the

the State of California.
B. The reserve shall consist of such members as the City Manager may,
from time to time, determine necessary; provided, however, that the number of
members shall not exceed the number of regularly employed sworn officers of
the South San Francisco Police Department.
C. The reserve shall be officially known as the South San Francisco
Police Reserve Organization.
SECTION 4. QUALIFICATIONS OF MEMBERS.
The Chief of Police, subject to the approval of the City Manager, shall,
by rule, prescribe the qualifications necessary for membership in the reserve
and the procedure by which applications are to be processed and applicants
accepted or rejected for membership.
SECTION 5. DUTIES OF THE CHIEF OF POLICE.
A. The Chief of Police, subject to the approval of the City Manager,
shall prepare, adopt and promulgate rules and regulations as may be necessary
for efficiency and proper discipline within the reserve.
B. The Chief shall have complete command and control of the reserve,
and he shall appoint a commanding officer for the reserve from among sworn
regular personnel of the South San Francisco Police Department.
C. The Chief shall be responsible to insure that all members of the
reserve are properly trained in accordance with State law.
SECTION 6. MISSION OF THE RESERVE.
The reserve shall assist the South San Francisco Police Department in
protecting and serving the public. The reserve is specifically assigned the
duty of preparing for assistance and response in major disasters that may
threaten the lives and property of people in the City.
SECTION 7. DUTIES OF MEMBERS
A. Each member will be required to serve an average minimum number of
hours per month in the reserve as set by the Chief of Police, subject to the
approval of the City Manager. Any member who fails to give such minimum ser-
vi'ce for a period of two (.2) consecutive months will be required to explain
that failure to the commanding officer of the reserve. Unless good reason
is shown for such failure to render the minimum required service, the Chief
of Police may summarily expel that member from membership in the reserve.
B. Members of the reserve, regardless of reserve rank, shall be sub-
ordinate to all sworn regular officers of the South San Francisco Police Depart-
ment.
SECTION 8. ENFORCEMENT AUTHORITY: POWERS AS PEACE OFFICERS.
Members of the reserve, while on duty, shall be deemed to have all of
the powers of a police officer of this City and of a peace officer of the
State of California, provided that such members qualify as a peace officer
in accordance with Penal Code Section 832.6, and provided further that such
member,s authority shall extend only for the duration of specific reserve assign-
ments. Members of the reserve shall not exercise any off-duty authority as
peace officers or police officers and have only the authority elected other
citizens under the Penal Code.
SECTION 9. CERTAIN ACTS PROHIBITED.
A. It is unlawful for any person to willfully resist, delay or obstruct
any member of the reserve in the discharge or attempt to discharge any duty
of his office.
B. It is unlawful for any person to falsely impersonate or represent
himself to be a member of the reserve.
C. It is unlawful for any person to wear, carry, display, use or
possess without authority, a badge, other insignia or uniform of the reserve.
SECTION 10. EQUIPMENT
The member shall provide itemg of equipment degignated by the Chief
of Police, subject to the approval of the City Manager. All items of equip-
ment and?or uniforms provided by the City of South San Francisco sh611 be
returned to the City upon termination of membership in the reserve.
SECTION 11. USE OF FIREARMS ON DUTY.
No member shall, while on duty or in public service, carry or use
any firearm unless he shall have completed a course of instruction in the
use of the same and have obtained a certificate to that effect signed by the
Chief of Police and countersigned by the officer in charge of such training.
SECTION 12. USE OF FIREARMS OFF DUTY.
No member shall carry~or use any firearm because of the fact of his
membership in the reserve while he is not on-duty or in public service un-
less he obtains a permit for the same as prescribed by law.
SECTION 13. TERMINATION OF MEMBERSHIP.
A. The membership of any member of the reserve may be terminated by
the Chief of Police, subject to the approval of the City Manager, at any time,
for any reason. Such termination may be without hearing or due process of
any ki nd.
B. A member of the reserve may terminate his own membership at any
time, but it shall be his duty to notify the Chief of Police, in writing, of
his resignation.
C. Upon termination of membership, whether voluntary or not, it shall
be the duty of the member to return any and all equipment, paraphernalia,
identification and badge issued to him or in his possession.

SECTION 14. PUBLICATION AND EFFECTIVE DATE.
This Ordinance shall be published once in the Enterprise-Journal, a
newspaper of general circulation in the City of South San Francisco, as re-
quired by law, and shall become effective thirty (30) days from and after
its adoption.
