The Commission has adopted a policy that applicants and their representatives have a maximum time limit of 20 minutes to make a presentation on their project. Non-applicants may speak a maximum of 3 minutes on any case. Questions from Commissioners to applicants or non-applicants may be answered by using additional time. Remote Public Comments: Members of the public wishing to participate are encouraged to submit public comments in writing in advance of the meeting. (Christopher Espiritu, Senior Planner) RECOMMENDATION Recommendation Staff recommends that the Planning Commission conduct a public hearing and take the following actions: 1.Adopt a resolution making findings and recommending that the City Council adopt a resolution approving an East of 101 Area Plan Amendment (SP21-0002). MOTION FOR THE COMMISSION TO ADOPT STAFF RECOMMENDATION: (1)Move to adopt the resolution recommending amendment to the East of 101 Area Plan. BACKGROUND/DISCUSSION On April 21,2022,the Planning Commission of the City of South San Francisco considered the project at 580 Dubuque Avenue (Project)and adopted a resolution making findings and recommending that the City Council, 1)adopt the Initial Study/Mitigated Negative Declaration (IS/MND)(EIR22-002)in accordance with Section 21080 of the California Public Resources Code and CEQA Guidelines Section 15070,and 2)adopt a resolution making findings and recommending that the City Council approve the entitlements request for the project including a General Plan Amendment (GPA21-0002),Transportation Demand Management Plan (TDM21- 0006),Design Review (DR21-0024),subject to the draft Conditions of Approval,and adopt an ordinance amending the Zoning Map (RZ21-0003)to rezone the project parcel as a Planned Development.The Planning Commission voted 6-0-1 in favor of the project’s approval. Prior to the Planning Commission Hearing,an errata memo was issued to note revisions to the entitlements resolution and present the Commission an additional Exhibit which reflects an additional action deemed appropriate for the project.Specifically,the project is located under the East of 101 Area Plan,adopted in 1994. The East of 101 Area Plan established primary development policies for the East of 101 Area and provided design policies that would be implemented by the City of South San Francisco,as development projects were proposed. Since the adoption of the East of 101 Area Plan in 1994,several changes in the East of 101 Area,and the overall City Planning landscape have occurred.Specifically,adoption of the General Plan (adopted 1999), Downtown Station Area Specific Plan (adopted February 2015),Oyster Point Specific Plan (adopted February 2011),and Genentech Campus Master Plan (adopted 1995,2007,and November 2020),have established land use policies and design standards that reflected the growth in the area more effectively.Therefore,the East of 101 Area Plan has not been in use and will be replaced by the upcoming General Plan Update (ShapeSSF 2022). Nevertheless,until formal adoption of the General Plan,the East of 101 Area Plan is an existing planning document and thus, staff is proposing to amend the Plan to accommodate the 580 Dubuque Avenue project. Entitlements Request The project is seeking to remove the site from the boundaries of the East of 101 Area Plan (Entitlements Resolution Exhibit A, as reference): -East of 101 Area Plan Amendment to remove the project parcel from the boundaries of the Area Plan and thus, not subject to the Land Use and Development Standard controls established in the Plan. ENVIRONMENTAL REVIEW Given that the project parcel would be removed from the boundaries of the East of 101 Area Plan,the Proposed Project would not be required to comply with the Environmental Impact Report prepared in 1994 for the Plan. Also,the project was fully analyzed under an IS/MND (File #22-275)prepared by Lamphier-Gregory,Inc.in accordance with the California Environmental Quality Act (CEQA). CONCLUSION As considered and recommended for approval to City Council,the proposed Office/R&D development continues to be consistent with both the General Plan 2040 goals and the Zoning Ordinance requirements.The East of 101 Area Plan does not reflect the current growth and diversity of land uses in the East of 101 and does not reflect the City’s current planning goals.Consequently,the Plan will be replaced by the impending General Plan Update. For these reasons, staff recommends that the Planning Commission take the following action: 1.Adopt a resolution making findings and recommending that the City Council adopt a resolution approving an East of 101 Area Plan Amendment (SP21-0002). Resolution Making Findings and Recommending that the City Council Approve an East of 101 Area Plan Amendment to Allow a New Office/R&D Development on 580 Dubuque Avenue WHEREAS,the applicant has proposed construction of an eight-story office and R&D building on the site,and 345 parking spaces (“Project”)located at 580 Dubuque Avenue (APN 015-021-998 and approximately 1.89 acres) referred to as “Project Site” in the City; and WHEREAS,the applicant seeks adoption of a resolution approving an East of 101 Area Plan Amendment (SP21-0002); and WHEREAS,approval of the applicant’s proposal is considered a “project”for purposes of the California Environmental Quality Act, Pub. Resources Code §21000, et seq. (“CEQA”); and WHEREAS,on April 21,2022,the Planning Commission for the City of South San Francisco held a lawfully noticed public hearing to solicit public comment and consider the Initial Study/Mitigated Negative Declaration (“IS/MND”)(EIR22-0002)and the proposed entitlements for 580 Dubuque Avenue (P21-0037:GPA21-002, RZ21-0003, TDM21-0006, and DR21-0024) take public testimony; and, WHEREAS,the Planning Commission reviewed and carefully considered the information in the IS/MND (EIR22-0002),and by resolution,recommended that the City Council adopt the IS/MND (EIR22-0002),as an objective and accurate document that reflects the independent judgment and analysis of the City in relation to the Project’s environmental impacts,and find that the IS/MND satisfies the requirements of the California Environmental Quality Act and no further environmental review is necessary; and WHEREAS,the Planning Commission reviewed and carefully considered the information in the proposed entitlements (P21-0037:GPA21-002,RZ21-0003,TDM21-0006,and DR21-0024),and by resolution recommended that the City Council approve the entitilements. NOW,THEREFORE,BE IT RESOLVED that based on the entirety of the record before it,which includes without limitation,the California Environmental Quality Act,Public Resources Code §21000,et seq. (“CEQA”)and the CEQA Guidelines,14 California Code of Regulations §15000,et seq.;the South San Francisco General Plan and General Plan EIR;the East of 101 Area Plan;the South San Francisco Municipal Code;the Project applications;the Project Plans,as prepared by Perkins and Will Architects,dated March 4, 2022;the Initial Study/Mitigated Negative Declaration,as prepared by Lamphier-Gregory,Inc.,dated January 19,2022;all site plans,and all reports,minutes,and public testimony submitted as part of the Planning Commission’s duly noticed May 5,2022 meeting;and any other evidence (within the meaning of Public Resources Code §21080(e)and §21082.2),the Planning Commission of the City of South San Francisco hereby finds as follows: City of South San Francisco Printed on 4/28/2022Page 1 of 2 powered by Legistar™14 File #:22-316 Agenda Date:5/5/2022 Version:1 Item #:2a. SECTION 1 FINDINGS East of 101 Area Plan Amendment 1.The Area Plan Amendment implements and is consistent with the General Plan and Preferred land Use Scenario for the General Plan 2040 Update; 2.The Area Plan Amendment will not be detrimental to the public interest,health,safety,convenience,or welfare of the City since the project will comply with adopted zoning standards in the surrounding area; 3.The Area Plan Amendment area is physically suitable for the proposed land use designation(s)and the anticipated development since it removes the project parcel from an outdated Area Plan that otherwise limits development in conflict with the selected General Plan Preferred Land Use Scenario; and 4.The proposed development pursuant to the Area Plan Amendment will be superior to development otherwise allowed under conventional zoning classifications and will be consistent with the General Plan Preferred Land Use Scenario. SECTION 2 DETERMINATION NOW,THEREFORE,BE IT FURTHER RESOLVED that the Planning Commission of the City of South San Francisco hereby recommends that the City Council make the findings contained in this Resolution and approve the amendment to the East of 101 Area Plan (SP21-0002),and make a determination that the amendment to the East of 101 Area Plan will not exceed established CEQA thresholds of significance and no additional environmental review is necessary.
