Lung Cancer Awareness Month, November 2006 - proclamation read by Mayor Fernekes . Fire Prevention Poster Contest Winners - Paramedic/Firefighters Steve Mann and John Grimaldi presented awards to grade school students Mathew Collins, Celeste Perez, William Vidak, Aryanna Cisneros Flores, Evelyn Gutierrez, Mauricio Ortega, Nicholas Banaria (not present), James Carl Fong, Nicole Strapeni, Domenic Delorenzi, Georgina Du, Nicolas Dino, Jimmy Millington, and Shelby Miguel (Recess: 7:58 p.m. - 8:20 p.m.) AGENDA REVIEW No changes. Mayor Fernekes requested the meeting be adjourned in memory of Maria Heredia and Kay Olson. PUBLIC COMMENTS Ms. Sara Watson, representing the Chamber of Commerce, introduced Chamber Executive Director, Maria Martinucci who assumed duties on November 1,2006. The following speakers and residents at Oyster Point Cove Marina, spoke with concern regarding the grading at the 333 Oyster Point Boulevard project site and the toxic contaminates that are being blown in the direction of the marina. Speakers addressed the contaminants that they're breathing (including radio active material), dissatisfaction with the project EIR and that it did not include people living at the marina, access to public records and EP A reports, property damage, dust control, enforcing the grading permit, health issues, medical expenses, the transportation of toxic material by truck, and protecting residents rights. Ms. Nina Smith Mr. Terry O'Rourke Mr. John Moses (informational packets submitted to Council) Mr. Casey and Mrs. Linda McMullen and son, William Mr. Steve Cundy Mr. Xenon Herrmann Mr. Rayvn Maloco Mr. Anthony Maloco Ms. Laurelyn Coleman Mr. Dustin Nolet Ms. Rae Crescenti All speakers urged Council to resolve the problem, have the site monitored and dust controlled. Councilmembers discussed with City Engineer Ray Razavi the grading permit mediation plan. He reported that an inspector has been assigned to the project to enforce dust control and the air quality board has not cited any violations. Councilmembers asked that the EP A reports be made available to the public, keep soil dampened and trucks covered, that the City Engineer visit the site and report back to Council on a weekly basis, and to work with the residents. ITEMS FROM COUNCIL . Announcements . Committee Reports Councilmembers reported on attendance at community and regional events and meetings, announced upcoming events and fundraisers, and acknowledged members of the community for their contributions. Vice Mayor Garbarino reported on the Fairfield subcommittee (Fernekes/Garbarino) meeting and that there are still some outstanding items to be resolved. Mayor Fernekes reported on the Centennial Way subcommittee (Fernekes/Matsumoto) meeting, the first kiosk was dedicated and the 3 mile parkway will be completed in 2008. . Appointment to RHNA Policy Advisory Committee With the consensus of Council, Mayor Fernekes appointed Councilwoman Matsumoto to the advisory committee. CONSENT CALENDAR 1. Motion to approve the minutes of October 11 and 25, 2006 2. Motion to confirm expense claims of November 8, 2006 in the amount of $1 ,587,268.57 3. Motion to cancel meeting of November 22,2006 and schedule special meeting of November 29, 2006 REGULAR CITY COUNCIL MEETING MINUTES NOVEMBER 8, 2006 PAGE 2 4. Acknowledgement of proclamation issued: David Casagrande, retiree, 10/27/06 Motion-Garbarino/Second-Addiego: To approve the Consent Calendar, as submitted. Unanimously approved by voice vote. ADMINISTRATIVE BUSINESS 5. Resolution amending the 2006-07 budget for changes identified in the first quarter financial review Staff report presented by Finance Director Steele. Director Steele reported the first quarter parking tax results were on track and the City Attorney's office has advised staff that the SFO parking structure is subject to the City's 8% parking tax; SFO has yet to be contacted. Councilwoman Matsumoto asked that the General Fund Summary page (Attachment C) include an "Expenditure" percentage change in the far right column. Report accepted as submitted. Motion-Matsumoto/Second-Garbarino: To approve Resolution No. 88-2006, amending the 2006-07 budget for changes identified in the first quarter financial review. Unanimously approved by voice vote. COUNCIL COMMUNITY FORUM No report. ADJOURNMENT Being no further business, Mayor Fernekes adjourned the meeting at 9:37 p.m. in memory of Kay Olson and Maria Heredia.
