AN ORDINANCE ADDING SECTION19.44.090(B)(3) TO
THE SOUTH SAN FRANCISCO MUNICIPAL CODE PROVIDING
LIMITED EXEMPTION FROM POSTING SECURITY FOR
SUBDIVISION IMPROVEMENTS
THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS
FOLLOWS:
SECTION 1. SECTION 19.44.090(B)(3) ADDED TO THE SOUTH SAN FRANCISCO
MUNICPAL CODE
There is hereby added to the South San Francisco Municipal Code Section
19.44.080(B)(3) which shall read as follows:
"Whenever an entity required to furnish security in accordance
with this Section is a California non-profit corporation,
funded by the United States of America or one of its agencies,
or funded by the State or one of its agencies, said entity shall
not be required to comply with this Section if the conditions
of Government Code §66499.3 are met."
SECTION II. SEVERABILITY
If any section, subsection, sentence, clause or phrase of this Ordinance
is for any reason held to be invalid or unconstitutional, such decision shall
not affect the validity or constitutionality of the remaining portion of this
Ordinance. The City Council hereby declares that it would have adopted this
Ordinance and each section, subsection, sentence, clause or phrase hereof,
irrespective of the fact that any one or more sections, subsections, sentences,
clauses or phrases be declared invalid or unconstitutional.
SECTION III. PUBLICATION AND EFFECTIVE DATE
This Ordinance shall be published in the "Enterprise-Journal," a newspaper
of general circulation in the City of South San Francisco, as required by law,
and shall become effective thirty (30) days from and after its adoption.
