AN ORDINANCE AMENDING SECTION 19.60.180 AND
ADDING SECTION 19.60.185 TO CHAPTER 19.60 OF
THE SOUTH SAN FRANCISCO MUNICIPAL CODE ENTITLED
"DEVELOPMENT AGREEMENTS."
THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS
SECTION 1. SECTION 19.60.180 OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE AMENDED.
Section 19.60.180 of the South San Francisco Municipal Code is hereby
amended to read as follows:
"Development Agreement, Duration.
Development Agreements shall be limited in duration as follows:
A. Development Agreements shall normally be limited in duration to a
period not to exceed five (5) years from the effective date of the adopting
ordinance.
B. Upon a finding by the City Council, based upon substantial evi-
dence, that a project is of such a magnitude that it cannot be reasonably
completed within five (5) years, the City Council may authorize the City to enter
into a Development Agreement of a duration reasonably sufficient to enable a
developer to complete said project if the project is pursued with reasonable
diligence.
C. Notwithstanding the foregoing, no Development Agreement entered
into by the City of South San Francisco shall be of a duration to exceed ten
(10) years from the effective date of the adopting ordinance; nor shall any
Development Agreement be extended so that it expires on a date which is later
than ten (10) years after the effective date of the original ordinance adopting
said Development Agreement."

SECTION 2. SECTION 19.60.185 ADDED TO THE SOUTH SAN FRANCISCO MUNICIPAL CODE.
Section 19.60.185 is added to the South San Francisco Municipal Code
and shall read as follows:
"19.60.185 Development Agreement, Periodic Review.
A. Notwithstanding the provisions of Section 19.60.180, periodic
reviews of the Development Agreement shall be conducted as follows:
(1) The City Council shall review the Development Agreement at
least once every twelve (12) months after the effective date of the adopting
ordinance (hereinafter "annual review").
(2) The City Council may, on its own motion or on the advice of
the City Manager, review the Development Agreement more often than once every
twelve (12) months as it is deemed necessary (hereinafter "special review").
(3) The City Council may delegate or refer the periodic review of
the Development Agreement to the Planning Commission or to the City Manager or
his designated representative."
SECTION 3. PUBLICATION AND EFFECTIVE DATE.
This Ordinance shall be published once in the Enterprise-Journal, a
newspaper of general circulation in the City of South San Francisco, as required
by law, and shall become effective thirty (30) days from and after its adoption.
