Home My WebLink AboutOrd 967-1984ORDINANCE NO. 967-84 AN ORDINANCE AMENDING SECTIONS 1.08.060, 2.20.020, 2.22.020A, 2.36.020 AND 3.12.010B, SUBSECTIONS 19.24.150B, 20.57.310C AND 20.57.530E AND CHAPTERS 13.28 AND 11.80 OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE AND CORRESPONDING SECTIONS OF CITY ORDINANCES AND ADDING TO SAID MUNICIPAL CODE SECTIONS 1.08.070, 1.08.080, 1.08.090 AND 1.08.100 (RELATING TO REORGANIZATION OF THE ADMINISTRATION OF THE CITY) THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCICO DOES ORDAIN AS FOLLOWS: SECTION 1. SECTIONS 1.08.060 OF THE MUNICIPAL CODE AND l(e) OF ORDINANCE NO. 658 AMENDED. Section 1.08.060 of the South San Francisco Municipal Code and Section l(e) of Ordinance No. 658 are hereby amended to read as follows: "1.08.060 Director of Public Works, Ecological Development or Public Services Whenever the Ordinances or Resolutions of the City or the provisions of this Code refer to the Director of Public Works, Director of Ecological Development, or Director of Public Services, the reference shall be construed to be the Deputy City Manager/City Engineer, Technical and Maintenance Services." SECTION 2. SECTIONS 1.08.070, 1.08.080, 1.08.090 AND 1.08.100 ADDED TO THE MUNICIPAL CODE Sections 1.08.070, 1.08.080, 1.08,090 and 1.08.100 are hereby added to the South San Francisco Municipal Code and shall read as follows: "1.08.070 Director of Community Development Whenever the Ordinances or Resolutions of the City or the provisions of this Code refer to the Director of Community Development, the reference shall be construed to be the Deputy City Manager, Community Development and Administration. 1.08.080 Director of Parks and Recreation Whenever the Ordinances or Resolutions of the City or the provisions of this Code refer to the Director of Parks and Recreation, the reference shall be construed to be the Director of Recreation and Community Services. 1.08.090 Department of Community Development Whenever the Ordinances or Resolutions of the City or the provisions of this Code refer to the Department of Community Development, the reference shall be construed to be the Planning Division. 1.08.100 Department of Public Services or Office of the Department of Public Services Whenever the Ordinances or Resolutions of the City or the provisions of this Code refer to the Department of Public Services or Office of the Department of Public Services, the reference shall be construed to be the Office of the Deputy City Manager/City Engineer, Technical and Maintenance Services." SECTION 3. SECTION 2.20.020 OF THE MUNICIPAL CODE AND SECTION 3 OF ORDINANCE NO. 728 AMENDED Section 2.20.020 of the South San Francisco Municipal Code and Section 3 of Ordinance No. 728 as amended by Ordinance Nos. 898 and 948 are hereby amended to add Subsections E and F to read as follows: "E. Deputy City Manager/City Engineer, Technical and Maintenance Services $500,000 F. Deputy City Manager, Community Development and Administration $500,000 SECTION 4. SUBSECTION 2.22.020A OF THE MUNICIPAL CODE AMENDED Subsection 2.22.020A of the South San Francisco Municipal Code is hereby amended to add Subdivision 12) thereto which shall read as follows: "(2) Deputy City Manager, Community Development and Administration" -2- SECTION 5. SUBSECTION 2.36.020 OF THE MUNICIPAL CODE AND SECTION 2 OF ORDINANCE NO. 288 AMENDED Subsection 2.36.020 of the South San Francisco Municipal Code and Section 2 of Ordinance No. 288 as amended by Ordinance No. 906 are hereby amended to read as follows: "In the absence of the City Manager or in the event of his temporary dis- ability to perform the duties of the office, the Deputy City Manager, Community Development and Administration, or some other properly qualified person appointed by the City Manager, shall perform the duties of the office of the City Manager." SECTION 6. SUBSECTION 3.12.010B AND SUBSECTION 6B OF ORDINANCE NO. 449 AMENDED ~ Subsection 3.12.010B and Subsection 6B of Ordinance No. 449 as amended from time to time are hereby amended to add the following offices: "Deputy City Manager, Community Development and Administration, Deputy City Manager/City Engineer, Technical and Maintenance Services, Director of Recreation and Community Services, Planning Director"; and to delete the following offices: "Assistant City Manger and his assistants, Director of Community Development, Director of Parks and Recreation, Director of Public Services/City Engineer." SECTION 7. CHAPTER 13.28 OF THE MUNICIPAL CODE AND ORDINANCE NO. 815 AMENDED Chapter 13.28 of the South San Francisco Municipal Code and Ordinance No. 815 entitled "The Street Tree Ordinance of the City of South San Francisco" are hereby amended so that all references therein to the "Director of Parks and Recreation" are changed to read "Deputy City Manager/City Engineer, Technical and Maintenance Services." SECTION 8. CHAPTER 11.80 OF THE MUNICIPAL CODE AND ORDINANCE NO. 412 AMENDED Chapter 11.80 of the South San Francisco Municipal Code and Ordinance No. 412 entitled "An Ordinance of the City of South San Francisco Regulating -3- Traffic Upon the Public Streets and Thoroughfares of said City and Establish- ing Truck Routes" are hereby amended so that all references therein to "Director of Public Works" or "Director of Public Services" are changed to read "Assigned Traffic Engineer." SECTION 9. SUBSECTION 19.24.150B OF THE MUNICIPAL CODE AND SUBSECTION 7.06b OF ORDINANCE NO. 861 AMENDED Subsection 19.24.150B of the South San Francisco Municipal Code and Subsection 7.06b of Ordinance No. 861 entitled the "Subdivision Ordinance of the City of South San Francisco" are hereby amended to read as follows: "No grading shall be commenced until a grading plan has been submitted to and approved by the City Engineer and a grading permit is issued by the City Engineer." SECTION 10. SUBSECTION 20.57.310C OF THE MUNICIPAL CODE AND SUBSECTION C7c OF EXHIBIT "A" TO ORDINANCE NO. 868 AMENDED The last sentence of Subsection 20.57.310C of the South San Francisco Municipal Code and the last sentence of Subsection C7c of Exhibit "A" to Ordinance No. 868, which ordinance established the Gateway Specific Plan Zone District, are hereby amended to read as follows: "The storm drain lines located in the public ri§~ts-of-way and/or public easements will be maintained by the City Public Works Division." SECTION 11. SUBSECTION 20.57.530E OF THE MUNICIPAL CODE AND SUBSECTION G4e OF EXHIBIT "A" TO ORDINANCE NO. 868 AMENDED Subsection 20.530E of the South San Francisco Municipal Code and Sub- section G4e of Exhibit "A" to Ordinance No. 868, which ordinance established the Gateway Specific Plan Zone District, are hereby amended so that the reference therein to the "Director of Public Services/City Engineer" is changed to read "City Engineer." -4- SECTION 12. SEVERABILITY. If any section, subsection, sentence, clause or phrase of this Ordi- nance is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council hereby declares that it would have adopted this Ordinance and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. SECTION 13. PUBLICATION AND EFFECTIVE DATE. This Ordinance shall be published once, with the names of those City Council members voting for or against the Ordinance, in the Enterprise-Journal, a newspaper of general circulation in the City of South San Francisco, as re- quired by law, and shall become effective thirty {30) days from and after its Introduced this lOth day of October 19 84 .
