HomeMy WebLinkAboutOrd 982-1985ORDINANCE NO. 982-~5 AN ORDINANCE REPEALING CHAPTER 3.36 OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE AND SECTIONS 20 AND 22 OF ORDINANCE NO. 449 ENTITLED "AN ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO RECREATING AND RE-ESTABLISHING A PERSONNEL SYSTEM FOR THE CITY OF SOUTH SAN FRANCISCO AND REPEALING ORDINANCE NO. 216 AND ALL INCONSISTENT ORDINANCES" AND ADDING CHAPTER 3.36 ENTITLED "POLITICAL ACTIVITY OF EMPLOYEES" THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS FOLLOWS: SECTION 1. CHAPTER 3.36 OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE AND SECTIONS 20 AND 22 OF ORDINANCE NO. 449 REPEALED Chapter 3.36 of the South San Francisco Municipal Code and Sections 20 and 22 of Ordinance No. 449 entitled "An Ordinance of the City of South San Francisco Recreating and Re-establishing a Personnel System for the City of South San Francisco and Repealing Ordinance No. 216 and all Inconsistent Ordinances" are hereby repealed. SECTION 2. CHAPTER 3.36 ENTITLED "POLITICAL ACTIVITY OF EMPLOYEES" ADDED. There is hereby added to the South San Francisco Municipal Code Chapter 3.36 which shall read as follows: Sections: 3.36.010 3.36.020 3.36.030 3.36.010 "Chapter 3.36 POLITICAL ACTIVITY OF EMPLOYEES Political activity defined. Activities prohibited. Adoption of pertinent provisions of State and Federal law. Political activity defined. For the purpose of this Chapter "Political Activity" is defined to include pamphleting, leafleting or active solitication for the purpose of espousing a particular candidate or cause or soliciting or receiving funds on behalf of a particular candidate or cause. 3.36~020 Activities prohibited~ The officers and employees of the City of South San Francisco are hereby prohibited from: A~ Engaging in any political activity during those hours that the officer or employee should be discharging the duties of his or her position. B. Engaging in any political activity on any premises owned or leased by the City of South San Francisco excluding City streets, rights-of-way, City parks and City premises which are normally made available for use by the public for meetings. 3.36.030 Adoption of provisions of State and Federal law. Except as specifically provided in Section 3.36.020 the political activities of the officers and employees of the City of South San Francisco shall conform to the pertinent provisions of State and Federal law." SECTION 3. SEVERABILITY. If any section, subsection, subdivision, sentence, clause or phrase of this ordinance is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council hereby declares that it would have adopted this Ordinance and each section, subdivision, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses or phrases be declared invalid or unconstitutional. SECTION 4. PUBLICATION AND EFFECTIVE DATE. This Ordinance shall be published once, with the names of those City Council members voting for or against the Ordinance, in the Enterprise-Journal, a news- paper of general circulation in the City of South San Francisco, as required by law, and shall become effective thirty (30) days from and after its adoption. regular day of May AYES: Introduced this 8th day of May , 1985.
