HomeMy WebLinkAboutPC Meeting 09-16-21 (Reso 2874-2021) - 201 Baden RESOLUTION NO. 2874-2020 PLANNING COMMISSION, CITY OF SOUTH SAN FRANCISCO STATE OF CALIFORNIA RESOLUTION MAKING FINDINGS AND DETERMINING THAT THE DISPOSITION OF THE CITY OF SOUTH SAN FRANCISCO-OWNED PROPERTIES LOCATED AT 201 BADEN AVENUE (APN 012-335-100 AND APN 012-335-110), FOR RESIDENTIAL AND COMMERCIAL PURPOSES, IN THE DOWNTOWN TRANSIT CORE IS IN CONFORMITY WITH THE SOUTH SAN FRANCISCO ADOPTED GENERAL PLAN IN ACCORDANCE WITH PROVISIONS OF STATE PLANNING LAW (GOVT. CODE SECTION 65402) WHEREAS, the City of South San Francisco (“City”) is the owner of certain real properties located in the City of South San Francisco, California, known as County Assessor’s Parcel APN 012-335- 100 and APN 012-335-110 (“201 Baden Avenue”); and, WHEREAS, 201 Baden Avenue is a City-owned retired firehouse; and, WHEREAS, the 201 Baden firehouse is currently vacant and the parking lot is used as public parking; and, WHEREAS, in September 2017, the City issued a Request for Qualifications (“RFQ”) to select a developer who would create a high quality, mixed-use, transit-oriented development on 201 Baden; and, WHEREAS, the City selected a developer team that proposed to retain and restore the firehouse for commercial purposes on one half of the site and develop housing on the second half of the site was selected; and, WHEREAS; pursuant to the Exclusive Negotiating Rights Agreement (“ENRA”) executed on March 4, 2019, the City has been exclusively negotiating with Firehouse Work LLC (“Firehouse Work “) for the sale 201 Baden; and, WHEREAS, Firehouse Work secured Eden Housing Inc. (“Eden Housing”) (collectively “Developers”) as a new affordable housing developer partner and the City, Firehouse Work and Eden Housing entered into the Second Amendment to the Second ENRA on May 28, 2021; and, WHEREAS, Eden Housing are in the process of acquiring the adjacent site (the KFC/Taco Bell site). Eden Housing will complete a site assemblage and develop a multi-use project that includes 82 Below Market Rate (“BMR”) units and some ground floor commercial to replace the KFC/Taco Bell; and, WHEREAS, the City and Developers will execute Purchase and Sale Agreements (“PSAs”) for the sale and conveyance of 201 Baden; and, WHEREAS, prior to disposition of real property owned by the City, the Planning Commission as the planning agency for the City is required to find such disposition is in conformity with the adopted general plan in accordance with Government Code section 65402; and, WHEREAS, Developers will submit their Planning applications once the PSAs are executed and become effective; and, WHEREAS, the General Plan Land Use Designation for the 201 Baden property is Downtown Transit Core, which includes specific policies related to development within the Downtown in an effort to “Promote infill development, intensification, and reuse of currently underutilized sites”, to “Preserve and enhance the character of existing downtown neighborhoods while continuing to encourage modest intensifications of use as currently allowed” and to “Revitalize Downtown South San Francisco as a citywide destination that is economically vital, diverse, active, and that encompasses a variety of uses”; and, WHEREAS, the restoration and historic preservation of the Firehouse for Commercial Uses and development of the vacant parking lot for affordable housing will achieve the Downtown Station Area Specific Plans Guiding Principles. NOW THEREFORE, based on the entirety of the record before it, the Planning Commission of the City of South San Francisco hereby finds as follows: A. General Findings 1. The foregoing recitals are true and correct and made a part of this resolution. 2. The documents and other material constituting the record for these proceedings are located at the Planning Division for the City of South San Francisco, 315 Maple Avenue, South San Francisco, CA 94080, and in the custody of the Chief Planner, Tony Rozzi. 3. The 201 Baden project is consistent with the General Plan which promotes infill development and the intensification of an underutilized site for higher density residential. The General Plan Land Use Designation for the 201 Baden property is Downtown Transit Core, which includes specific policies related to development within the Downtown in an effort to “Promote infill development, intensification, and reuse of currently underutilized sites”. The proposed sale of the property and the entitlements that will ensue for this project will provide for higher density residential than what is currently allowed but will still be compatible in scale with the remaining Downtown residential districts. The proposed project will provide a mix of housing opportunities and continue to conform to the General Plan Land Use Policies. NOW, THEREFORE, BE IT FURTHER RESOLVED that in accordance with California Government Code section 65402, the Planning Commission hereby finds that the location, purpose and extent of the proposed disposition of 201 Baden Avenue (APN 012-335-100 and APN 012- 335-110), is in conformity with the City’s adopted General Plan. * * * * * I hereby certify that the foregoing resolution was adopted by the Planning Commission of the City of South San Francisco at a regular meeting held on the 16th day of September, 2021 by the following vote: AYES: Chair Evans, Vice-Chair Shihadeh, Commissioner Faria, Commissioner De Paz Fernandez, Commissioner Murphy, Commissioner Funes, Commissioner Tzang NOES: ABSTENTIONS: ABSENT: RECUSE: Attest_/s/Tony Rozzi________ Secretary to the Planning Commission
