HomeMy WebLinkAboutPC Meeting 10-15-20 (Reso 2867-2020) - Genentech 1 RESOLUTION NO. 2867-2020 PLANNING COMMISSION, CITY OF SOUTH SAN FRANCISCO STATE OF CALIFORNIA RESOLUTION MAKING FINDINGS AND RECOMMENDING THAT THE CITY COUNCIL ADOPT FINDINGS AND CERTIFY THE ENVIRONMENTAL IMPACT REPORT, INCLUDING ADOPTION OF THE STATEMENT OF OVERRIDING CONSIDERATIONS AND MITIGATION MONITORING AND REPORTING PROGRAM FOR THE GENENTECH 2020 MASTER PLAN UPDATE WHEREAS, the City of South San Francisco (“City”) Planning Division staff, Genentech, Inc. staff, and Lamphier-Gregory consultants have prepared the Genentech 2020 Master Plan Update to guide the development of the Genentech campus over a period of fifteen (15) years to create a vibrant, transit supported, state of the art research, office, and manufacturing campus for the life sciences and that includes amendments to Chapter 20.260 of the South San Francisco Zoning Ordinance (collectively, “2020 Master Plan”); WHEREAS, the City determined that an Environmental Impact Report (EIR) was required to evaluate the impacts of the proposed 2020 Master Plan; and WHEREAS, a Notice of Preparation was originally issued on May 24, 2017 and a draft environmental impact report was prepared and circulated for public review from November 8, 2019 to December 23, 2019; and WHEREAS, the Planning Commission participated in a joint study session with the City Council on the 2020 Master Plan at a meeting on September 23, 2019, and held a duly noticed meeting during the review period on December 19, 2019 to take public comment on the DEIR; and WHEREAS, the City prepared written responses to comments received on the DEIR and prepared a FEIR for circulation, which consists of the DEIR (incorporated by reference), all comments received on the DEIR, written responses to comments received on the DEIR, and revisions to the DEIR; and WHEREAS, the Planning Commission has reviewed and carefully considered the information in the Draft EIR and the Final EIR (collectively, “EIR”) at a duly noticed public hearing held on October 15, 2020, made the findings attached to this Resolution, and recommends certification of the EIR, as an objective and accurate document that reflects the independent judgment of the City in the identification, discussion and mitigation of the 2020 Master Plan’s environmental impacts; and WHEREAS, where feasible, mitigation measures have been incorporated into the Project to reduce identified impacts to a level of less than significant; and WHEREAS, no feasible mitigation exists for certain significant and unavoidable impacts that would reduce the impacts to a less-than-significant level; and WHEREAS, the 2020 Master Plan cannot be approved unless a Statement of Overriding Considerations is adopted which evaluates the benefits of the proposed 2020 Master Plan against its unavoidable impacts and the 2020 Master Plan offers specific benefits as stated in the Statement of Overriding Considerations (attached as Exhibit B and incorporated herein). NOW, THEREFORE, BE IT RESOLVED that based on the entirety of the record before it, which includes without limitation, the California Environmental Quality Act, Public Resources Code §21000, et seq. (“CEQA”) and the CEQA Guidelines, 14 California Code of Regulations §15000, et seq.; the South San Francisco General Plan and General Plan EIR, including all amendments and updates thereto; the South San Francisco Municipal Code; the Genentech 2020 Master Plan Update, prepared by Lamphier-Gregory; the draft Zoning Ordinance Amendment for Chapter 20.260 Genentech Master Plan Zoning District, the Genentech Campus Master Plan EIR, including the Draft and Final EIR, and all appendices thereto; all reports, minutes, and public testimony submitted as part of the City Council and Planning Commission Joint Study Session on September 23, 2019; all reports, minutes, and public testimony submitted as part of the Planning Commission’s duly noticed December 19, 2019 meeting; all reports, minutes, and public testimony submitted as part of the Planning Commission’s duly noticed October 15, 2020 meeting; and any other evidence (within the meaning of Public Resources Code §21080(e) and §21082.2), the Planning Commission of the City of South San Francisco hereby finds as follows: 1. The foregoing recitals are true and correct and made a part of this Resolution. 2. The exhibits and attachments, including the Environmental Impact Report for the Genentech Campus Master Plan Update (Draft EIR attached as Exhibit Aa; Draft EIR Technical Appendices attached as Exhibit Ab; Final EIR attached as Exhibit Ac), the CEQA Findings, including the Statement of Overriding Considerations (attached as Exhibit B), and the Mitigation Monitoring and Reporting Program (attached as Exhibit C), are each incorporated by reference as part of this Resolution, as if set forth fully herein. 3. The documents and other material constituting the record for these proceedings are located at the Planning Division for the City of South San Francisco, 315 Maple Avenue, South San Francisco, CA 94080, and in the custody of Chief Planner, Sailesh Mehra. 4. Based on the Planning Commission’s independent judgment and analysis, the Planning Commission makes the findings regarding the Plan's significant and unavoidable impacts, potentially significant impacts, and less than significant impacts; makes the findings regarding the proposed mitigation measures, and the Project alternatives; and recommends adoption of the Statement of Overriding Considerations, finding that the benefits of the Project outweigh the Project’s significant and unavoidable environmental impacts, for the reasons set forth in Exhibit B, attached hereto and incorporated by reference. BE IT FURTHER RESOLVED that the Planning Commission of the City of South San Francisco hereby recommends that the City Council make the CEQA Findings and adopt the Statement of Overriding Considerations, attached as Exhibit B, adopt the Mitigation Monitoring and Reporting Program, attached as Exhibit C, and certify the EIR for the Genentech Campus Master Plan Update (EIR 17-0002) attached as Exhibit Aa, Exhibit Ab, and Exhibit Ac.
