HomeMy WebLinkAboutPC Meeting 06-15-17 (Reso 2803-2017) - Tentative Reparcelization Map RESOLUTION NO. 2803-2017 PLANNING COMMISSION, CITY OF SOUTH SAN FRANCISCO STATE OF CALIFORNIA RESOLUTION APPROVING A TENTATIVE PARCEL MAP TO REPARCELIZE THE OYSTER POINT REDEVELOPMENT PROJECT PROPERTY TO ALLOW SEPARATE PARCELS FOR EACH OF THE SEPARATE DEVELOPMENT PHASES WHEREAS, in March of 2011, the City of South San Francisco (“City”) and the former Redevelopment Agency of the City of South San Francisco (“Successor Agency”) approved the Oyster Point Redevelopment Project (“Project”); and WHEREAS, the entitlements for the Project were intended to facilitate a public/private partnership to redevelop approximately 82 acres at Oyster Point (“Property”) and included a General Plan Amendment, Zoning Text Amendment, Precise Plan, Design Review, Transportation Demand Management Program, Development Agreement (“DA”) and a Disposition and Development Agreement (“DDA”); and WHEREAS, in furtherance of the Project, the Developer prepared a tentative map (“Tentative Map”) to reparcelize the Property to configure separate parcels for each of the office/R&D phases, the open space areas, the hotel parcel, and reconfigured roadways; and WHEREAS, in connection with the Tentative Map, fewer than five parcels are being conveyed to or from a non-governmental or non-public entity in accordance with Government Code Section 66426.5, and accordingly, the Tentative Map is being processed pursuant to the procedures outlined under South San Francisco Municipal Code (“SSFMC”) Section 19.48; and WHEREAS, SSFMC Section 19.48 requires the Planning Commission to consider the City Engineer and staff’s evaluation of the Tentative Map and make a determination as to whether the Tentative Map is in conformity with the Subdivision Map Act and the SSFMC; and WHEREAS, the City Engineer and other relevant City staff have reviewed and analyzed the Tentative Map and determined that the Tentative Map complies with the requirements of SSFMC Title 19 and the Subdivision Map Act and recommend that the Planning Commission approve the Tentative Map; and WHEREAS, the Planning Commission considered the Tentative Map at its duly noticed public hearing on June 15, 2017. NOW, THEREFORE, BE IT RESOLVED that based on the entirety of the record before it, which includes without limitation, the California Environmental Quality Act, Public Resources Code §21000, et seq. (“CEQA”) and the CEQA Guidelines, 14 California Code of Regulations §15000, et seq.; the California Subdivision Map Act; the Tentative Map prepared by Wilsey Ham Engineering; the South San Francisco General Plan and General Plan EIR, including all amendments and updates thereto; the South San Francisco Municipal Code; all reports, minutes, and public testimony submitted as part of the Planning Commission’s duly noticed June 15, 2017 meeting and any other evidence (within the meaning of Public Resources Code §21080(e) and §21082.2), the Planning Commission of the City of South San Francisco hereby finds as follows: SECTION 1 FINDINGS I. General Findings 1. The foregoing recitals are true and correct and made a part of this Resolution. 2. The Exhibits including Tentative Map attached hereto as Exhibit A and the Conditions of Approval attached as Exhibit B are incorporated as if set forth fully herein. 3. The documents and other material constituting the record for these proceedings are located at the Planning Division for the City of South San Francisco, 315 Maple Avenue, South San Francisco, CA 94080, and in the custody of Chief Planner, Sailesh Mehra. 4. The Planning Commission finds that the Tentative Map is in conformity with the provisions of the Subdivision Map Act and Title 19 of the SSFMC as to design, drainage, utilities, road improvements and offers of dedication or deed. II. Chapter 19.48 Findings 1. The proposed Tentative Map, including the proposed designs and improvements, is consistent with the City’s General Plan and East of 101 Planning Sub-Area because the Tentative Map would facilitate the development of the larger Oyster Point Redevelopment Project, which would create a coordinated mixed-use campus development in the East of 101 Area. 1. 2. The proposed Tentative Map is consistent with the standards and requirements of the City’s Zoning Ordinance and with the provisions of the Oyster Point Specific Plan Zoning District. 2. 3. The Tentative Map complies and meets all of the requirements of Title 19 of the South San Francisco Municipal Code (“Subdivisions”) and with the requirements of the State Subdivision Map Act. 4. The Project site is physically suitable for the type of development and density proposed, as the mixed-use campus will be located in the Oyster Point Specific Plan area which calls for the coordinated development of research and development, commercial, open space and recreational land uses, and the size of the proposed development parcels is appropriate for the location and meet’s the City’s land use and zoning standards. 3. 5. The Tentative Map is consistent with the analysis included in the already certified EIR, and the approval of this Tentative Map would not result in any new significant environmental effects or a substantial increase in the severity of any previously identified effects beyond those disclosed and analyzed in the EIR certified by City Council (SCH # 2010022070) , nor does the Tentative Map constitute a change in the Project or change in circumstances that would require additional environmental review. 6. The design and improvements of the Tentative Map are not in conflict with any existing public easements. 7. The property is located in a developed, urban setting, and is not subject to a Williamson Act contract, on open space easement, a conservation easement, or an agricultural conservation easement. The surrounding land uses and resulting parcels would not support agricultural uses; the resulting parcels would result in mixed-use development not incidental to commercial agricultural use of the land. SECTION 2 DETERMINATION NOW, THEREFORE, BE IT FURTHER RESOLVED that the Planning Commission of the City of South San Francisco hereby makes the findings contained in this Resolution and approves the Tentative Map, attached hereto and incorporated herein as Exhibit A, subject to the conditions of approval attached as Exhibit B.
