HomeMy WebLinkAboutPC Meeting 03-07-13 (Reso 2730-2013) - PGE Easement GP ConsistencyRESOLUTION NO. 2730-2013 PLANNING COMMISSION, CITY OF SOUTH SAN FRANCISCO STATE OF CALIFORNIA A RESOLUTION FINDING THAT A PROPOSED GRANT OF A PUBLIC UTILITY EASEMENT TO PACIFIC GAS & ELECTRIC COMPANY IS CONSISTENT WITH THE SOUTH SAN FRANCISCO GENERAL PLAN WHEREAS, the California Legislature adopted, the Governor signed, and the California Supreme Court, in California Redevelopment Association, et al. v. Matosantos, (2012) 53 Cal.4th 231, upheld Assembly Bill x1 26 (“ABx1 26”); WHEREAS, pursuant to ABx1 26, all California redevelopment agencies were dissolved effective February 1, 2012; WHEREAS, pursuant to Resolution No. 8-2012, adopted by the City Council on January 25, 2012, the City of South San Francisco (“City”) agreed to serve as the successor agency to the Redevelopment Agency of the City of South San Francisco (“Successor Agency”) commencing upon the dissolution of the Redevelopment Agency on February 1, 2012; and WHEREAS, the Successor Agency is considering granting a public utility easement to Pacific Gas & Electric (“PG&E”) for an underground transmission gas pipeline on property formerly owned by the South San Francisco Redevelopment Agency, identified as APN 093- 331-050 & 060 (Centennial Way Park); and WHEREAS, Section 65402 of the California Government Code requires that the Planning Commission report to the City Council as to whether the proposed public utility easement grant conforms with the South San Francisco General Plan; and WHEREAS, the Planning Commission did receive information regarding the location, purpose and extent of the proposed public utility easement grant at a public meeting on March 7, 2013 and heard recommendations regarding this proposed action; and WHEREAS, the Planning Commission has considered the relevant portions of the South San Francisco General Plan with regards to the proposed public utility easement grant. NOW, THEREFORE, the Planning Commission of the City of South San Francisco does hereby Resolve as follows: 1. The foregoing recitals are true, correct, and incorporated herein by reference. 2. The proposed public utility easement grant conforms with the South San Francisco General Plan based on the following: A. The General Plan Parks and Recreation Element permits the City to use a public utility rights-of-way to develop linear parks. B. The Economic Development Element includes objectives for supporting public improvements, including road widening, sewer or water upgrades, and utility undergrounding. C. The following General Plan Guiding and Implementing Policies would support the intended use: 5.1-G-5 Develop linear parks in conjunction with major infrastructure improvements and along existing public utility and transportation rights- of-way. 5.1-I-7 Work with the Bay Area Rapid Transit (BART), Pacific Gas and Electric (PG&E) and the SFPUC to lease and develop linear parks on existing public utility and transportation rights-of-way in the city, where appropriate and feasible.
