AN ORDINANCE AMENDING CHAPTERS 2.36, 3.04, 3.24, AND 3.28
OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE CONCERNING THE
DUTIES AND RESPONSIBILITIES OF THE CITY MANAGER
THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS
FOLLOWS:
SECTION 1. Section 2.36.040 of the South San Francisco Municipal Code
is hereby amended to read:
Section 2.36.040 Powers and Duties
The city manager shall be the administrative head of the city govern-
ment. The city manager shall be responsible to the city council for the
efficient administration of all affairs of the city. In addition to general
powers as administative head, and not as a limitation thereof, it shall be the
duty of the city manager and the city manager shall have power:
A. To see that all laws of the state pertaining to the city and all
city ordinances are duly enforced;
B. To appoint, discipline and dismiss all appointed officers and
employees of the city, excepting the members of council-appointed boards and
commissions and the city attorney;
C. To establish, organize, and assign functions to such departments,
divisions, offices, and positions as considered necessary or appropriate, to
transfer employees from one department or division to another, where legally
permissible, to consolidate and combine departments, divisions, offices and
positions with the consent of the city council, and to assign responsibility for
performing functions to those management positions as are authorized by the city
council.
D. To make such rules and regulations as deemed necessary for the
administration of affairs of the city.
E. To attend all meetings of the city council and all meetings of
all committees thereof, unless excused therefrom by the city council or by the
committee;
F. To recommend to the city council for adoption such measures and
ordinances as deemed necessary or proper;
G. To keep the city council advised at all times as to the financial
conditions and needs of the city;
H. To prepare and submit an annual budget to the city council and be
responsible for its administration after its adoption.
I' To prepare and recommend the salary plan to the city council;
J~ To make and execute contracts on behalf of the city for commodities
or services included in the annual budget, or otherwise authorized by council
action.
K. To make investigations into the affairs of the city and each
department and division thereof; to make investigations with respect to all
contracts and obligations in which the city is a party;
L. To investigate all complaints in relation to all matters concern-
ing the administration of the government of the city; to investigate the service
required to be rendered by any public utility in the city, and to see that all
provisions of franchises, permits and privileges granted by the city are faith-
fully observed;
M. To exercise general supervision over all public buildings, public
parks and other public property which are under the control and jurisdiction of
the city;
N. To devote the entire time during customary working hours to the
duties and interests of the city;
O. To perform such other and additional duties and to exercise such
other and additional powers as may be vested in the city manager by statute,
ordinance or resolution, or otherwise delegated by the city council.
SECTION 2.
Section 2.36.050 of the South San Francisco Municipal Code
is hereby amended to read:
Section 2.36.050 Non-Interference with Administrative Service
Neither the city council nor any of its members shall interfere with the
execution by the city manager of the city manager's powers and duties, or directly
or indirectly order the appointment or removal, by the city manager or by any of
the department heads, of any person to any position in the city service. Except
for the purpose of inquiry, the city council and its members shall deal with the
administrative service solely through the city manager, and neither the council
nor any member thereof shall give orders to any subordinate of the city manager,
either publicly or privately. The city manager shall take orders and instructions
from the city council only when it is sitting in a lawfully held meeting.
SECTION 3. Section 3.04.020 of the South San Francisco Municipal Code
is hereby amended to read:

Section 3.04,020 Personnel officer
The city manager shall be ex officio personnel officer. The city manager
may delegate any of the powers and duties conferred as personnel officer under
this chapter and Chapters 3.12 through 3.36 to any other officer or employee of
the city, or may recommend that certain powers and duties be performed under
contract as hereinafter provided. The city manager as personnel officer shall:
A. Attend all meetings of the personnel board and serve as its
secretary or delegate to an employee of the city the responsibility to attend
all meetings of the personnel board and serve as its secretary;
B. Administer all the provisions of this chapter, and Chapters
3.12 through 3.36 and of the personnel rules not specifically reserved to
the council or the personnel board;
C. Prepare and recommend to the council revisions and amendments
to the personnel rules;
D. Prepare a position classification plan, including class specifi-
cations, and revisions of the plan. The plan and any revisions thereof shall
become effective upon approval of the city council;
E. Prepare a plan of compensation, and revisions thereof, covering
all classifications in the competitive service. The plan and any revisions
thereof shall become effective upon approval by the city council.
SECTION 4.
Section 3.24.010 of the South San Francisco Municipal Code
is hereby amended to read:
Section 3.24.010 Appointment to vacant positions
A. Appointments to vacant positions in the competitive service shall
be made in accordance with the personnel rules. Appointments and promotions
shall be based on merit and fitness to be ascertained by competitive examina-
tions. Examinations shall be used and conducted to aid in the selection of
qualified employees and shall consist of such recognized selection techniques
as achievement and aptitude tests, and other written tests, personal interview,
performance tests, evaluation of daily work performance, work sampler or any
combination of these, which will, in the opinion of the personnel board, test
fairly the qualifications of candidates. Physical, medical and agility tests
may be given as a part of any entrance examination. Physical and medical ex-
aminations may be required on promotional appointments when related to the
qualifications necessary to perform the duties of the classification.
B. In any recruitment examination the personnel board may include,
in addition to competitive tests, a qualifying test or tests and set minimum
standards therefor.

C. Appointment shall be made by the city manager upon the recommenda-
tion of the department head.
D. When recruitment or promotional appointment is to be made to a
vacancy in the competitive service, the personnel board shall transmit to the
appointing power the names of all persons on the appropriate certified employ-
ment or promotional list, in the order in which they appear on the list.
E. In the absence of appropriate employment lists, a provisional
appointment may be made by the appointing authority of a person meeting the
minimum training and experience qualifications for the position. Provisional
appointment of department heads, except that of city attorney, shall be made
by the city manager. Provisional appointments to other positions shall be
made by the appropriate department head. An employment list shall be established
within six months for any permanent position filled by provisional appointment.
The personnel board may, by a four-fifths vote, extend the period for the list
and provisional appointment for not more than thirty days, by any one action
not to exceed three such extensions.
F. Credits shall be allowed on promotional appointments for length
of time in service in grade after completion of the probationary period. The
schedule of the credits shall be set forth in the rules and regulations and the
applicant must obtain a passing grade on the examiation before such credits shall
be applied.
G. During the period of suspension of an employee, or pending final
action on proceedings to review suspension, demotion or dismissal of an employee,
such vacancy may be filled by the appointing authority, subject to the provisions
of this chapter Chapters 3.04 and 3.12 through 3.36, and the personnel rules.
SECTION 5.
Section 3.28.020 of the South San Francisco Municipal Code
is hereby amended to read:
Section 3.28.020 Demotion and discharge
Employees may be discharged or demoted for cause, and the rules and
regulations shall provide for the exercise of such powers by the city manager,
upon recommendation of the department head. A discharged department head may
be reinstated to the position in the competitive service held by the department
head immediately prior to appointment as department head or to an equivalent
position in the classification. An employee discharged from a position not in
the competitive service to which the employee was advanced from a position in
the competitive service may be reinstated to the position in the competitive
service held by the employee immediately prior to the advancement or to an
equivalent position in the classification.

SECTION 6~ Any ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 7. This ordinance shall be published once in the Enterprise-
Journal and shall become effective thirty (30) days from and after the date of
its adoption.
