RESOLUTION NO. 12-2007
CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION AMENDING THE NEPOTISM POLICY
WHEREAS, the City desires to revise its current nepotisln policy; and
WHEREAS, the City has consulted with employee group representatives regarding
the proposed amended policy and has further revised the policy in response to input from
the elnployee group representatives.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South
San Francisco that the City Council hereby approves the Nepotism Policy attached hereto
as Attachment 1.
BE IT FURTHER RESOLVED THAT the policy attached hereto as Attachment 1
shall replace Section 10.07 of the City's Personnel Rules and Regulations.

REVISED NEPOTISM POLICY
REPLACES CURRENT SECTION 10.07 OF
THE CITY'S PERSONNEL RULES AND REGULATIONS
The following policy shall govern theelnploYlnent of imlnediate family Inelnbers
of the City's elected officials, City Council appointees to commissions, and City
employees. This policy shall apply prospectively, and existing fmnily relationships that
were permitted under the prior Nepotism Policy prior to adoption of this revised Policy
may continue, so long as the elected officials, appointees and/or elnployees remain in the
smne positions or job classifications they held prior to adoption of this revised Policy.
A. F or purposes of this section, "iInlnediate fmnily" shall Inean spouse, domestic
partner registered with the State of California, parent, child, grandparent,
grandchild, brother, sister, including step and adoptive relationships for each of
these categories, as well as legal guardianship relationships.
B. City Elected Officials: During the tenn of a City elected official, including
Councillnelnbers, the City Clerk and City Treasurer, the City shall not elnploy
anyone in the City Council member's, City Clerk's or City Treasurer's ilnlnediate
fmnil y.
C. City Council Appointed Board of COlnlnissioners: During a City Council
appointed Board of COlllinissioner's official term, the City shall not elnploy
anyone in the Cormnissioner's imlnediate fmnily in a City job classification that
may require the elnployee to work on the same issue(s) on which the
Commissioner has authority to Inake recOlnlnendations or decisions. Appointed
COlnmissioners are not considered elnployees for purposes of this Nepotism
Policy.
D. City Manager / City Attorney: The City shall not elnploy anyone in the City
Manager's or City Attorney's imlnediate fmnily.
E. Other City Elnployees: For elnployees other than the City Manager, City
Attorney, City Clerk and City Treasurer, the City may not hire, prolnote, transfer
or elnploy an irmnediate family member within the same department, division or
facility if one immediate family member would be placed in such a position as to
directly supervise, evaluate or discipline the other immediate fmnily member, or
would be working as a manager in the same department, division or facility as the
other immediate family Inember. "Manager" as that term is used in this Nepotism
Policy includes the classifications set forth in Exhibit A to the Personnel Rules.
1. Limits on Employment of Immediate Family Members: No more than two
immediate family Inembers may, at any given time, work in the same
department, division or facility. Hourly employees shall not count toward
this two imlnediate family member InaxiInum. This subsection E.1. shall
not apply to either employees who Inarry or become domestic partners
while already working in the smne departlnent, division or facility, or to a
spouse or domestic partner seeking elnploYlnent in a departlnent, division
or facility in which his or her spouse or dOlnestic partner already works.
2. Co-Employees Who Marry or Become DOlnestic Partners: If co-
employees Inarry or become domestic partners, the appointing authority
shall:
a. Evaluate whether making reasonable efforts to assign job duties in
their current positions so as to Ininilnize problems of supervision,
safety, security or Inorale would sufficiently reduce or eliminate
potential conflicts of interest or other hazards to pennit the
continued elnploYlnent of both spouses or dOlnestic partners; and
b. If the appointing authority determines that job duties in their
current positions cannot be Inodified as described in Section E.2.a,
the City will determine whether an existing, funded and vacant
position for which one of the spouses or domestic partners is
qualified exists to which a spouse or domestic partner Inay be
transferred.
If neither assigmnent of job duties or a job transfer as described above resolve the
issue, then one of the spouses or dOlnestic partners will need to voluntarily leave
the spouse's or dOlnestic partner's position. If no spouse or domestic partner
volunteers, the City will either separate froln City service, or separate from
elnployment in the same departlnent, division or facility, whichever spouse or
dOlnestic partner has worked fewer years for the City in a full time status.

The classifications covered by this Exhibit A are Executive Managelnent, Public Safety
Managers and employees included in the Mid-Managelnent Unit. As of the date of
adoption of the City's revised Nepotisln Policy, these classifications are as follows:
