HomeMy WebLinkAboutPC Meeting 11-20-03 (Reso 2628-2003) - World Cup Soccer ResoRESOLUTION NO.2628-2003 PLANNING COMMISSION, CITY OF SOUTH SAN FRANCISCO STATE OF CALIFORNIA A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SOUTH SAN FRANCISCO RECOMMENDING THAT THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DENYZONING AMENDMENT ZA03- 0002 REGARDING AMUSEMENT ARCADES IN THE M-1 INDUSTRIAL ZONE DISTRICT AND DENY USE PERMIT MODIFICATION UPM03-0002 REGARDING MODIFICATION OF WORLD CUP SOCCER USE PERMIT AT 1416-1422 SAN MATEO AVENUE IN THE M-1 INDUSTRIAL ZONE DISTRICT. WHEREAS, the South San Francisco Planning Commission held a duly noticed public hearing on November 20, 2003; and, WHEREAS, the Planning Commission finds the proposed Zoning Amendment to allow an “amusement arcade” as a conditionally permitted use in the M-1 Zone District is not consistent with the General Plan which designates this site “Mixed Industrial”. As defined in the plan, the Mixed Industrial designation is intended to “provide and protect industrial lands for a wide range of manufacturing, industrial processing, general service, warehousing, storage and distribution, and service commercial uses…Unrelated retail and service commercial uses that could be more appropriately located elsewhere in the city would not be permitted…” NOW THEREFORE BE IT RESOLVED, as required by the “Use Permit Procedure” (SSFMC Chapter 20.81) the following findings are made in denial of a Use Permit Modification for an existing indoor soccer facility at 1422 San Mateo Avenue to: 1) include an amusement arcade; 2) expand the hours of operation to 8:00 am to 1:00 am; 3) allow laser tag as an additional use; 4) allow on-site sales of beer; 5) expand the use into the adjacent 14,850 sq ft. tenant space at 1416 San Mateo Avenue to include two (2) batting cages and a full size soccer field; and 6) approve existing unauthorized signs on property located in the M-1 Industrial Zone District, in accordance with SSFMC Chapter 20.30.040(a) and Chapters 20.87 and 20.91, based on public testimony and the materials submitted to the City of South San Francisco Planning Commission which include, but are not limited to: Application letter and plans submitted by Herb Martinez, applicant; Planning Commission staff report dated November 20, 2003, including all attachments; and testimony received at the Planning Commission meeting of November 20, 2003. 1. The proposed project is not consistent with the City’s General Plan which designates Draft Planning Commission Resolution Subject: World Cup Soccer Date: November 20, 2003 Page 2 of 3 the site Mixed Industrial. The General Plan does not support the proposed expansion of a commercial use within an industrially designated area. The Mixed Industrial designation is intended to “provide and protect industrial lands for a wide range of manufacturing, industrial processing, general service, warehousing, storage and distribution, and service commercial uses…Unrelated retail and service commercial uses that could be more appropriately located elsewhere in the city would not be permitted…” ▪ Guiding Policy 3.2-G-1 – Maintain the industrial character in the area from roughly the Spruce Avenue corridor in the west to San Mateo Avenue in the east, and south of Railroad Avenue to the San Bruno BART station. ▪ Implementing Policy 3.2-I-4 – Don not permit manufacturing, warehousing or distribution on the sites designated for Regional Commercial facilities, and retail uses on sites designated as Mixed Industrial. 2. The proposed project would not comply with the standards and requirements of the Zoning Ordinance. The proposed hours of operation would negate the shared parking facilities agreement under which the original use permit was granted and which is needed to meet the minimum parking requirements for the use. 3. The proposed project would be adverse to the public health, safety and welfare. The facility is intended to serve children and young adults. The facility would be located in an industrial area with substantial heavy truck traffic and limited sight distances. Additionally, ther are insufficient parking spaces available on-site to serve the anticipated customers. As such, customers will be forced to park on the street, where they will be in closer contact with traffic of a heavy industrial nature and in an area which not been optimally designed for increased commercial activity. 4. The proposed sale of beer at the facility is not in the interest of the community. The area is considered an “overconcentration” area by ABC in that 5 permits are authorized in the Census tract and 29 are existing. Consequently, the city would have to issue a letter of public convenience to authorize an additional ABC license. The Police Department opposes the granting of such for several reasons, but primarily due to the fact that they have had several calls over the years regarding fighting at the site. In addition, the applicant has provided to the Police Department a list of problems they have resolved without need for police assistance, noting a Draft Planning Commission Resolution Subject: World Cup Soccer Date: November 20, 2003 Page 3 of 3 significant number of fights. Introduction of alcohol into this facility would likely exacerbate these occurrences. NOW, THEREFORE, BE IT FURHER RESOLVED that the Planning Commission hereby recommends that the South San Francisco City Council deny Zoning Ordinance Amendment ZA03-0002, and Use Permit Modification UPM03-0002, and this Resolution is effective immediately upon its passage and adoption. * * * * * I hereby certify that the foregoing resolution was adopted by the Planning Commission of the City of South San Francisco at the regular meeting held on the 20th day of November, 2003, by the following vote: AYES: Commissioner Giusti, Commissioner Honan, Commissioner Sim, Commissioner Teglia, Commissioner Zemke, Vice Chairperson Ochsenhirt and Chairperson Romero NOES: None ABSTAIN: None ABSENT: None ATTEST: Commission Secretary Thomas C.
