HomeMy WebLinkAboutPC Meeting 05-04-00 (Reso 2553-2000) - ECR Corridor 2nd Amend to Redev PlanS:\_ADMINISTRATIVE\Resolutions\2000\PC Meeting (Res0 2553-2000) - ECR Corridor 2nd Amend to Redev Plan.doc Resolution No. 2553-2000 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SOUTH SAN FRANCISCO REPORTING ON THE PROPOSED SECOND AMENDMENT TO THE REDEVELOPMENT PLAN FOR THE EL CAMINO CORRIDOR REDEVELOPMENT PROJECT, AND RECOMMENDING REMOVAL OF THE SOUTH SAN FRANCISCO HIGH SCHOOL SITE FROM THE SECOND AMENDMENT AREA, AND SUBJECT TO SUCH REMOVAL, RECOMMENDING ADOPTION OF THE PROPOSED SECOND AMENDMENT. WHEREAS, the Redevelopment Agency of the City of South San Francisco (“Agency”) has prepared and submitted to the Planning Commission of the City of South San Francisco (“Planning Commission”) a proposed Second Amendment to the Redevelopment Plan for the El Camino Corridor Redevelopment Project (“Second Amendment”); and WHEREAS, Sections 33346, 33347 AND 33354.6 of the Community Redevelopment Law (Health and Safety Code, Section 33000 et seq.) provides that the Planning Commission is to review the proposed Second Amendment and make its report and recommendations thereon to the Agency and the City Council of the City of South San Francisco (“City Council”), including a determination that the proposed Second Amendment conforms to the General Plan of the City of South San Francisco (“General Plan”); and WHEREAS, Section 65402 of the Government Code provides in part: “(a) If a general plan or part thereof has been adopted, no real property shall be acquired by dedication or otherwise for street, square, park or other public purposes, and no real property shall be disposed of , no street shall be vacated or abandoned, and no public building or structure shall be constructed or authorized, if the adopted general plan or part thereof applies thereto, until the location, purpose and extent of such acquisition or disposition, such street vacation or abandonment, or such public building or structure have been submitted to and reported upon by the planning agency as to conformity with said adopted general plan or part thereof….” “(c ) A local agency shall not acquire real property for any of the purposes specified in paragraph (a) nor dispose of any real property, nor construct or authorize a public building or structure, in any county or city, if such county or city has adopted a general plan or part thereof, until the location, purpose and extent of such acquisition, disposition, or such public building or structure have been submitted to and reported upon by the planning agency having jurisdiction, as to conformity with said adopted general plan or part thereof…”; and WHEREAS, the above required reports and recommendations, including matters referred to in Section 33346 of the Health and Safety Code and Section 65402 of the Government S:\_ADMINISTRATIVE\Resolutions\2000\PC Meeting (Res0 2553-2000) - ECR Corridor 2nd Amend to Redev Plan.doc Code, are to be made to the Agency and the City Council for their consideration in acting on the adoption of the Second Amendment; and WHEREAS, the territory proposed to be added to the El Camino Corridor Redevelopment Project by the Second Amendment (“Second Amendment Area”) includes property owned by the South San Francisco Unified School District (“School District”) on which the South San Francisco High School is located, and which property the School District has requested to be removed from the Second Amendment Area; and WHEREAS, the Planning Commission has considered the proposed Second Amendment, the School District’s request, and the General Plan and other pertinent reports and documents. NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF SOUTH SAN FRANCISCO, DOES RESOLVE AS FOLLOWS: Section 1. Findings. The Planning Commission hereby finds and determines that: (a) The property owned by the South San Francisco Unified School District, located at 400 B Street and identified as Assessor Parcel No. 014-160-050, should be removed from the Second Amendment Area prior to adoption of the proposed Second Amendment. (b) Subject to Finding (a) above, pursuant to Section 33346 of the Community Redevelopment Law, the proposed Second Amendment to the Redevelopment Plan for the El Camino Corridor Redevelopment Project (attached hereto as Attachment No. 1) conforms to the General Plan of the City of South San Francisco. (c ) Subject to Finding (a) above, pursuant to Section 65402 of the Government Code, with respect to public activities which may be undertaken within the area added by the Second Amendment and the original Project Area pursuant to the Redevelopment Plan, as amended by the Second Amendment, and that are referred to in said section, such activities and undertakings conform to the General Plan of the City of South San Francisco. Section 2. Report and Recommendations. The Planning Commission hereby reports to the Agency and the City Council the findings referred to in Section 1 hereof, and, subject to Finding (a) above, recommends the approval and adoption of said Second Amendment. In the event that prior to its adoption of the Second Amendment, the City Council desires to make any other minor, technical, or clarifying changes to the Second Amendment, the Planning Commission hereby finds and determines that any other such minor, technical, or clarifying changes need not be referred to it for further report and recommendation, and hereby waives its report and recommendation under Section 33347 of the Community Redevelopment Law concerning any such change. Section 3. Transmittal. The Planning Commission’s Secretary shall transmit a copy of this Resolution to the Agency and the City Council for consideration S:\_ADMINISTRATIVE\Resolutions\2000\PC Meeting (Res0 2553-2000) - ECR Corridor 2nd Amend to Redev Plan.doc as part of the Agency’s Report to the City Council pursuant to Section 33352 of the Community Redevelopment Law, and this Resolution shall be deemed the report and recommendations of the Planning Commission concerning the proposed Second Amendment and contemplated public projects and activities thereunder, as required by applicable provisions of law. NOW, THEREFORE, BE IT FURTHER RESOLVED that the Planning Commission hereby recommends to the Redevelopment Agency and the City Council of the City of South San Francisco (City Council ) recommending removal of the South San Francisco High School site from the Second Amendment Area, and subject to such removal, recommending adoption of the proposed Second Amendment; and I hereby certify that the foregoing resolution was adopted by the Planning Commission of the City of South San Francisco at the regular meeting held on May 4, 2000 , by the following vote: AYES: Commissioner Baldocchi, Commissioner D'Angelo, Commissioner Honan, Commissioner Romero, Commissioner Teglia, Vice Chairperson Meloni, and Chairperson Sim NOES: None ABSTAIN: None ABSENT: None ATTEST: Commission Secretary Thomas C.
