PLANNING COMMISSION OF THE CITY OF SOUTH SAN FRANCISCO,
STATE OF CALIFORNIA
A RESOLUTION RECOMMENDING ADOPTION OF AN
AMENDMENT TO THE TERRABAY SPECIFIC PLAN, AN
AMENDMENT TO MUNICIPAL CODE CHAPTER 20.63
(TERRABAY SPECIFIC PLAN DISTRICT), APPROVAL OF A
VESTING TENTATIVE MAP AND A PRECISE PLAN FOR
PHASE II OF THE TERRABAY DEVELOPMENT
WHEREAS, the existing Terrabay Specific Plan, Chapter 20.63 and the Terrabay Development
Agreement allow development of the Terrabay project (together the existing entitlements ), subject to
certain further approvals and entitlements; and
WHEREAS, the Terrabay project is divided into three separated phases, the first of which, Phase
I, is currently under construction and nearing completion; and
WHEREAS, the existing entitlements provide for development of 432 units of single family
dwelling and condominiums, an 18,000 sq ft health club, a 400 room hotel, 268,800 technology center,
three restaurants and a 57,500 square foot condominium office building; and
WHEREAS, in July 1997 the owner of Phase II and III, SunChase G.A. Inc. (Applicant ),
applied to the City to modify the Terrabay Specific Plan, amend the Chapter 20.63 of the Municipal Code
to modify the Phase II development and a precise plan for Phase II (the proposed entitlements ); and
WHEREAS, the proposed entitlements for Phase II would provide for development of a total of
289 residential dwelling units, divided between three neighborhoods (Woods and Point), consisting of
135 single family detached units, 154 duplex and triplex units; and
WHEREAS, the applicant modified the proposed entitlements by requesting the Commons
Neighborhood not be developed; and
WHEREAS, a Supplemental Environmental Impact Report has been prepared, which together
with the Environmental Impact Report prepared in 1982 and the 1996 Supplemental Environmental
Impact Report, analyze the anticipated environmental effects of the proposed Phase II development; and
WHEREAS, the Applicant has filed copies of the proposed vesting tentative map and all those
statements required under Municipal Code Chapters 19.40 and 19.50, including copies of the proposed
Covenants, Conditions and Restrictions (CC&Rs); and
WHEREAS, pursuant to Municipal Code section 19.40.080, copies of the proposed vesting
tentative map have been distributed to City staff and public agencies; and
WHEREAS, on February 25, 1999, the Planning Commission held a public hearing on the
proposed adoption of an amendment to the Terrabay Specific Plan, an amendment to Municipal Code
Chapter 20.63, a precise plan and a vesting tentative map for Phase II of the Terrabay Development; and
WHEREAS, proper notice of said hearing was given in all respects as required by law.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of South
San Francisco does hereby find that:
A. The proposed amendment to the Terrabay Specific Plan, the proposed amendment to
Municipal Code Chapter 20.63, the proposed precise plan and the proposed vesting
tentative map for Phase II of the Terrabay Development are consistent with the goals,
policies and implementing programs set forth in the General Plan, specifically General
Plan Planning Area #4, General Plan Policy 4-1, General Plan Goal #1 and Policies 1C
and 3C.
This finding is based upon the Planning Commission’s independent review of
relevant sections of the 1982 EIR and the 1996 Supplemental EIR and the entire
1999 SEIR and the General Plan, as well as the proposed amendment to the
Terrabay Specific Plan, the proposed amendment to Municipal Code Chapter
20.63, the proposed precise plan and the proposed vesting tentative map and the
1999 SEIR, as further explained by the February 25, 1999 Staff Report to the
Planning Commission.
B. Proper environmental documentation has been prepared on the proposed amendment to
the Terrabay Specific Plan, the proposed amendment to Municipal Code Chapter 20.63,
the proposed precise plan and the proposed vesting tentative map for Phase II of the
Terrabay Development in accord with the California Environmental Quality Act.
This finding is based upon the Planning Commission’s independent review of
relevant sections of the 1982 EIR and the 1996 Supplemental EIR, and the entire
1999 SEIR, and the finding and SEIR Mitigation Monitoring Program, and the
certification of the 1999 SEIR by the City Council.
C. The proposed amendment to the Terrabay Specific Plan, the proposed amendment to
Municipal Code Chapter 20.63, the proposed precise plan and the proposed vesting
tentative map for Phase II of the Terrabay Development will not have a substantial
adverse affect on health or safety or be substantially detrimental to the public welfare or
be injurious to property or public improvement.
This finding is based on the Planning Commission’s independent review of the
proposed amendment to the Terrabay Specific Plan, the proposed amendment to
Municipal Code Chapter 20.63, the proposed precise plan and the proposed
vesting tentative map, the SEIR and relevant sections of the 1982 EIR and the
1996 Supplemental EIR and the entire 1999 SEIR which demonstrate that any
threats to public health or safety from the proposed development have either been
avoided or mitigated to a level of less than significance; and that the proposed
development will finance circulation improvements, provide needed housing
stock, and further implement the long-term strategy for managing the
environmental, aesthetic and recreational resources of San Bruno Mountain.
D. The development and/or construction standards in the proposed precise plan for Phase II
of the Terrabay Development are designed to achieve compliance with the development
and/or construction standards of the Terrabay Specific Plan.
This finding is based upon testimony from the City staff in the Staff Report for
the February 25, 1999 hearing and in oral testimony at the hearing that
development and/or construction standards in the proposed precise plan meet or
exceed those required by the Specific Plan.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Planning Commission of the
City of South San Francisco does hereby recommend that the City Council of the City of South San
Francisco:
A. Adopt the proposed amendment to the Terrabay Specific Plan attached hereto as Exhibit
1 and incorporated herein by reference.
B. Adopt the proposed amendment to Municipal Code Chapter 20.63 attached hereto as
Exhibit 2 and incorporated herein by reference.
C. Approve the proposed vesting tentative map attached hereto as Exhibit 3 and
incorporated herein by reference subject to the conditions of approval attached hereto as
Exhibit A and incorporated herein by this reference.
D. Adopt the proposed precise plan attached hereto as Exhibit 4 and incorporated herein by
reference subject to the conditions of approval attached hereto as Exhibit A and
incorporated herein by this reference.
