HomeMy WebLinkAboutPC Meeting 03-18-99 (Reso 2540-1999) - Terraby 3-18-99 DARESOLUTION NO. 2540-1999 PLANNING COMMISSION OF THE CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION RECOMMENDING ADOPTION OF A RESTATED AND AMENDED DEVELOPMENT AGREEMENT FOR PHASE II OF THE TERRABAY DEVELOPMENT WHEREAS, the existing Terrabay Specific Plan, Chapter 20.63 and the Terrabay Development Agreement allow development of the Terrabay project (together the “existing entitlements”), subject to certain further approvals and entitlements; and WHEREAS, the Terrabay project is divided into three separate phases, the first of which, Phase I, is currently under construction and nearing completion; and WHEREAS, in July 1997 the owner of Phase II and III, SunChase G.A. Inc. ("Applicant"), applied to the City to amend the Terrabay Development Agreement and to approve related entitlements for Phase II and III of the Terrabay development (the "proposed entitlements"); and WHEREAS, a Supplemental Environmental Impact Report prepared in 1998 to 1999, which together with the Environmental Impact Report prepared in 1982 and the Supplemental Environmental Impact Report prepared in 1996, analyzes the anticipated environmental impacts of the proposed Phase II and III; and WHEREAS, the Applicant instructed the City to process the proposed entitlements for Phase II separate from the proposed entitlements for Phase III; and WHEREAS, pursuant to Municipal Code section 19.60.050, the Director of Community Development reviewed the application to amend the Terrabay Development Agreement; and WHEREAS, the propsed Restated and Amended Develpoment Agreement for Phase II of the Terrabay Development relates only to Phase II; and WHEREAS, pursuant Municipal Code sections 19.60.050 and 19.60.060, the Director of Community Development found the proposed Restated and Amended Development Agreement for Phase II to be in the proper form, determined that the application was complete, and referred the application and Agreement to the Planning Commission for a public hearing; and WHEREAS, on February 25, 1999 and March 18, 1999, the Planning Commission held a public hearing on the proposed Restated and Amended Development Agreement for Phase II of the Terrabay Development; and WHEREAS, proper notice of said hearing was given in all respects as required by law. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of South San Francisco does hereby find that: A. Proper environmental documentation has been prepared on the proposed Restated and Amended Development Agreement for Phase II of the Terrabay Development in compliance with the California Environmental Quality Act. This finding is based upon the Planning Commission's independent review of the proposed Restated and Amended Development Agreement, relevant sections of the 1982 EIR and the 1996 SEIR, and the entire 1998-1999 SEIR, and the finding and mitigation monitoring program for the SEIR and the Planning Commission’s determination that these documents satisfy the requirements of the California Environmental Quality Act. B. The proposed Restated and Amended Development Agreement for Phase II of the Terrabay Development is consistent with the objectives, policies, general land uses and programs specified in the General Plan and the amended Terrabay Specific Plan as recommended to be amended. This finding is based upon the Planning Commission’s independent review of the General Plan and the proposed Restated and Amended Development Agreement for Phase II of the Terrabay Development. C. The proposed Restated and Amended Development Agreement for Phase II of the Terrabay Development is compatible with the uses authorized in and the regulations prescribed for the Terrabay Specific Plan District as recommended to be amended. This finding is based on the Planning Commission's independent review of the proposed amendments to the Terrabay Specific Plan District and the proposed Agreement. D. The proposed Restated and Amended Development Agreement for Phase II of the Terrabay Development is in conformity with public convenience, general welfare and good land use practice. This finding is based on the Planning Commission's independent determination that the Agreement will finance circulation improvements, provide needed housing stock, and further implement the long- term strategy for managing the environmental, aesthetic and recreational resources of San Bruno Mountain. E. The proposed Restated and Amended Development Agreement for Phase II of the Terrabay Development will not be detrimental to the health, safety and general welfare. This finding is based upon the Planning Commission’s independent review of the proposed Restated and Amended Development Agreement for Phase II of the Terrabay Development, and the proposed entitlements, including the CEQA documents described in paragraph A above, which demonstrate: (1) that any threats to public health or safety from the project have either been avoided or mitigated to a level of less than significance; and (2) that the Agreement will finance circulation improvements, provide needed housing stock, and further implement the long-term strategy for managing the environmental, aesthetic and recreational resources of San Bruno Mountain. F. The proposed Restated and Amended Development Agreement for Phase II of the Terrabay Development will not adversely affect the orderly development of property or the preservation of property valued. This finding is based upon the extensive study, planning and analysis, by both City staff and the Applicant's technical consultants, of the Terrabay project and the proposed entitlements for Phase II. City staff testified orally at the March 18, 1999 hearing and in the Staff Report for the hearing that the Agreement would help the City achieve long-term circulation improvement objectives and would otherwise be consistent with good planning practice for the proposed Phase II development area. NOW, THEREFORE, BE IT FURTHER RESOLVED that Planning Commission of the City of South San Francisco does hereby recommend that the City Council of the City of South San Francisco approve the proposed Restated and Amended Development Agreement for Phase II of the Terrabay Development, attached hereto as Exhibit 1 and incorporated herein by reference. * * * * * * * I hereby certify that the foregoing Resolution was regularly introduced and adopted by the Planning Commission of the City of South San Francisco at a regular meeting held on the 18th day of March, 1999 by the following vote: AYES: Chairperson Honan, Vice Chairperson Sim and Commissioner Romero NOES: Commissioner Baldocchi and Commissioner Teglia ABSTAIN: None ABSENT: None ATTEST: Commission Secretary J:\WPD\MNRSW\405\35\RESO\1999\PH2PCDA.212 AUL:rja
