HomeMy WebLinkAboutPC Meeting 12-02-99 (Reso 2549-1999) - Jalisco 1 RESOLUTION NO. 2549-1999 PLANNING COMMISSION, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA RESOLUTION MODIFYING USE PERMIT 98-019 WHEREAS, Permit 98-019 allows outside display of fresh produce at 441 Grand Avenue in accordance with SSFMC 20.26.060(b); and WHEREAS, numerous violations of the requirements and conditions of said Permit have been reported to the City, documented and discussed in properly noticed Planning Commission meetings; and WHEREAS, City Staff has worked with the property owner to attempt to address the alleged violations; and WHEREAS, on June 17, 1999, the Planning Commission ordered a hearing to consider the revocation or modification of Use Permit 98-019; and WHEREAS, on July 15, 1999 the Planning Commission held a properly noticed hearing pursuant to SSFMC 20.91.030 to consider whether or not to revoke or modify said Use Permit. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of South San Francisco finds based upon all of the evidence in the record, including without limitation, the Staff Report for the July 15, 1999 Planning Commission meeting, the Staff Report for the November 4, 1999 Planning Commission meeting, the Staff Report for the December 2, 1999 Planning Commission meeting, and testimony presented at said meetings: (1) Condition "C" of Use Permit 98-019 has been violated by the placement of miscellaneous items including plywood panels and the backs of display cases in front of windows. (2) Condition ā€œJā€ of Use Permit 98-019 has been violated by the placement of vehicles, boxes, and delivery equipment in the public right-of-way; and by the failure to bring deliveries immediately into the store. Delivery trucks, boxes and equipment are regularly placed within the public right-of-way so as to partially block it for 2 to 3 hours per day. Daily deliveries are staged on the public sidewalk while the merchant brings them into the store over a period of 2 to 3 hours. (3) That the property for which Use Permit 98-019 was issued has been maintained in such a way as to be detrimental to public health, welfare and safety because it has blocked traffic, obstructed public sidewalks and made the area unattractive to shoppers. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of South San resolves that Use Permit 98-019 is hereby modified by adding the following two additional conditions to the Permit: (1) The front of the property, including the entry, shall be kept clear of any boxes, milk crates, or other items other than the approved display units. 2 (2) Loading and unloading is authorized at the rear of the building only. Deliveries made at the rear of the building shall not block one-way vehicular access through the lane. (3) The display units shall be finished as graphically illustrated at the Planning Commission meeting dated 12/2/99. * * * * * I hereby certify that the foregoing Resolution was regularly introduced and adopted by the Planning Commission of the City of South San Francisco at a regular meeting held on the 2nd day of December , 1999 by the following vote: AYES: Commissioner Baldocchi, Commissioner Meloni, Commissioner Romero, Commissioner Teglia, Vice Chairperson Sim and Chairperson Honan NOES: None ABSTAIN: None ABSENT: Commissioner D'Angelo ATTEST: Thomas C.
