HomeMy WebLinkAboutReso 15-2007 RESOLUTION NO. 15-2007 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF AN AFFORDABLE HOUSING AGREEMENT IN CONNECTION WITH THE FINAL TERRABA Y PHASE III SPECIFIC PLAN FROM TERRABA Y PARTNERS, LLC WHEREAS, Terrabay Partners, LLC ("Developer") is required under the approved Final Terrabay Specific Plan and 2006 Terrabay Project conditions of approval (Resolution 82-2006, October 11, 2006) to construct 32 llloderate incOllle units affordable to households earning 120% of the area-wide median incollle in San Mateo County; and WHEREAS, the Developer was required to construct these 32 units pursuant to Terrabay Specific Plan approvals granted in October 2000; and WHEREAS, the 2000 Terrabay Project was approved prior to the City adopting its Inclusionary Housing Ordinance; and WHEREAS, the 2006 Terrabay Amendment carried forward the 32 unit requirement and is tied to Phase III commercial entitlements; and WHEREAS, City of South San Francisco has reviewed the 2006 Terrabay Project and determined that the construction of 32 units may be constructed off site of the Project Property which has been approved for office and cOllllllercial uses and does not include residential uses on the Proj ect Property; and WHEREAS, the City Council Condition of Approval A-20 requires the Developer to enter into an Affordable Housing Agreelllent with the City to guarantee construction of the 32 affordable units. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that the City Council hereby authorizes the Affordable Housing Agreelllent between the City of South San Francisco and Terrabay Partners, LLC for Terrabay Phase III. BE IT FURTHER RESOLVED that the City Manager and the City Attorney are hereby authorized to execute the agreements on behalf of the City of South San Francisco. * * * * * I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular Ineeting held on the 28th day of March 2007 by the following vote: AYES: Councihnelnbers Mark N.
