AN ORDINANCE AMENDING CHAPTER 20.06 AND CHAPTER 20.11
OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE PERTAINING
TO TRUCKS ASSOCIATED WITH HOME OCCUPATIONS AND AUTO
REPAIRS ON RESIDENTIAL PREMISES
THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS FOLLOWS:
SECTION 1. A new section, Section 20.06.260, is hereby added to read:
Section 20.06.260 "V".
(a)
Vehicle. Any vehicle, as vehicle is defined by the California
Vehicle Code, including any automobile, camper, camptrailer,
trailer, trailer coach, motorcycle, house car, boat, or similar
conveyance.
SECTION 2.
Subsection (i) of Section 20.11.020 is hereby amended to read:
Section 20.11.020 Home Occupations.
(i)
No truck with a bed longer than eight feet, excluding the
tailgate, or with a manufacturers' capacity rating greater
than one ton and no trailer or semi-trailer used in conjunction
with the business shall be stored on the site or on the
public street.
SECTION 3.
A new section, Section 20.11.050 is hereby added to read:
Section 20.11.050 Vehicle repair on residential premises.
Except for emergency road service as offered by an automobile club, such
as the California State Automobile Association, servicing, repairing,
assembling, wrecking, modifying, restoring, or otherwise working on any
vehicle on any residential premises in any zone district shall be subject
to the following:
(a)
Work shall be limited to the minor repair and maintenance of
vehicles currently registered as specified in the California
Vehicle Code to the occupant or a member of the occupant's
immediate family, which shall be limited to parents,
grandparents, spouse, or children related by blood, marriage
or adoption. This limitation precludes auto repair on
residential premises by any commerical entity.
(b)
Minor repair and maintenance of vehicles shall be limited to
the replacement of the alternator, generator, starter, water
pump, battery or brake parts, change of oil and filter, fan
belt, hose, lamp replacement, repair of flat tires, lubrication,
engine tune up (which consists of distributor cap, rotor and
spark plug replacement) and similar routine and preventive
maintenance work.
(c) Such work shall be done only between the hours of 8:00 a.m. and
10:00 p.m.
(d) Such work shall not be done in a public right-of-way.
(e) Such work shall be conducted on no more than one vehicle at any
one time.
(f)
Storage of parts for such vehicles on the premises shall be
limited to those parts reasonably necessary for minor repair of
the vehicle. Parts which cannot be located within an accessory
building shall be screened from view.
(g) No such work which creates a nuisance as defined in
Section 8.24.030 of this code shall be permitted.
(h)
Upon completion of any work allowed by this section, the property
shall be cleaned of all debris, oil, grease, gasoline, cloths,
rags, and equipment or material used in the work, and shall be
left in such a condition that no hazard to person or property
shall remain.
SECTION 4. SEVERABILITY
In the event any section or portion of this ordinance shall be determined
invalid or unconstitutional, such section or portion shall be deemed severable
and all other sections or portions hereof shall remain in full force and effect.
SECTION 5.
PUBLICATION AND EFFECTIVE DATE
This ordinance shall be published once, with the names of those City Council
members voting for or against it, in the Enterprise-Journal, a newspaper of
general circulation in the City of South San Francisco, as required by law, and
shall become effective thirty (30) days from and after its adoption.
