AN ORDINANCE AMENDING CHAPTER 6.32 OF THE SOUTH SAN
FRANCISCO MUNICIPAL CODE PERTAINING TO BINGO GAMES
THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS FOLLOWS:
SECTION 1. Section 6.32.020 and Section 6.32.070 of the South San
Francisco Municipal Code are hereby amended to read:
Section 6.32.020 Organizations eligible for permit
Pursuant to Section 19 of Article IV of the California Constitution and
Penal Code Section 326.5, organizations which are exempted from the payment
of the bank and corporation tax by Section 23701a, 23701b, 23701d, 23701e,
13701f, 213701g and 237011 of the Revenue & Taxation Code, mobile home park
associations, and senior citizen organizations shall be eligible to apply for
a permit to conduct bingo games provided that the proceeds of such games are
used only for chari.table purposes;.and further provided, the applicant has
owned or leased or has had donated to it property within the city that has
been used by the applicant for performance of the purposes for which the
applicant is organized for at least twelve (12) consecutive months immediately
preceding the filing of such application. No other person or organization
shall be eligible to receive a bingo permit. All organizations must comply
with the requirements of this chapter.
Section 6.32.070 Location of bingo games; number of sessions
An organization authorized to conduct bingo games shall conduct a bingo game
only on property owned or leased by it, or property the use of which is donated
to the organization for an office or for performance of the purposes for which
the organization is organized. Nothing in this section shall be construed to
require that the property owned or leased by or the use of which is donated to
the organization be used or leased exclusively by or donated exclusively to the
organization. No one organization may conduct bingo games at more than two
different sessions in any given week. No more than two separate organizations
may conduct bingo games at the same location.
SECTION 2.
Severability
In the event any section or portion of this ordinance shall be determined
invalid or unconstitutional, such section or portion shall be deemed severable
and all other sections or portions hereof shall remain in full force'and effect.
SECTION 3.
Publication and Effective Date
This ordinance shall be published once, with the names of those City Council
members voting for or against it, in the Enterprise-Journal, a newspaper of
general circulation in the City of South San Francisco, as required by law, and
shall become effective thirty (30) days from and after its adoption.
