BACKGROUND/DISCUSSION The City of South San Francisco received a Minor Use Permit application by FOX Rent a Car (Applicant)in April,2023.The project site has been developed as an Automobile/Vehicle Rental business since 1978 (Building Permit No.B79-313).FOX has been operating on the site since 2020,and previously operated a rental car business at the site from 2003-2009. As part of the rental car use,a car wash and vacuum service has been operating at the site for an undocumented period of time without a required permit.The applicant requests a Minor Use Permit to permit Automobile/Vehicle Washing under SSFMC Section 20.100.002, to bring the use into compliance. Site Overview The subject site is located at 435 S.Airport Blvd.and is approximately 48,800 square feet (1.2 acres), according to Project Description Narrative (Ref.Attachment 3).An existing office building and landscaping were permitted under the 1979 Building Permit and a Use Permit (UP83-652)for an auto rental business.The office building on the site is a single-story building,approximately 3,000 square foot rental office and serves as the rental office.The existing surface parking area is located in the north and northeastern portion of the site and there would not be any change to the current parking layout.There are two one-way vehicle accesses to the project site adjacent from S. Airport Blvd., along the southwest edge of the property. The project site is surrounded by San Bruno Canal and the Bay Trail to the north,Costco Tire Center located to the northeast,and Costco Wholesale and parking lot to the east and southeast of the property.The proposed washing activity would be separated from the surrounding business parking lot by the existing screened chain- link fence, trees, and landscaping with curbs. Proposed Project The project is proposing an automobile/vehicle washing station in new ancillary structures on the site.Two carport buildings and a wastewater storage with an employee breakroom building in the southeast side of the property would be utilized for the vehicle washing purpose.One of two carport buildings would be the main carwash area (920 sf.)and the other structure would be a vacuuming area (952 sf.).There is no change proposed to the existing building, and landscape areas would remain the same. Existing and Proposed Structure Square Footage ZONING CONSISTENCY Proposed Use The project property is designated as Community Commercial (CC)Zoning District and Automobile/Vehicle Washing uses are required to obtain a Minor Use Permit in the CC zoning district,pursuant to South San Francisco Municipal Code (SSFMC)Section 20.100.002.The applicant is also requesting additional operating hours,subject to Minor Use Permit approval per SSFMC Section 20.350.010 (discussed in detail in this staff report). Development Standard Compliance Lighting and Landscaping The proposed car washing area has downward yard lighting mounted on a pole and a large roof-mounted light on the east side of the vehicle washing building.All exterior lights are operated by automated sensor.Ten interior fluorescent lights are installed and illuminating both washing and vacuum areas within the roof canopies.The existing landscaping would remain,and is consistent with the current landscape development standards. Parking The existing surface parking provides 50 parking spaces for the rental car fleet and 15 additional parking stalls for employee parking on the site.The applicant is also running a shuttle van service from the project property to the airport passenger pick-up and drop-off areas.The proposed Automobile/Vehicle Washing is ancillary to the City of South San Francisco Printed on 7/5/2023Page 2 of 3 powered by Legistar™6 File #:23-562 Agenda Date:7/20/2023 Version:1 Item #:1. the airport passenger pick-up and drop-off areas.The proposed Automobile/Vehicle Washing is ancillary to the current vehicle rental business, and the proposed use would not add more vehicle trips in the area. OPERATION PLAN The Automobile/Vehicle Washing is proposed as necessary function to the existing vehicle rental use,as the rental car company washes and cleans the cars between customers.The proposed use would be in new carport structures during business hours between 5:00 am to 12:30 am,daily.The proposed operation hours include additional hours outside of the limited hours of operation,7:00 am to 10:00 pm,seven days a week.Therefore, the applicant is also requesting a Minor Use Permit to allow the extended washing service hours. Pursuant to SSFMC Section 14.04.140,discharge of pollutants including wash or rinse water to the city sewer storm system is prohibited,and the proposed automobile/vehicle washing facilities would be connected to the sanitary sewer for a wastewater storage receptacle.The proposed vehicle washing is reusing waste and fresh water which is pumped,filtered,and stored by a recovery and recycling strategy.Furthermore,Best Management Practices (BMPs)are proposed to prevent discharges to the stormwater system and conditioned to the Minor Use Permit (Ref. Attachment 2, Water Control Condition No. 1). GENERAL PLAN CONSISTENCY The City’s General Plan designates the property as East 101 Mixed Use.Warehousing,logistics,manufacturing and other industrial land uses are providing job opportunities in the East 101 area.The Automobile/Vehicle Washing is ancillary to the existing vehicle rental business on the site and this addition would support existing use.The car washing service would not increase traffic congestion nor bring significant changes to the neighbors and surrounding businesses. ENVIRONMENTAL REVIEW The project has been determined to be categorically exempt under the provisions of CEQA,Class 3,Section 15303,New Construction or Conversion of Small Structures.The Automobile/Vehicle Washing will operate in small new structures on the existing developed property surrounded by non-residential,commercial,and industrial buildings.The project is in urbanized area and not more than four commercial buildings less than 10,000 square feet in floor area. CONCLUSION The project is consistent with the requirements of the Community Commercial land use and zoning regulations. Staff recommends that the Zoning Administrator approve the Minor Use Permit (MUP23-0003)to allow the Automobile/Vehicle Washing at 435 S.Airport Blvd.based on the attached draft Findings and draft Conditions of Approval. AIRPORT BLVD (As recommended by City Staff on July 20, 2023) As required by the Use Permit Procedures (SSFMC Chapter 20.490), the following findings are made in support of a Minor Use Permit for an Automobile/Vehicle Washing development at 435 South Airport Boulevard in the Community Commercial (CC) Zoning District, in accordance with SSFMC Chapters 20.100 and 20.350.010, based on public testimony and materials submitted to the South San Francisco Planning Division which include, but are not limited to: Application materials prepared by applicant, dated submitted April 27, 2023; project plans prepared by Knapp Consulting, dated February 22, 2023; Zoning Administrator staff report dated July 20, 2023; and Zoning Administrator meeting of July 20, 2023. REQUIRED FINDINGS A. Project structures are designed so that form and scale are harmonious and consistent with the character of the specific site, the adjacent sues are structure, and the surrounding neighborhood. The project is consistent with the landscaping requirement (min. 10 percent of the site) with a 6,270 square foot planter with 42 feet in width and 6-inch curbs along S. Airport Blvd. Two side planter areas have 15 to 20 feet in width along the side property lines. B. The site design, including the location and number of driveways, will promote safe and efficient on-site and off-site traffic circulation. Existing two one-way driveways at the site are designed to provide efficient circulation. C. Service bay openings are designed to minimize the visual intrusion on surrounding streets and properties. Pump Islands are located 45 feet from the north property line and there is no canopy or structure over pump islands. The project area is located behind the main office building which blocks the project structures from the street views. Also, existing chain-link fence with slates and landscape planters with five trees along the south property line are screening the project area. D. Lighting is installed downward to be low-profile, indirect or diffused, and avoid adverse impacts on surrounding uses. Lighting shall be directed to avoid impacts to surrounding properties. E. The washing facility will not have any adverse impact on water supply and quality. Washing facilities are 230 feet from S. Airport Blvd and there is no residential building near the project site. MINOR USE PERMIT A. The project is located within the Community Commercial (CC) Zoning District and Automobile/Vehicle Washing is an allowed use with Minor Use Permit approval; B. The proposed use is consistent with the General Plan which designates the site as East 101 Mixed Use and the project is compatible with the vision of the land use; 8 Conditions of Approval C. The project will not adversely impact to the public health, safety, or general welfare of the community, or detrimental to surrounding properties or improvements; D. The project complies with all other design or development standards applicable to the Zoning District and use; E. The design, location, size, and operating characteristics of the proposed activity would be compatible with the existing and reasonably foreseeable future land uses in the vicinity because the car washing service is necessary function to the existing car rental business; F. The site is physically suitable for the type, density, and intensity of use being proposed, including access, utilities, and the absence of physical constraints; and G. Staff has determined that the proposed project is Categorically Exempt pursuant to the provisions of California Environmental Quality Act Guidelines, Section 15303, Class 3, New Construction or Conversion of Small Structures. 9 CONDITIONS OF APPROVAL P23-0059: MUP 23-0003 435 S. Airport Blvd. (As recommended by City Planning Staff on July 20, 2023) A. Planning Division requirements shall be as follows: 1. The applicant shall comply with the City of South San Francisco, Department of Economic and Community Development – Planning Division, standard Conditions and Limitations for Commercial, Industrial and Multi-Family Residential Projects. 2. The project shall be constructed and operated substantially as indicated on the plan set prepared by Allison Knapp Wollam dated February 22, 2023, and approved by the Zoning Administrator in association with MUP 23-0003 as amended by the Conditions of Approval. The final plans shall be subject to the review and approval of the Chief Planner. 3. Applicant shall submit a checklist showing compliance with Conditions of Approval when applying building permit and business license applications. 4. The applicant shall maintain the landscape proposed for the site and all landscaped area shall be permanently maintained in compliance with Chapter 20.300.008 of the Zoning Ordinance. 5. New structure exterior shall match the existing rental office building colors (blue and white). Any modification to the approved plans shall be subject to SSFMC Section 20.450.012 (Modification), whereby the Chief Planner may approve minor changes. All exterior design modifications, including any and all utilities, shall be presented to the Chief Planner for a determination. 6. All equipment (either roof, building, or ground-mounted) shall be screened from view through the use of integral architectural elements, such as enclosures or roof screens, and landscape screening or shall be incorporated inside the exterior building wall. Equipment enclosures and/or roof screens shall be painted to match the building. Prior to issuance of a building permit the applicant shall submit plans showing utility locations, stand-pipes, equipment enclosures, landscape screens, and/or roof screens for review and approval by the Chief Planner. 7. The hours of operation shall be within the 5:00 a.m. to 12:30 a.m. time period, up to seven days a week. 8. The business shall be operate substantially as outlined in the Project Description Narrative submitted by Knapp Consulting dated April 24, 2023 (Ref. Attachment 3). 10 9. All parking areas shall be maintained clear of litter and storage at all the time. No outdoor storage of materials is allowed, and no work shall be conducted outside of a building. 10. All exterior light sources, including canopy, perimeter, and flood, shall be energy-efficient, stationary, and shielded or recessed within the roof canopy to ensure that all light is directed away from adjacent properties and public rights-of-way. Lighting shall not be of a high intensity so as to cause a traffic hazard, be used as an advertising element, or adversely affect adjacent properties. 11. Applicant shall comply with all permitting requirements of Building Division related to the project and provide proof of permits and/or approval prior to building permit issuance for these project elements. 12. Demolition of any existing structures on site will require demolition permits. 13. The permit shall be subject to revocation if the project is not operated in compliance with the conditions of approval. APPROVED WITH CONDITIONS - the following items must be included in the plans or are requirements of the Water Quality Control Stormwater and/or Pretreatment Programs and must be completed prior to the issuance of a building permit: a. Upon Use Permit approval, Building Plans shall be submitted connecting the car wash area to an oil/water separator and the sanitary sewer (as noted in the Applicant’s narrative). Application Checklist Item 3 Project Description Overview The project site is developed with a permitted airport-related rental car business that was established in 1979. Various service providers have occupied the site over the years (see Research on Site History and Permitting, below). FOX rent a car is the current user. At an undocumented time, a car wash and vacuum service (‘car washing activities’) was added in absence of a minor conditional use permit (‘use permit’) and building permit. FOX is responding to an enforcement action (Case # CE20-0614, Officer Edgar Aries, Code Enforcement, Administrative Citation, 4/22/2023, 2/4/2021, 7/16, 2020, in Exhibit A.1 Officer Aries Citation)i with respect the car washing activities. This application intends to correct the zoning violation and legalize the car washing activities on the site. See Exhibit B Site Plans and Photographs, and specifically p 2, 3, 9,10 and 11. Car washing and drying activities are done manually, by hand. Currently car washing activities employ a recovery and recycling strategy that pumps, filters, stores and reuses waste and fresh water for car washing. Sludge from these activities is stored in a drum and off hauled by a licensed service provider. FOX understands this method has difficulties (notably a breach in the pump on March 2023 that was corrected, see Exhibit A.2 Natasha Gutierrez, Environmental Compliance Coordinator Citation and plans to connect wastewater disposal to the City’s sanitary sewer, after securing a use permit. To that end, FOX has located the sanitary-sewer as-builts and is currently drafting plans for a building permit application. FOX understands a building permit may NOT be issued in absence of obtaining an approved use permit and not prior to the termination of the 10-day appeal period. FOX’s goal is to have the building permit approved and ready to issue the day after the appeal period. FOX was made aware that environmental documents must be prepared and complied with for both the car rental operations, that includes fueling of vehicles, and car washing activities that disposes of wastewater. To that end CSS Engineering prepared the following documents: • Hazardous Materials Business Plan (HBMP, 2023); and • Spill Prevention, Control and Countermeasures Plan (SPCC, 2023). Apollonia Helm San Mateo County Department of Environmental Health, Hazardous Materials Specialist, REHS) was and is the contact for review of the plans. Both plans were approved, and the HBMP is uploaded 13 435 South Airport Boulevard Conditional Use Permit Application April 12, 2023 Page 2 of 9 to the California Environmental Reporting System (CERS Website (CERS) CERS ID: 10881433) and are attached as part of this application (Exhibits A.3 HMBP and A.4 SPCC). We had assumed that a Stormwater Pollution Prevention Plan (SWPPP) would be required for the site. Through review of the Industrial Guidelines Permits, subsection 8 Transportation Facilities, NPDES General Permit for Stormwater Discharge Associated with Industrial Activities (April 1, 2014) we found a SWPPP is not required. Additionally, the City does not require a SWPPP. Andrew Wemmer, South San Francisco Supervisor of Environmental Compliance noted the following in an email responding to our query. “From a Water Quality Control perspective, our only requirements are as follows: 1.) No wash or rinse water discharges to the storm drain system at any time, and effective Best Management Practices (BMPs) must be installed and in place/maintained that prevent discharges to the stormwater system (ex. Curbs, berms, etc.). 2.) Wash and rinse waters must drain to the sanitary sewer system.” (email Allison Knapp, Andrew Wemmer, Environmental Compliance Coordinator, March 21, 2023) Research on Site History and Permitting There is very little documentation in City files on building and/or use permits for the project site. We share what we found in the following and offer our thought process when filling in some gaps. Site Uses/Occupancies: The applicant indicates that FOX began operating on the site in 2003 and terminated in 2009 when they moved to the airport. See Exhibit A.5, FOX Business License dated 11/26/2002. A company named Airport Van Rental picked up the site and operated from 2009 through 2012. Subsequently Sixt took over the site and operations. According to Joe Knight, (VP Airport Concessions and Properties Europcar Mobility Group Fox Rent a Car) FOX returned to the site in 2020, July 25, 2022) (see Exhibit A.6 Business Operator History). Building Permit History: Our research of City building files indicates the car rental portion was constructed with a building permit issued in 1979 (Building Permit 79-420) and final sign off was on 1-11-80 (see SSF Building files). The construction associated with the permit includes a one-story framed structure for an auto rental office, and employee support uses (breakroom, restrooms). A 480 sq ft entry canopy and a 570 sq ft island car return appears to be included in the permit that was approved, as well as some of the site lighting (see below). Sign Permits/Lighting History: Our research of the building files found an undated application for sign permits for Sixt Rent A Car (SignJose) (see Exhibit A.7, Sixt Rent A Car, SignJose Sign Drawings). The drawings show cabinet and monument signs that are constructed on the site (See Exhibit B p 4-11). The requested signage comports to Sixt operating at the property, at some point in time. The current signs with the copy changed to FOX appear to be in the location shown on the SignJose drawings, with two smaller directional signs on the property close to the sidewalk. The two directional signs are small and seemingly promote safety on the site indicating the entrance and exit for vehicles. The roof mounted lighting is shown in the SignJose drawings and appears to be in the same location and type as the current site lighting. The pole mounted yard light also appears on the SignJose drawings. The specifications for the lighting are also shown (See Exhibit B Site Plans and Photographs p 9, 10, 11). The SignJose sign application shows the canopies on the rental office. More discussion on lighting is found under Application Checklist Item 6, below. General Plan and Zoning History: The rental car business was established in 1979 when the car rental use was considered a permitted use. The City’s 2000 general plan update and subsequent zoning ordinance amendment (2010) the Freeway Commercial did not permit the use, and as such the rental use was classified 14 435 South Airport Boulevard Conditional Use Permit Application April 12, 2023 Page 3 of 9 as legal non-conforming. The 2022 general plan and zoning update redesignated the site as Community Commercial (CC) where car rental and washing activities are typically permitted through the minor use permit process. Given the permitting history, by right in 1979 to conditionally permitted in 2022, the planning department opined a minor use permit adequate to address the addition of the car washing activities (Exhibit A.8 email Allison Knapp and Billy Gross, Principal Planner November 2, 2022). Direction to use 20.350.010 Automobile and Washing Stations SSFMC as guidance for the car washing activities was also given. Table 1, Use and Square Footage following summarizes the square footage of uses. Exhibit B Site Plans and Photographs, (CSS Engineering, 2022 and Knapp Consulting, 2023) illustrate these uses and structures. The plans and photographs in Exhibit B Site Plans and Photographs identify structures with letters while the numbers refer to the location where the photographs were taken. Reviewing the 1979 building permit it appears that setbacks were measured from the building and not the canopy. We measured the car return canopy attached to the rental office. The east side setback is 15 ft. from post to fence. The 1979 setbacks noted in the permit file are: 70 ft front 31 ft right side (south) 54 ft left (north) 245 ft rear The 2023 measured setbacks are: 5.6”-6’6” ft right side (south) 88’ ft rear The north side setback, with the unpermitted canopies, is less than what was permitted in 1979 so that setback was not measured. SSFMC 20.350.010 E notes permitted hours of operation for a car wash are limited to 7:00 am to 10:00 pm seven days a week. The site is active from 5:00 am to 12:30 AM daily. Therefore, we are requesting a minor use permit for extended hours of operations. Lighting does not appear to spill off site and will be considered through use permit review. Rational for Use Permit The project operates a shuttle van service from the site to 780 N McDonnel Road where airport passengers are picked up/dropped off. The project transports passengers to the site where they rent a car. The project operates two shifts a day, and five vans constitute their fleet of service. Three to four van trips/per shift operate daily. The use reduces vehicle trips in the area and is a Transportation Demand Management mitigation measure. The car washing activities are a necessary function of car rental and to have this activity on the same site also reduces vehicle miles traveled. The surrounding land uses include the Costco Installation Service (east, to the rear) and Costco Wholesale and parking lot to the south of the site. San Bruno Canal, including green space landscaping, and Bay Trail (‘Canal and Bay Trail’) is to the north. South Airport Boulevard fronts the site to the west. More industrial uses are north and west of the site including a stone warehouse across South Airport Boulevard and a food wholesaler east of Canal and Bay Trail. Hotels appear 400 to 500 ft from the project site. The car washing activities are sensitive in their placement to surrounding land uses and provide a buffer to those uses. The carwash activities face the blank concrete wall of Costco Installation Service, do not decrease the setback from Canal and Bay Trail, and are adjacent to the Costco Wholesale parking lot, to the south. Car parking is located along the northern elevation adjacent to Canal and Bay Trail property line which serves the car rental portion of the business. The public realm of the business is separated from the car wash activities and is described in detail in Item 9 Landscaping, below. Lighting appears to comport with the drawings submitted by SignJose sign company. Lighting viewable from the public right-of -way, South Airport Boulevard is task oriented. The pole mounted yard light, located in the central area of the site, is downcast and illuminates the fueling area that is 45 ft from the closest property line coincident with Canal and Bay Trail. The lighting is important for safety and is not obtrusive. The Floor Area Calculations are shown in Table 1 Use and Square Footage, above. Following are a couple items we believe further explanation would be beneficial. Lighting (see Exhibit B Site Plans and Photographs p 4, 5, 6,9, 10, 11): The rental building lighting on the site appears to have been constructed prior to and/or along with the signs by SignJose. The lighting includes: Office Rental Building: Eight (8) larger roof-mounted downcast lights for circulation and safety around the perimeter of the building and six (6) smaller directional task lights for signage and walking areas. Eight-watt energy star larger sign lighting and directional LED spotlights are shown on the plans. These lights are operated by an automatic sensor (Pinky Andrada, FOX site manager, text, April 4, 2023). One pole mounted downcast yard light, mentioned above, (see Exhibit B Site Plans and Photographs p 11) is located near gasoline pump and is shown on the SignJose drawings. This light is operated by an automated sensor. The following describes the lighting associated with the canopies and car wash activities. • Exterior: Car Wash/Vacuum: One large roof-mounted light on the east side of the canopy (facing the blank wall of the Costco Installation Shop) and is not visible from South Airport Boulevard. The exterior light is on an automatic sensor. • Interior: A total of 10 interior canopy fluorescent lights illuminate the work areas in both canopies (Pinky Andrada, FOX site manager, text, April 4, 2023) (see Exhibit B p 11). Parking, Bicycles and ADA Path: A total of 50 parking spaces for the rental car fleet and 15 additional 15 for employees are located on the site. Total vehicular parking is 75 spaces. The parking is striped and numbered. The ADA parking and path is located adjacent to the office rental building. No bicycle parking is included although a bicycle was noted alongside the vacuum area during one site visit. Parking is shown on Exhibit B Site Plans and Photographs p 2-6 and 9, 11. Application Checklist Item 7 and 8 Item 7. Exhibit B Site Plans and Photographs p 1-11 is the reference point illustrate the following. 7.A & F. Trims and Finishes and Color Elevations: The unpermitted canopies are crème with white trim and are shown on Exbibit B p 4-6, 9, 10. The crème color approximates that of the blank wall of the Costco Installation Shop constructed at the rear property line. The white matches that of the rental office constructed with permits in 1979. The rental office is blue and white. 7.B, C, D, E. F, G & H. The rental office roof is flat. Along the eve line are placed downcast lighting, some of which are shown in the SignJose sign permit drawings. The unpermitted canopies possess a minimal pitch and one façade mounted light. Lighting is shown in Exhibit B p 9, 10, 11. There are no retaining walls on the site. Chain link fencing is along both side property lines and shown in Exhibit B p 4, 5, 6, 7. Signs are shown on Exhibit B p 4, 8, 9. 17 435 South Airport Boulevard Conditional Use Permit Application April 12, 2023 Page 6 of 9 Daylight planes and shadow studies do not seem applicable, and shadow studies are exempt by the three-story criterion. 8.A-D. The existing and proposed site plans and floor areas are as permitted in 1979 for the rental office building and as proposed to be legalized with this application for a use permit. Please note, the wastewater recycling and holding tanks would be removed from the site upon approval of a building permit to connect car washing activities to the sanitary sewer. The existing and proposed gross floor area by use is shown in Table 1. There is no garage on the property. Please see the photographs and site plans in Exhibit B for details. 9. Application Checklist Item 9 Landscape Plan The site is organized in two realms, public and private. The public realm includes the rental office, canopies sheltering arrival and departure, visitor parking and ADA parking, restrooms, landscaping, and the emergency /gathering area, (see Exhibit B Site Plans and Photographs p 2, 3-6, 11). The public realm measures approximately 160 ft by 110 ft for a total of 12,540 sq ft. The site driveways (one in and one out) define the shape of this area creating a ‘U’ form. The first 55 ft of the public realm is landscaped in the main or ‘central’ landscape area, that also serves as an emergency gathering area, and two side planting areas (see Exhibit B Site Plans and Photographs p 2, 4-8). Customers are not permitted on the remainder of the site where the majority of the cars are parked, and fueling and car washing activities are performed. During our site visits, two announced and three unannounced, we noted office staff greeting users of the site and directing them to the office. The landscape plan is ‘as-planted’ and likely planted with the original building permit. The central planting area is approximately 42 ft in width and the two side areas are approximately 15 to 20 ft in width. The depth of the planting areas is mimicked in the Costco Warehouse landscape to the south and Canal and Bay Trail to the north. This landscape pattern, a band, continues south to Belle Air Road. Irrigation is drip on the side areas and spray in the middle. Various required utilities are interspersed in the planting areas (eg, blackflow preventer typically required by the fire department and/or water district). Landscaping is predominately ceanothus, flax, Dietes, a Fortnite lilly, Rosmarinus, Carex, and Pennisetum. These plants are drought tolerant (Exhibit B Site Plans and Photographs p 7). Additionally, there are five trees along the northern and southern property lines: one Monterey pine, three eucalyptus and one acacia. Landscaping consists of 12.85% of the site area (see Table 1). FINDINGS FOR USE PERMIT APPROVAL We believe the findings for use permit approval may be made in the affirmative. Findings for Use Permit Approval SSFMC 20.350.010(F) 1. The project is harmonious and consistent with the surrounding area. The car wash activities are not visible from South Airport Boulevard. The car rental office screens the view. The car wash is also setback from South Airport Boulevard 225 ft plus. A slatted chain link fence, and tree planting on the Canal and Bay Trail property, north side property line, provides screening. On the south side property line, a slatted chain link fence with Costco Warehouse parking and tree planting provides screening. The Costco Installation Service building rear wall, with no penetrations, runs the entire width of the rear property line. The public realm of site activities with landscaping and commerce is separated from the car wash activities. Furthermore, the immediate uses in the area are a mix of big box retail, recreation, heavy commercial and service stations. The car washing activities fits in with these uses. 18 435 South Airport Boulevard Conditional Use Permit Application April 12, 2023 Page 7 of 9 2. The site design is safe, including the location and number of driveways promotes safe and efficient on and off-site circulation. Site design provides a public area of approximately 12,450 sq ft, that is lighted, landscaped and includes ADA and visitor parking, the rental office, restroom and beverage machines. The car washing activities are separate from the public realm and staff is diligent in monitoring and enforcing the separation. 3. The project is not a service station and does not include service bay areas. The project is a car rental with a fueling station. The fueling station is in the central portion of the site. The carwash facilities are in the mid to rear portion of the site and screened from public view. 4. Lighting is designed to be low-profile, indirect or diffused, and avoid adverse impacts on surrounding uses. Lighting is task oriented and downcast. The one larger yard light in in the mid portion of the site and illuminates the fueling area. 5. The washing facility will not have an adverse impact on water supply or water quality. The washing facility will and shall connect to the sanitary sewer upon use permit approval. The project requires use permit approval to operate from 5:00 AM to 12:30 AM daily. The car wash activities have been in operation for an extended period of time. We have addressed site design and lighting above. We offer the following noise discussion. The following information is sourced from Environmental Impact Report for the South San Francisco General Plan Update, Zoning Code Amendments, and Climate Action Plan, Raimi + Associates, First Carbon Solutions July 2019. State Clearinghouse 2021020064 (GP2040 EIR). See Exhibit 3.11-1 Roadway and Railroad Noise Exposure Map, South San Francisco General Plan (p 3.11-39) and Exhibit 3.11-2, San Francisco International Airport Noise Contours (3.11-41). The project is not impacting the more sensitive land us, that being the open space and recreation use of Canal and Bay Trail. The project area is not identified as noise impacted. The airport noise contour map identifies the project area below the 65 dBA, CNEL noise exposure. The roadway and railroad noise exposure map identifies South Airport Boulevard as not being a road segment impacted by roadway noise. Higher noise levels from travel patterns include South Linden Avenue and Highway 101 (Roadway and Railroad Segments with Noise Levels above 65 dBA CNEL). Highway 101 is impacted by roadway noise and South Linden Avenue by railroad noise; South Airport Boulevard in the project location is not. Although the land uses in the area exist, we use Table 3.11-7: Land Use/Noise Compatibility Matrix to Guide New Development (GP 2040 EIR) for a more conservative discussion. Page 365, (GP EIR) identifies parks, neighborhood parks, playground development to be acceptable in an exterior environment up to 65 dBA CNEL. The location of Canal and Bay Trail are within and compatible with this criterion. For the project, we use the manufacturing, warehousing, wholesale, and utilities category for noise compatibility. For this type of land use the compatibility matrix switches to interior ambient noise and identifies 65 dBA CNEL as the threshold. The location of the project comports to this criterion, The project is not impacting the more sensitive land use, that being the open space and recreation use of Canal and Bay Trail and the noise environment is not impacting the office or car washing activities of the project. In summary, the site and project area are under the exterior ambient noise level of 65 dBA, CNEL. Moreover, hotel construction is required by law to comply with Title 23, Section 1206 noise regulations. Insulation assembly shall be designed to reduce ambient noise levels in any sleeping room to 45 dBA or less. Ergo the hotels in the project area are not impacted by the ambient noise environment. MISCELLANEOUS California Environmental Quality Act (CEQA) Determination The project (‘Project’) proposes to connect car washing activities to the sanitary sewer and legalize the use of two canopy structures, consisting of 1,870 sq ft for car washing and vacuuming activities. The City of South 19 435 South Airport Boulevard Conditional Use Permit Application April 12, 2023 Page 8 of 9 San Francisco requires car washing activities to be connected to the sanitary sewer. The 144 sq ft wastewater storage receptacle would also be removed from the site. The Project includes a Hazardous Materials Business Plan (HBMP, 2023); and Spill Prevention, Control and Countermeasures Plan (SPCC, 2023). Both plans were approved by San Mateo County Department of Environmental Health, uploaded to the California Environmental Reporting System (CERS Website (CERS) CERS ID: 10881433) and are attached as part of this application. Moreover, from a Water Quality Control perspective, no wash or rinse water discharges are permitted to enter the storm drain system at any time, and effective Best Management Practices (BMPs) shall be installed and in place/maintained that prevent discharges to the stormwater system (ex. Curbs, berms, etc.) as a condition of Project approval. Wash and rinse waters shall drain to the sanitary sewer system. The Project is categorically exempt from CEQA pursuant to CEQA Guidelines Section 15303 New Construction or Conversion of Small Structures, Class 3 (c) and (d) wherein: Class 3 consists of construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures; and the conversion of existing small structures from one use to another where only minor modifications are made in the exterior of the structure. The numbers of structures described in this section are the maximum allowable on any legal parcel. Examples of this exemption include but are not limited to: (c) A store, motel, office, restaurant or similar structure not involving the use of significant amounts of hazardous substances, and not exceeding 2500 square feet in floor area. In urbanized areas, the exemption also applies to up to four such commercial buildings not exceeding 10,000 square feet in floor area on sites zoned for such use if not involving the use of significant amounts of hazardous substances where all necessary public services and facilities are available[,] and the surrounding area is not environmentally sensitive. (d) Water main, sewage, electrical, gas, and other utility extensions, including street improvements, of reasonable length to serve such construction. (e) Accessory (appurtenant) structures including garages, carports, patios, swimming pools, and fences. The Project would legalize 1,872 q ft of car washing activities and remove a 144 sq ft wastewater storage receptacle for a net legalization of 1,728 sq ft well under both the 2,500 and 10,000 sq ft exemption. The Project would connect car washing wastewater to the sanitary sewer as required by the City. The Project is compliant with hazardous materials usage, storage and disposal (HMBP, 2023) and spill prevention and cleanup (SPCC Plan, 2023). The site is flanked by heavy commercial to the east, Costco Installation; South Airport Boulevard, a busy transportation corridor to the west; and Costco Wholesale and associated parking to the south; none of which are environmentally sensitive. More sensitive land uses are to the north, Canal and Bay Trail. The canal is on average 50 feet from the northern property line. There exists a one (1) foot gradient on the site from the north property line at 14 ft elevation above mean sea level (msl) to the south at 13 ft above msl. Carwash activities are along the southern property line. The location of the carwash activities; the presence of a total of six drainage inlets (DIs) and curbs along the north and south property lines; distance between the northern property line and the carwash (93 ft); and the site gradient- 20 435 South Airport Boulevard Conditional Use Permit Application April 12, 2023 Page 9 of 9 to the south protects Canal and Bay Trail to the north. Water on the site is collected by the DIs and curbs. Additional BMPs will be required through use permit approval. Fox Rent A Car Spill Prevention, Control, Countermeasures (SPCC) South San Francisco Job 7106 - SPCC - Fox Rent A Car Page 1 1.0 INTRODUCTION 1.1 Purpose The purpose of this Spill Prevention, Control, and Countermeasure (SPCC) Plan is to describe measures implemented by Fox Rent A Car (Fox) to prevent discharges from occurring, and to prepare Fox to respond in a safe, effective, and timely manner to mitigate the impacts of a discharge. This plan is specific to the Fox Rent A Car lot located at 435 S. Airport Boulevard, South San Francisco, California. This Plan has been prepared to meet the requirements of Title 40, Code of Federal Regulations, Part 112 (40 CFR part 112), and supersedes the earlier Plan developed to meet provisions in effect since 1974. In addition to fulfilling requirements of 40 CFR part 112, this SPCC Plan is used as a tool to communicate practices on preventing and responding to discharges with employees, as a guide to facility inspections, and as a resource during emergency response. This Plan provides guidance on key actions that Fox must perform to comply with the SPCC rule: Review the SPCC Plan at least once every five (5) years and amend it to include more effective prevention and control technology if such technology will significantly reduce the likelihood of a spill event and has been proven effective in the field at the time of the review. Plan amendments, other than administrative, must be recertified by a Professional Engineer (PE) on the certification page in Section 2.2 of this Plan. Amend the SPCC Plan within six (6) months whenever there is a change in facility design, construction, operation, or maintenance that materially affects the facility’s spill potential. The revised Plan must be recertified by a PE. Review the Plan on an annual basis. Update the Plan to reflect any “administrative changes” that are applicable, such as personnel changes or revisions to contact information, such as phone numbers. Administrative changes must be documented, but do not have to be certified by a PE. 51 52 CSS Environmental Services, Inc. [40 CFR 112.3(d)] This certification in no way relieves the owner or operator of the facility of his/her duty to prepare and fully implement this SPCC Plan in accordance with the requirements of 40 CFR part 112. This Plan is valid only to the extent that the facility owner or operator maintains, tests, and inspects equipment, containment, and other devices as prescribed in this Plan. Fox Rent A Car Spill Prevention, Control, Countermeasures (SPCC) South San Francisco Job 7106 - SPCC - Fox Rent A Car Page 4 3.0 GENERAL INFORMATION This SPCC Plan has been designed to outline proper response to and minimize the effects of hazardous materials from accidental spills or releases that may adversely affect human health and the environment. This SPCC Plan provides the information for spill prevention control and countermeasures to Fox Rent A car for their lot located at 435 S. Airport Boulevard in South San Francisco, California. The Regional location of the project is shown on Figure 1; Figure 2 shows the location of the Above Ground Storage Tank (AST) areas and site features; Figure 3 details the Spill Release Notification Procedure; and Figure 4 details the Spill Response Flow Chart. The purpose of the SPCC Plan is to provide proper emergency response in the event of an accidental release, and to prevent discharges of substances from reaching waterways or sensitive resources. Spill and leak preventative measures, and the training of employees, are the primary methods used to minimize the chances of an accidental discharge. The Fox lot is not classified as a Substantial Harm Facility as defined in the Oil Pollution Act of 1990; therefore, a Facility Response Plan as outlined in Section 40CFR §112.20 is not required for this site. 54 CSS Environmental Services, Inc. Fox Rent A Car Spill Prevention, Control, Countermeasures (SPCC) South San Francisco Job 7106 - SPCC - Fox Rent A Car Page 5 3.2 Revisions, Amendments, and Documentation (40 CFR 112.5(b)) In accordance with 40 CFR 112.5(b), Unified Oil reviews this SPCC Plan at least once every five years (in the past, such reviews were required every three years). Revisions to the Plan, if needed, are made within six months of the five-year review. A registered PE certifies any technical amendment to the Plan, as described above, in accordance with 40 CFR 112.3(d). This Plan is dated November 18, 2022. The next plan review is therefore scheduled to take place on or prior to November 18, 2026. The Spill Plan may be amended at any time should one of the following occur: There is a change in facility design, construction, operation or maintenance that materially affects the facility's potential for a release into or upon waterways or a sensitive resource. A more effective control or prevention technology is made available which will significantly reduce the chances of a spill event; or As required by the EPA, State, or local regulatory agency after review of the Spill Plan or regulatory updates. All Spill Plan amendments must be certified by a registered PE and implemented as soon as possible, but no later than six months after a facility change or the Spill Plan review. In addition to review and certification, a record of the following activities must be maintained: Secondary containment inspections and corrective actions. All spill and release events. Spill Plan training records. Changes in physical plant conditions that may be inconsistent with the current Spill Plan; and, Changes in maximum storage inventory or other physical plant changes. 55 CSS Environmental Services, Inc. Fox Rent A Car Spill Prevention, Control, Countermeasures (SPCC) South San Francisco Job 7106 - SPCC - Fox Rent A Car Page 6 4.0 SPILL PREVENTION PROCEDURES 4.1 General Conditions (40 CFR 112.7(a) (3)) The Fox lot serves as a temporary storage and staging facility for rental cars gasoline fueling. The following SPCC Plan general conditions apply to the Fox Rent A Car facility. The following provides maximum quantities of materials stored at the facility: 1. Gasoline fuel storage does not exceed 1,773 gallons dispensed from (2) two above ground gasoline storage tanks; one tank is 793 gallons and the other tank is 980 gallons. Refer to Figure 2 for locations at grids D - 2.5. The following procedures and practices will apply to the bulk storage area: 1. Fueling will not occur outside of the designated area, near the ASTs. 2. No ancillary construction equipment (pumps or generators, etc.) will be located within 100 feet of waterways or sensitive resource. 3. As applicable, provide double containment for equipment containing fuel, lubricants, and oils or other potential contaminants. Used oil filters will be stored under covered areas. 4. Waste manifests and inspection logs will be kept on site. 4.2 Spill Containment Equipment (40CFR 112.7(c)) Maintaining an adequate supply of spill containment equipment is of primary importance to spill containment measures. Fox maintains spill kits for accidental occurrences. The following equipment will be on-site in the event that prevention techniques are not adequate, and a spill does occur: 1. Absorbent materials such as diatomaceous earth or sawdust for the direct absorption of spilled liquids, 2. Absorbent pads for the direct absorption of spilled liquids, 56 CSS Environmental Services, Inc. Sandbags for constructing dams, dikes, diversions, sediment barriers or containment areas, 4. Shovels for filling sandbags, and 5. Plastic sheeting for forming barriers. 4.3 Storage Tanks and Piping (40 CFR 112.7(e)) Onsite fuel storage occurs at the Fox lot. The following spill prevention measures will be in place in order to prevent failure of the ASTs and piping: 1. Each fuel AST is painted to prevent corrosion. 2. Each fuel AST meets U.L. 142 construction standards. 3. Each fuel AST is equipped with a float gauge. 4. Each fuel AST is observed as addressed in Section 3.5, Inspections and Records 4.4 Tank Truck or Refueller Truck Loading/Unloading (40 CFR 112.7(h)) Tank truck or refueller truck loading/unloading procedures meet the minimum requirements and regulations established by the Department of Transportation. Drivers have been trained to handle spills by reporting them to management. Management will direct spill reporting and response as discussed in Section 4.0. The following procedures will be adhered to during loading/unloading to prevent vehicular departure before completing disconnect of flexible or fixed transfer lines: 1. Prior to filling, protect direct conveyances to drainage ways by placing appropriate absorbent materials as appropriate. 2. Prior to filling, operators must ensure that the volume available in the receiving tank is greater than the volume of product to be transferred into the tank. 3. Bonding and grounding wires must be properly attached to the truck before product transfers. 57 CSS Environmental Services, Inc. Connect receiving hose and check all valves to ensure delivery of product to the proper tank. Operators will not rely on settings of previous fuel deliveries. Operators will check the relief vent on the receiving tank to ensure proper operation. 5. The transport driver will remain on hand until delivery has been completed. 6. The transfer will be constantly monitored to prevent overfilling and spilling. Even if the receiving tank has a built-in overfill protection system to safeguard against overfilling the tank and causing a spill, the operators will check the receiving tank by means of the inventory control computer and/or site gauge and will not solely rely on a paper inventory. 7. The delivery hose and lines will be checked for leaks. 8. The shut-off valve on the fuel truck hose will be closed before disconnecting the hose from the tank. 9. When unloading is complete, all appropriate valves will be shut off, hoses will be disconnected, and the operator will check for leaks. 10. Remove the absorbent sock or sealant pad from any storm drain, if applicable, and return it to the spill response kit. 4.5 Inspections and Records (40 CFR 112.7(e)) An employee of Fox will make informal inspection of the ASTs, valves and piping during all routine visits. Records do not need to be made of such informal observations. However, employees must report evidence of spills or damaged facilities and equipment. All visible oil leaks from seams, gaskets, rivets and bolts, that are large enough to cause accumulation of product in the bulk storage area within the secondary containment or ground near the pump dispensing area, are also to be reported to management and repaired immediately. Formal inspections of the ASTs exterior, secondary containment facility, valves and piping will be conducted monthly by operating personnel to detect potential leakage from pipe seams, connections and fittings (Attachment A). In addition, the general condition of items, such as flange joints, expansion joints, pipeline supports, locking valves, and metal surfaces will be 58 CSS Environmental Services, Inc. Deficiencies noted during informal or formal inspections will be acted upon in a manner consistent with environmental safety and good management practices. A record of the formal monthly inspections, signed by Fox, will be made part of the SPCC Plan and maintained for a period of three (3) years (Attachment A). The following records will also be kept: 1. Spill history log (Attachment B); and 2. Plan review records. 4.6 Security (40CFR112.7 (g)) The following security measures are in place at Fox to prevent tampering or accidents: 1. The Fox lot is in an area that has access through a controlled gate at the entrance of the facility. 2. The AST tank fill ports are locked. 3. The Fox General Manager is available 24-hours. 4.7 Employee Training (40CFR 112.7(f)) Fox employees and any subcontractors engaged in the handling of fuel will be: 1. Trained in the safe handling of these materials and trained in the operation of equipment, and 2. Made aware of the requirements and purpose of this SPCC Plan. The Fox General Manager is responsible for properly instructing personnel in the operation and maintenance of equipment to prevent the discharge of fuel and applicable pollution control laws, rules and regulations. All personnel and contractors who are required to receive this training must signoff on the training log sheet at the training session. 59 CSS Environmental Services, Inc. Fox Rent A Car Spill Prevention, Control, Countermeasures (SPCC) South San Francisco Job 7106 - SPCC - Fox Rent A Car Page 10 The employee or subcontractor must demonstrate the following: 1. Understanding of the operating procedures and the ability to apply them. 2. Ability to identify petroleum product by color; know the storage capacity of each tank and refueller truck compartment. 3. Ability to gauge tanks and convert inches of product to gallons. 4. Know the location and purpose of all valves and disconnect switches. 5. Know how to operate safety equipment located at the tank area; and 6. Know where spill response materials are stored and their proper application. 4.8 Spill Response Training (40CFR 112.7(f)) The California Occupational Health and Safety Administration’s (Cal-OSHA’s) Hazardous Waste Operations and Emergency Response (Hazwoper) regulations apply to “emergency response operations for releases of, or substantial threats of releases of, hazardous substances without regard to the location of the hazard,” unless the employer can demonstrate that the operation does not involve employee exposure or the reasonable possibility for employee exposure to safety or health hazards. Fox site personnel directly engaged with removal of contaminated material will have a minimum of 24-hours of Hazwoper instruction. On an “as- needed basis,” Fox intends to utilize the following subcontractor personnel that have the specified level of Hazwoper training: CSS Environmental Services, Inc. Personnel 1. Fox Rent A Car Spill Prevention, Control, Countermeasures (SPCC) South San Francisco Job 7106 - SPCC - Fox Rent A Car Page 11 5.0 SPILL REPSONSE PROCEDURES 5.1 Accidental Spill Procedures When an accidental spill occurs, action must be taken to stop the spill and reduce its effects. This section addresses those actions to be taken. The response needed will be dictated by the spill. Minor Spills. Minor spills are those that have the least probability of environmental damage, not necessarily the smallest volume, although volume is a definite consideration. Minor spills are those that can be contained and quickly cleaned up and do not result in damage to the environment or human health. Minor accidental spills will require clean up. Major Spills. Major spills are those that have the potential to adversely affect the environment or human health. Like minor spills, volume is not the only variable in determining the severity of the spill. Examples of major spills are spills resulting from a tank valve or product dispensing pipe seal break, or any other uncontrolled accidental releases of a significant quantity. Initial Notification and Activation. A formal notification process will be initiated when a spill or potential spill is first observed that has the potential to adversely affect the environment or human health. Follow the “Spill Release Notification Procedure” shown in Figure 3. The first individual who discovers a spill (spill observer) will be responsible for initiating notification to the Fox General Manager. The Fox General Manager will direct response procedures. The project personnel who must be notified will depend on the size and type of the spill. For major spills these include, but are not limited to: 1. Spill Observer 2. Spill Response Contractor – CSS Environmental Services, Inc. – (415) 948-4514 General responsibilities of the designated personnel are outlined as follows: Spill Observer is the first person to witness a spill. They must immediately: 1. Assess the incident as observed. 2. Notify the Fox General Manager (Pinky Andrada) 3. If the incident can be safely controlled, take steps to do so. Fox General Manager is designated to fulfill the following responsibilities. 1. Determine if the spill response contractor is needed to accomplish cleanup. 2. Determine if additional spill response support is necessary. 3. Complete containment and cleanup of accidental spill. 4. Complete Spill Release Notification Procedure (Figure 3); and 5. Complete all reporting to SMESHMP and SFRWQCB. San Mateo County Environmental Services HazMat Programs (SMESHMP) must be notified immediately in the event of any accidental spill that has the potential to adversely affect the environment or human health. 1. The Fox General Manager will document time, date, person contacted and disseminate any directives from the SMESHMP and SFRWQCB regarding the incident. 2. Telephone notifications to the SMESHMP and SFRWQCB will be confirmed in writing within two weeks. Written notifications will include: a) Reasons for the discharge, b) Duration and volume of the discharge, c) Steps taken to correct the problem, and d) Steps taken to prevent the problem from recurring. Spill Response Contractor is the outside company hired by Fox who is designated to respond to spills. The Spill Response Contractor will: 62 CSS Environmental Services, Inc. Fox Rent A Car Spill Prevention, Control, Countermeasures (SPCC) South San Francisco Job 7106 - SPCC - Fox Rent A Car Page 13 1. Follow the Spill Response Flow Chart 2. Collect appropriate samples for laboratory analysis, as needed and transmit the results to Fox within 48 hours of laboratory issuance. 3. Follow the specific spill response procedures outlined in the SPCC Plan; and 4. Take direction from the Fox General Manager for additional actions needed for spill response. 5.2 Specific Response Procedures Specific response procedures have been developed for accidental spills. Follow the “Spill Response Flow Chart” outlined in Figure 4. Securing the source of the spill is an extremely important step in response activities. However, a source should be secured only if it can be performed safely without risk to human life or health. Steps taken to prohibit the migration of spilled material include installation of fences, earthen berms, straw bales, absorbent material or other devices that may be necessary to contain the spilled material. Another key element in early response to all spills is determining the volume and extent of the spill. These facts should be determined as soon as possible in order to facilitate planning and initiate proper response operations. The volume will be needed to evaluate equipment and personnel needs, as well as requirements for storage and disposal of recovered waste. A rough estimate of the spill volume can be generated from visual observation and source identification. The location of the spill, the potential for the material to migrate, and the volume of the spill are factors that determine the severity of the accidental spill. General response procedures illustrated in the Spill Response Flow Chart (Figure 4) include: 1. When the spill is discovered, begin making notifications on the Spill Release Notification Procedure, Figure 3. 2. Determine if the Spill Response Contractor is needed to assist with complete cleanup. a) If the answer is NO, submit incident reports to the Fox General Manager. b) If the answer is YES, go to step 3. 63 CSS Environmental Services, Inc. Fox Rent A Car Spill Prevention, Control, Countermeasures (SPCC) South San Francisco Job 7106 - SPCC - Fox Rent A Car Page 14 3. Activate the local spill response team. Generally, these are personnel designated by the Fox General Manager, but other contractor personnel may supplement the team. 4. Determine if additional cleanup contractors are necessary for the incident. a) If the answer is NO and the incident is determined to be a minor spill, conduct internal cleanup, review and evaluate the cleanup, determine if the cleanup is beyond the local response team’s ability or equipment. If during cleanup, the incident is determined to be beyond the abilities of the local response team, contact additional contractors to help with the cleanup. b) If the answer is YES, contact additional contractors to help with the cleanup. 5. The local spill response team shall coordinate cleanup activities with the Fox General Manager and agencies as appropriate. 6. Arrange for proper disposal of all waste. 7. Closely monitor all cleanup activities and document spills. 8. Ensure proper disposal of absorbent materials, containers, and soils, as required. 9. Complete the cleanup and restore damaged areas. 5.3 Reporting of Accidental Spills Minor Accidental Spills. For minor spills, it will only be necessary to notify the Fox General Manager, and those individuals that can respond and remove the spill. If minor spills are quickly cleaned up and properly treated, additional notification and reporting will not be necessary. Major Accidental Spills. Upon recognition of a major spill, notification is critical to immediate response. The first notification will be given to the Fox General Manager. After initial spill response has begun, notification will be made to the SMESHMP and SFRWQCB, and to the Spill Response Contractor. The following guidelines should be followed when reporting major spills. 1. Never include information that has not been verified. 2. Never speculate as to the cause of the incident or make any acknowledgment of liability. 3. Do not delay reporting because of incomplete information. 64 CSS Environmental Services, Inc. Notify persons/ agencies and document notification and the content of the message. 5.4 Closing of the Spill Incident Disposal of Spilled Material Following the cleanup of a spill, the spilled material, clean-up materials, and any soil that has been contaminated will be handled in an appropriate manner. Any hazardous materials must be characterized, handled and disposed of off-site. Fox or their designated environmental contractor (CSS) is responsible for sampling, laboratory testing, and reporting of the accidental spill incident. Confirmation of Spill Reporting Telephone notifications to the SMESHMP and SFRWQCB of a reportable spill incident will be confirmed in writing within two weeks of the telephone notification. Final Reporting In the event of an accidental release and subsequent cleanup action, a report will be submitted describing and documenting the type and extent of 1) the spilled contaminated soil and/or contaminated groundwater, 2) sample collection locations on project maps, and 3) contaminant levels, quantities, and disposal activities. The report will be prepared and certified by a California Registered PE and provided to the involved agencies within 45 days after the completion of the project. 65 FIGURES 66 DATE REVISEDBYJOB NO.
