HomeMy WebLinkAboutOrd 1072-1989ORDINANCE NO. 1072-89 AN ORDINANCE AMENDING CHAPTER 15.20 OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE TO ADOPT THE NATIONAL ELECTRICAL CODE, 1987 EDITION, AND TO REPEAL THE NATIONAL ELECTRICAL CODE, 1984 EDITION THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS FOLLOWS: SECTION 1. National Electrical Code, 1984 Edition, Repealed. The National Electrical Code, 1984 Edition (South San Francisco Municipal Code Section 15.20.010 through 15.20.060), as enacted by Ordinance 1007-86, and any other ordinances or parts of ordinances in conflict herewith are hereby repealed. This repeal shall not affect or prevent the prosecution or punishment of any person for any act done or omitted in violation of this chapter prior to the effective date of this ordinance. SECTION 2. Chapter 15.20 of the South San Francisco Municipal Code is hereby amended to read as follows: Section 15.20.010 National Electrical Code, 1987 Edition, adopted by reference. The National Electrical Code, 1987 Edition, published by the National Fire Protection Association, as modified by the amendments, additions and deletions set forth hereinafter, is hereby adopted by reference as the National Electrical Code of the City of South San Francisco, and may be cited as such. Section 15.20.020 Amendments, General. Set forth below are the amendments, additions and deletions to the National Electrical Code, 1987 Edition. Article and section numbers used herein are those of the National Electrical Code. Section 15.20.030 Violations. Article 90-9. It shall be unlawful for any person, firm or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use or maintain any electrical systems or equipment or cause or permit the same to be done in violation of this code. Each day during any portion of which any violation of this code is committed or continued by any person, firm or corporation shall constitute a separate offense and shall be punishable as herein provided. Section 15.20.040 Penalties. Article 90-10. Any person, firm or corporation violating any of the provisions of this ordinance shall be punished as provided for in Section 15.06.040. Section 15.20.050 Wiring Methods. Article 300-23 Wiring Systems. Commercial/industrial business facilities and multi-unit residential buildings containing more than two dwellings units and their properties shall be wired using approved electrical metallic tubing or rigid metallic conduit. This article is intended to supersede the "Permitted Uses" section of raceways and cable types specified in other articles of this code. Exception 1: PVC, fiber duct and cement conduit may be used in slabs or underground installations. Exception 2: Branch circuit wiring within individual tenant areas of commercial and industrial buildings may be wired using EMT conduit, armored cable, metal-clad cable, intermediate metal conduit, rigid metal conduit, and flexible metal conduit. Exception 3: Individual dwelling units and multi-unit projects with two (2) dwelling units or more per building not exceeding three (3) stories in height and of combustible construction, and group M occupancies (as defined in the Uniform Building Code) which are accessory to a residential building may have branch circuit wiring of NMC cable as allowed in this code. Section 15.20.060 Metal-Clad Cable. Article 334-23 Grounding. Type MC cable shall provide an adequate path for equipment grounding as required by Article 25. Plans and details of such installations shall be submitted to the administrative authority for approval prior to installation. Section 15.20.070 Non-Metallic Sheathed Cable. Article 336-3 Uses Permitted. Type NM and Type NMC cables shall be permitted to be used in one - and two-family dwellings, within individual dwellings of multi-unit residential buildings of combustible construction and three (3) stories or less in height (as defined by the Uniform Building Code) and within group M occupancies which are accessory to a residential building. (FPN): See Section 310-10 for temperature limitation of conductors. (a) Type NM. Type NM cable shall be permitted for both exposed and concealed work in normally dry locations. It shall be permissible to install or pull type NM cable in air voids in masonry block or tile walls where such walls are not exposed or subject to excessive moisture or dampness. (b) Type NMC. Type NMC cable shall be permitted: (1) for both exposed and concealed work in dry, moist, damp, or corrosive locations; (2) in outside and inside walls of masonry block or tile; (3) in a shallow chase in masonry, concrete, or adobe and covered with plaster, adobe, or similar finish. Article 336-4 Uses Not Permitted. (a) Type NM or NMC. Type NM and NMC cables shall not be used: (1) in any dwelling or structure exceeding three floors above grade; (2) as service-entrance cable; (3) in commercial or industrial (non-residential) buildings or premises; (4) in theaters and similar locations or places of assembly; (-5) in motion picture studios; (6) in storage battery rooms; (7) in hoistways; (8) embedded in poured cement concrete, or aggregate; or (9) in any hazardous (classified) location. For the purpose of this article, the first floor of a building shall be that floor which is designed for human habitation and which has 50 percent or more of its perimeter level with or above finished grade of the exterior wall line. (b) Type NM. Type NM cable shall not be installed: (1) where exposed to corrosive fumes or vapors; (2) where embedded in masonry, concrete, adobe, fill, or plaster; (3) in shallow chase in masonry, concrete, or adobe and covered with plaster, adobe, or similar finish. SECTION 3. SEVERABILITY. In the event any section or portion of this ordinance shall be determined invalid or unconstitutional, such section or portion shall be deemed severable and all other sections or portions hereof shall remain in full force and effect. 3 TI SECTION 4. PUBLICATION AND EFFECTIVE DATE. After the introduction of this ordinance, pursuant to Government Code Section 50022.3, notice of a public hearing to be held on December 13, 1989, shall be published once a week for two successive weeks in the Enterprise-Journal, a newspaper of general circulation in the City of South San Francisco. Pursuant to the provisions of the Government Code Section 36933, a summary of this ordinance shall be prepared by the city attorney. At least five (5} days prior to the Council meeting at which this ordinance is scheduled to be adopted, the city clerk shall (a) publish the summary, and (2) post in the city clerk's office a certified copy of this ordinance. Within fifteen (15) days after the adoption of this ordinance, the city clerk shall (1) publish the summary, and (2) post in the city clerk's office a certified copy of the full text of this ordinance along with the names of those City Council members voting for and against this ordinance or otherwise voting. This ordinance shall become effective thirty (30) days from and after its adoption.
