HomeMy WebLinkAboutReso 30-2007 RESOLUTION NO. 30-2007 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION CALLING A SPECIAL MUNICIPAL ELECTION TO FILL THE VACANT POSITION OF CITY CLERK; REQUESTING THAT THE COUNTY BOARD OF SUPERVISORS CONSOLIDATE THE ELECTION WITH THE REGULAR ELECTION TO BE HELD ON NOVEMBER 6,2007 AND THAT THE COUNTY REGISTRAR PERFORM CERTAIN ELECTION SERVICES IN CONNECTION WITH SAID SPECIAL ELECTION; AND AUTHORIZING THE CITY MANAGER TO REIMBURSE THE COUNTY FOR ELECTION SERVICES WHEREAS, the position of City Clerk became vacant upon the retirement of the incumbent, effective March 30, 2007; and WHEREAS, the position of City Clerk is an elected position in the City of South San Francisco, and the term of the retired inculnbent shall expire in November 2009; and WHEREAS, pursuant to Government Code Section 36512, when a vacancy occurs in a municipal elective office, the City Council may fill the vacancy by special election. In that event, the special election must be held on the next regularly established election date that is more than 114 days from the date that the Council calls the special election. The November 6, 2007 election is the next election that satisfies those requirements; and WHEREAS, the City Council desires to submit to the voters an election to fill the position of City Clerk for the relnainder of the retired incumbent's term; and WHEREAS, the City Council desires to have the San Mateo County Registrar of V oters render certain services in connection with the special election. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco as follows: 1. The City Council hereby calls a special municipal election to be held on Novelnber 6, 2007 to fill the vacant position of City Clerk. The candidate elected shall serve the remainder of the unexpired term of the retired incumbent. 2. Pursuant to Sections 10400 and 10403 of the California Elections Code, the City Council of the City of South San Francisco hereby requests that the San Mateo County Board of Supervisors direct the Registrar of Voters to conduct all necessary services related to the special municipal election, and to bill the City for the costs of conducting said election. 3. The timing of the submission of nomination documents for candidates shall be governed by Section 10407 of the California Elections Code and submitted to the office of the City Clerk no later than 5 p.m., 88 days prior to the date of the special election, which is August 10, 2007. Nomination documents shall be available in the office of the City Clerk during the hours that City Hall is normally open to the public. 4. Candidate statements shall not exceed 200 words and shall be submitted to the office of the City Clerk with nominating documents, as required by Section 13307 of the California Elections Code. 5. The office of the City Clerk is hereby directed to file a certified copy of this resolution with the Board of Supervisors and the Registrar of Voters of San Mateo County. 6. The City Manager is hereby authorized to reinlburse San Mateo County in full for such services actually perfonned upon presentation of a bill from the County. 7. Notice of the tiIne and place of holding the election is hereby given and the office of the City Clerk is authorized, instructed and directed to give further or additional notice of the election, in tilne, form and manner as required by law. 8. As permitted by Section 13307 of the Elections Code, all candidates shall be required to pay in advance and simultaneously with the sublnission of a candidate statement his or her estilnated pro rata share of the cost of printing, handling, translating, and mailing the candidate statement. A candidate who submits a statement and qualifies as indigent under Section 13309 of the Elections Code shall not be required to pay his or her pro rata share of the cost of printing, handling, translating, and nlailing the statelnent until after the election. The City Clerk is authorized to require payment in any reasonable fonn deemed appropriate to ensure collection. * * * * * * I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular lneeting held on the 19th day of April 2007 by the following vote: AYES: Councihnan Joseph A.
