AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF SOUTH SAN FRANCISCO AMENDING SECTION 20.84
OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE
RELATING TO PARKING AND LOADING REQUIREMENTS
FOR COMMERCIAL AND INDUSTRIAL PLANNED UNIT
DEVELOPMENTS
THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES
ORDAIN AS FOLLOWS:
SECTION 1.
Section 20.84.070 amended.
Section 20.84.070 of the South San Francisco Municipal Code is
hereby amended to read as follows:
"(a) Parking and Loading Space Requirements. The development
shall make adequate provision for delivery and shipment of
materials by truck or rail; standing space for service vehicles,
and parking for visitors, clients, customers and employees.
Parking or loading spaces shall be provided as required by Chapter
20.74 for similar uses with the following exceptions:
(1) The Planning Commission may increase the required
number of spaces or other standards of Chapter 20.74 when it finds
that such increase is warranted due to the nature of the proposed
use.
(2) The City Council may approve a lesser standard for
the number of parking or loading spaces upon a request by the
applicant. Such a request must include, but may not be limited to,
the following information.
An impact analysis discussing all impacts resulting from
the deviation from the usual off-street parking or
loading requirements, alternative parking designs or
strategies considered, and why they were deemed
infeasible, and alternatives for mitigating negative
impacts identified:
A parking analysis which provides a clear, documentable,
rationale describing how and why the proposed parking
design or strategy will work and specifically identifying
where it has been successfully used in other comparable
projects and cities.
Such studies shall be conducted by an approved traffic
professional, retained by the city, at the applicant's expense.
To approve such lesser standard the city council must make the
following findings:

(A) The number of parking and loading spaces or the parking
standards proposed will be adequate for the proposed uses
because of the unique character of the project, the property,
or the offered alternative solutions for providing or managing
parking.
(B) The number of parking and loading spaces provided by such
lesser standard will serve all existing, proposed and
potential uses as effectively and conveniently as would the
standard number of parking and loading spaces required by
Chapter 20.74.
3) The City Council will not consider the following
reasons or conditions acceptable as the sole rationale for allowing
a deviation from the provisions of the off-street parking or
loading space requirements contained in Chapter 20.74:
(A) The potential or estimated increase in or benefit to a
project's revenue generation, cash flow, market value,
marketing strategy, or financial feasibility;
(B) A desire or unsubstantiated need to increase the dwelling
unit or square footage yield of a project by decreasing the
required off-street parking ratio associated with the project
or its individual uses."
(b) Noise, Dust, Odor, Smoke, Vibration Limitations. Noise,
dust, odor, smoke and vibration shall be limited or controlled so
as not to be detrimental to uses within the development or
adjoining properties.
SECTION 2.
Section 20.84.110 amended.
Section 20.84.110 of the South San Francisco Municipal Code is
hereby amended to read as follows:
Section 20.84.110.
Planning commission approval.
"The Planning Commission shall take' final action on the PUD
permit when a planned unit development requires neither the
submission of a tentative subdivision map, a request for a
reduction in the parking or loading space requirements contained in
Chapter 20.74, nor an environmental impact report. A public
hearing, noticed as required by Chapter 20.88, shall be held. At
the conclusion of this public hearing, the Planning Commission
shall review the planned unit development plan for conformity with
the General Plan and any applicable special requirements contained
in this Chapter and, after making any required findings, shall
approve, conditionally approve, or deny issuance of the PUD permit.
For planned unit developments on which the Planning Commission does
not take final action, the Planning Commission shall hold a pubic
hearing and submit a recommendation to the City Council within

forty-five days of the conclusion of the public hearing."
SECTION 3.
Section 20.84.120 amended.
Section 20.84.120 of the South San Francisco Municipal Code is
hereby amended to read as follows:
Section 20.84.120.
City Council approval.
Section 20.84.120 of the South San Francisco Municipal Code is
hereby amended to read as follows:
"The City Council shall take final action on the PUD permit
when a planned unit development requires a tentative subdivision
map, a reduction in the parking or loading space requirements
contained in Chapter 20.74, or an environmental impact report.
(a) The Planning Commission shall forward to the City Council
the appropriate environmental documents; the Commission's written
report advising approval, conditional approval, or disapproval of
the tentative map and/or reduction in parking or loading space
requirements; and a written report advising approval, conditional
approval, or disapproval of the planned unit development.
(b) Within forty-five days following the receipt by the City
Clerk of the reports forwarded by the Planning Commission, a public
hearing, noticed as required by Chapter 20.88 shall be held before
the City Council for formal action on the proposed planned unit
development. At the conclusion of this public hearing the City
Council shall take the following action.
(1) Compliance with CEQA. Prior to approval of a
permit, the City Council shall take the necessary action to comply
with the requirements of CEQA.
(2) Tentative Subdivision Map. The City Council shall
approve, conditionally approve, or disapprove any tentative
subdivision map incident to the planned unit development.
(3) Reduction in Parking or Loading Space Requirements.
The City Council shall approve, conditionally approve, or
disapprove any reduction in the parking or loading space
requirements, as allowed in Section 20.84.070(a), proposed as part
of the planned unit development.
(4) Planned Unit Development. The City Council shall
review the planned unit development for conformity with the General
Plan and any applicable special requirements contained in this
chapter and, after making any required findings, shall approve,
conditionally approve, or deny issuance of the PUD permit."

SECTION 4.
SEVERABILITY
In the event any section or portion of this ordinance shall be
determined invalid or unconstitutional, such section or portion
shall be deemed severable and all other sections or portions hereof
shall remain in full force and effect.
SECTION 5. Publication and Effective Date.
This ordinance' shall be published once, with the names of
those City Councilmembers voting for or against it, in the
Enterprise-Journal, a newspaper of general circulation in the City
of South San Francisco, as required by law, and shall become
effective thirty (30) days from and after its adoption.
