AN URGENCY ORDINANCE OF THE SOUTH SAN FRANCISCO CITY
COUNCILAMENDING CHAPTER 10.40 OF THE SOUTH SAN FRANCISCO
MUNICIPAL CODE BY AMENDING SECTIONS 10.40.010; 10.40.030;
10.40.040; 10.40.050; and 10.40.060
The city Council of the City of South San Francisco does
ordain as follows:
SECTION 1: Section 10.40.010 of the South San
Municipal Code is hereby amended to read as follows:

Section 10.40.010 PURPOSE AND INTENT.
The purpose and intent of this chapter is to restrict the
consumption of alcoholic beverages in public places and parking
lots within the City of South San Francisco. This chapter shall
not be deemed to make punishable any act or acts which are
prohibited by any statute of the state of California.
SECTION 2: Section 10.40.030 the South San Francisco Municipal
Code is hereby amended to read as follows:
Section 10.40.030 ALCOHOL CONSUMPTION IN PUBLIC PLACES.
It is unlawful for any person to consume any alcoholic
beverage in any public place, including any public street,
sidewalk, pedestrian mall, public park, alleyway, or thoroughfare.

SECTION 3: Section 10.40.040 of the South San
Municipal Code is hereby amended to read as follows:

Section 10.40.040 ALCOHOL CONSUMPTION IN PARKING LOTS.
It is unlawful for any person to consume any alcoholic
beverage in any private or public parking lot within the city where
such parking lot has immediate access to a public street. (Ord.
1014 § 1 (part), 1987.)
SECTION 4:
Section 10.40.050 is hereby deleted in its entirety.
SECTION 5: Section 10.40.060 of the South San Francisco
Municipal Code is hereby amended to read as follows:
Section 10.40.060 EXEMPTION.
The provisions of this chapter shall not apply to the
consumption of alcoholic beverages at a city approved function or
event or in a public park pursuant to Municipal Code Section
10.36.070. (Ord. 1014 § 1 (part), 1987.)

SECTION 6:
URGENCY ORDINANCE
Pursuant to Government Code Section 36937, the City Council
of the City of South San Francisco hereby finds that prohibiting
alcoholic consumption in public places is necessary for the
preservation of public peach, health and safety, in that such
prohibition lowers the incidence of criminal activity and offensive
behavior associated with consumption of alcoholic beverages.
SECTION 7:
SEVERABILITY.
In the event any section or portion of this ordinance shall be
determined invalid or unconstitutional, such section or portion
shall be deemed severable and all other sections or portions hereof
shall remain in full force and effect.
SECTION 8:
PUBLICATION AND EFFECTIVE DATE.
This ordinance shall be published once, with the names of
those City Councilmembers voting for or against it, in the
Enterprise Journal, a newspaper of general circulation in the city
of South San Francisco, as required by law, and shall take effect
immediately upon adoption.
Introduced and adopted as an urgency Ordinance of the City of
South San Francisco at a regular meeting of the City Council of the
city of South San Francisco, held the 14th day of
December , 1994, by the following vote:

Councilmembers Jack Drago, Joseph A. Fernekes, John R. Penna
Roberta Cerri Teglia and Mayor Robert Yee

ABSTAIN: None
ABSENT: None

approve the foregoing Ordinance this 14th day of December ,
