CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION AUTHORIZING A PENALTY INCREASE
FOR PARKING METER VIOLATIONS IN THE
DOWNTOWN PARKING DISTRICT
WHEREAS, parking violation fees are considered a civil penalty and may be set
by the governing body of a local jurisdiction pursuant to California Vehicle Code section
40200 et seq.; and
WHEREAS, in December of 2002, the City Council approved a fee increase of
$4.00 for parking meter violations in the Downtown Parking District, which brought the
fee to $15.00; and
WHEREAS, staff now recommends an additional increase of ten dollars to the
parking meter violation fee, bringing the fee to $25.00; and
WHEREAS, the ten dollar increase to the parking meter violation fee will assist in
covering the cost of the contractor hired to process parking citations, offset the rising cost
of equipment supplies, and compensation, and hold those using the meter more
accountable for depositing the appropriate amount of money; and
WHEREAS, under California Vehicle Code section 40203.5, to the extent
possible, issuing agencies within a county must standardize penalties; and
WHEREAS, a comparison survey conducted with similar cities in San Mateo
County and San Francisco shows the City of South San Francisco's current fee schedule
to be the lowest among those cities surveyed; and
WHEREAS, this ten dollar fee increase will help the City of South San Francisco
meet its rising expenses and keep the rates more consistent with that of nearby cities.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
South San Francisco that the City Council hereby authorizes a ten dollar increase in the
penalty for parking meter violations in the Downtown Parking District as defined in
11.56.040 of the South San Francisco Municipal Code.
