Report regarding consideration of Design Review and a Minor Use Permit to allow upgrades to two storage tanks at 470 East Grand Avenue and 455 East Grand Avenue in the Genentech Master Plan District (GMPD) in accordance to Title 20 of the South San Francisco Municipal Code and determination that the project is categorically exempt from CEQA.(Adena Friedman, Chief Planner) RECOMMENDATION Staff recommends that the Zoning Administrator approve the Minor Use Permit (MUP23-0004)and Design Review (DR23-0025)based on the attached Draft Findings and subject to the attached Draft Conditions of Approval,and determine that the project is categorically exempt under the provisions of CEQA, Class 3, Section 15303, New Construction or Conversion of Small Structures. BACKGROUND/DISCUSSION In October,2023,the applicant (Genentech)submitted an application for Design Review and a Minor Use Permit to upgrade two existing bulk industrial gas tanks,which support operations in two Genentech Research and Development (R&D)buildings (B41,at 470 E.Grand Avenue and B42,at 455 E.Grand Avenue).The upgrades include replacing existing tanks with larger tanks,adding new equipment,expanding existing architectural screening to screen the larger equipment, and landscaping improvements around the storage yards. The proposed improvements are part of a campus-wide upgrade of the bulk industrial gas tanks to increase the resiliency of supply by ensuring that tanks have the capacity for one month’s reserve supply.Both proposed sites are within the Genentech Master Plan District (GMPD)and are subject to the requirements of the Genentech Master Plan and associated zoning requirements (South San Francisco Municipal Code Chapter 20.260, Genentech Master Plan District). Project Overview Genentech has submitted Plan Sets (Attachments 1 and 2)and Narratives (Attachments 3 and 4)for the proposed gas tank improvements. Following is a brief discussion of each proposal. B41 New Service Yard Proposal The B41 service yard is located in the parking lot south of the building,and currently has a horizontal 9,000 gallon bulk storage tank,and ambient vaporizer.Genentech is proposing to add an additional 15,000 gallon horizontal bulk tank,housed in a new enclosure located at the hillside.The new tank is approximately 11 feet tall, and 44 feet long. The existing landscape area will be cut back to allow for hillside excavation,to create a space for a new horizontal tank yard,with structural retaining walls at the adjacent hillside.The proposed design approach is intended to minimize the visual impact of the facility and help screen the new enclosure from the surrounding area.The new pad and enclosure will be constructed to match the materials,texture,and colors of the existing enclosure and building. The landscaping improvements are designed to help screen the new enclosure.Seven poplar trees (high-water use)will be removed and will be replaced with seven California buckeye trees (low-water use).Additional columnar shrubs and sea lavender plants are proposed to help screen the facility.Proposed plant species are those that are already thriving within the Genentech campus. B42 Service Yard Expansion The B42 service yard is located at the northeast side of the building,and currently has a 3,000 gallon vertical bulk storage tank and ambient vapor serving a range of R&D labs in the building,located within an existing service yard.Genentech proposes to replace the existing tank with an 11,000 gallon horizontal bulk storage tank.The new tank is approximately 11 feet tall,and 34 feet long.The project also includes a new 14-ton vertical bulk tank,located within the existing service yard.The existing service yard will be expanded,both vertically and horizontally, to accommodate the upgraded facilities. The expanded service yard and additional landscaping are proposed as visual screening for the new tanks, specifically to screen views from the Bay Trail,which runs adjacent to the building to the east.The expanded walled enclosure will be designed with materials and colors to match the existing adjacent enclosure.The project proposes to supplement the existing plantings surrounding the site with new she-oak trees and Pride of Madeira shrubs, to screen the view from the Bay Trail. ZONING CONSISTENCY The project is located within the Genentech Master Plan District (GMPD),which prescribes planning and design principles for facility-wide development in accordance with the Genentech Campus Master Plan. SSFMC Section 20.260.006 (GMPD Administration)requires a Minor Use Permit (MUP)for accessory structures and above grade utility systems of between 501 and 5,000 square feet (sq.ft.).The proposed new tank enclosure at B41 will be approximately 1,300 sq.ft.,and the proposed expanded tank enclosure at B42 will be approximately 950 sq. ft., thus both requiring a MUP. Staff has reviewed the application for the MUP and has determined that it is consistent with the required findings: a.The proposed use will not be adverse to the public health,safety or general welfare of the community, nor be detrimental to surrounding properties or improvements. The proposed tanks are part of a campus wide project to improve the resiliency of the supply of the gas tanks,which support Genentech’s R&D operations.They have been designed to meet all required safety standards and have been reviewed by the relevant City departments (including by the Fire Marshal)to ensure public health and safety. b.The use is consistent with the City’s General Plan and any applicable area plan. The proposed tanks support Genentech’s R&D operations,which is a permitted use by the City’s General Plan, Genentech Master Plan, and implementing zoning. c.The proposed use complies with all applicable standards and requirements of the Zoning Ordinance. The proposed tanks and enclosures,as designed,are consistent with the requirements of the Zoning Ordinance. The proposed tanks and enclosures have been reviewed against the Genentech Master Plan Design Review Checklist and are found to be consistent.The design of the enclosures and associated landscaping are focused on implementing a well-integrated and coherent campus environment. DESIGN REVIEW The Design Review Board (DRB)reviewed the proposed project at its meeting of November 21,2023.The DRB supported the project and recommended approval. ENVIRONMENTAL REVIEW The proposed bulk tanks and associated enclosures are categorically exempt from CEQA,per the provisions of CEQA Guidelines Class 3,15303,New Construction or Conversion of Small Structures,as they are accessory structures. CONCLUSION The proposed project is consistent with the SSFMC Zoning Regulations for the Genentech Master Plan District, the Genentech Master Plan,and the General Plan.The project will expand the capacity of the bulk storage tanks on the Genentech campus,thus supporting the existing and future R&D uses throughout the campus.Staff recommends that the Zoning Administrator approve the Minor Use Permit (MUP23-0004)and Design Review Permit (DR23-0025)to allow the upgraded bulk storage tanks at 455 and 470 East Grand Avenue in the Genentech Master Plan District, and determine that the project is categorically exempt from CEQA. Grand Avenue and 470 E. Grand Avenue (As recommended by City Planning Staff on December 13, 2023) As required by the Genentech Master Plan District (SSFMC 20.260), the following findings are made in support of a Minor Use Permit and Design Review to upgrade existing bulk tanks and expand and construct screening enclosures at 455 E. Grand Avenue and 470 E. Grand Avenue in the Genentech Master Plan District (GMPD) in accordance with Title 20 of the South San Francisco Municipal Code (SSFMC), based on materials submitted to the City of South San Francisco Planning Division which include, but are not limited to: Application materials prepared by applicant, submitted October 3, 2023; staff report dated December 13, 2023; and Conditions of Approval. Minor Use Permit Findings 1. The proposed use will not be adverse to the public health, safety or general welfare of the community, nor be detrimental to surrounding properties or improvements. The proposed tanks are part of a campus wide project to improve the resiliency of the supply of the gas tanks, which support Genentech’s R&D operations. They have been designed to meet all required safety standards, and have been reviewed by the relevant City departments (including by the Fire Marshal) to ensure public health and safety. 2. The use is consistent with the City’s General Plan and any applicable area plan. The proposed tanks support Genentech’s R&D operations, which is a permitted use by the City’s General Plan, Genentech Master Plan, and implementing zoning. 3. The proposed use complies with all applicable standards and requirements of the Zoning Ordinance. The proposed tanks and enclosures, as designed, are consistent with the requirements of the Zoning Ordinance. 4. The use complies with the Genentech Master Plan District’s facility design guidelines. The proposed tanks and enclosures have been reviewed against the Genentech Master Plan Design Review Checklist, and are found to be consistent. The design of the enclosures and associated landscaping are focused on implementing a well-integrated and coherent campus environment. Design Review Findings 1. The design of the new enclosures and associated landscaping is consistent with the requirements of the Zoning Ordinance, as the enclosures and landscaping are designed to screen the bulk storage tanks from view, and they are compatible with the existing design of the buildings on the Genentech campus. 30 2. The new bulk storage tanks and enclosures are consistent with the General Plan and the Genentech Master Plan, as they are an accessory use to a permitted R&D use. 3. The design of the new enclosures and the associated landscaping is consistent with the Genentech Master Plan’s Facility Design Checklist. 4. The Project, including Design Review, is consistent with the Minor Use Permit that the project requires for the reasons stated above. 5. The Project is consistent with the applicable design review criteria in South San Francisco Municipal Code Section 20.480.006 (Design Review Criteria) because the project has been evaluated by the Design Review Board on November 21, 2023 and found to be consistent with each of the eight design review criteria included in the “Design Review Criteria” section of the Ordinance. 31 P23-0112, Conditions of Approval Page 1 DRAFT Conditions of Approval P23-0112: MUP 23-0004, DR23-0025 455 E. Grand Avenue and 470 E. Grand Avenue (As recommended by City Planning Staff on December 13, 2023) Introduction The term “applicant”, “developer”, “project owner” or “project sponsor” used hereinafter shall have the same meaning- the applicant for the 455 E. Grand and 470 E. Grand project or the property/project owner if different from applicant. PLANNING DIVISION 1. The project shall be constructed and operated substantially as indicated on the plan sets prepared by DGA Architects on September 27, 2023 and approved by the Zoning Administrator in association with P23-0112 as amended by the conditions of approval. The final plans shall be subject to the review and approval of the City’s Chief Planner. 2. The construction drawings shall comply with the Zoning Administrator approved plans, as amended by the conditions of approval, including the plans prepared by DGA Architects on September 27, 2023. 3. Any modification to the approved plans shall be subject to SSFMC Section 20.450.012 (“Modification”), whereby the Chief Planner may approve minor changes. All exterior design modifications, including any and all utilities, shall be presented to the Chief Planner for a determination. 4. .Unless the use has commenced or related building permits have been issued within two (2) years of the date this permit is granted, this permit will automatically expire on that date, subject to any extensions provided under the Subdivision Map Act or other applicable law. A one-year permit extension may be granted in accordance with provisions of the SSFMC Chapter 20.450 (Common Procedures) 5. The permit shall not be effective for any purpose until the property owner or a duly authorized representative files a signed acceptance form, prior to the issuance of a building permit, stating that the property owner is aware of, and accepts, all of the conditions of the permit. 6. The permit shall be subject to revocation if the project is not operated in compliance with the conditions of approval. 32 P23-0112, Conditions of Approval Page 2 7. Neither the granting of this permit nor any conditions attached thereto shall authorize, require or permit anything contrary to, or in conflict with any ordinances specifically named therein. 8. Prior to construction, all required building permits shall be obtained from the City’s Building Division. 9. Demolition of any existing structures on site will require demolition permits. 10. All conditions of the permit shall be completely fulfilled to the satisfaction of the affected City Departments and Planning and Building Divisions prior to occupancy of any building. 11. Plant materials shall be replaced when necessary with the same species originally specified unless otherwise approved by the Chief Planner. 12. All landscape areas shall be watered via an automatic irrigation system which shall be maintained in fully operable condition at all times, and which complies with SSFMC Chapter 20.300 (Lot and Development Standards). 13. All planting areas shall be maintained by a qualified professional; the landscape shall be kept on a regular fertilization and maintenance program and shall be maintained weed free. 14. Plant materials shall be selectively pruned by a qualified arborist; no topping or excessive cutting-back shall be permitted. Tree pruning shall allow the natural branching structure to develop. 15. Landscaped areas in the project area may contain trees defined as protected by the South San Francisco Tree Preservation Ordinance, Title 13, Chapter 13.30. Any removal or pruning of protected trees shall comply with the Tree Preservation Ordinance, and applicant shall obtain a permit for any tree removals or alterations of protected trees, and avoid tree roots during trenching for utilities. 16. Construction drawing shall show compliance with SSFMC Section Chapter 20.180 (Flood Plain / Sea Level Rise Overlay), if applicable. Permit(s) shall be required as set forth in adopted California Fire Code (CFC) Sections 105.5 and 105.6. Submittal documents consisting of construction documents, statement of special inspection, geotechnical report, referenced documents, and other data shall be submitted electronically with each permit application. The construction documents shall be prepared by a registered design professional. Where special conditions exist, the code official is authorized to require additional construction documents to be prepared by a registered design professional. 4. Construction documents shall be to scale (graphic scale required on all plan sheets), dimensioned and drawn on suitable electronic media. Construction documents shall be of sufficient clarity to indicate the location, nature and extent of the work proposed and show in detail that it will conform to the provisions of adopted codes and relevant laws, ordinances, rules, and regulations, as determined by the fire code official. 5. Shop drawings for the fire protection system(s) and other hazardous operations regulated by the fire department shall be submitted directly to the Fire Department to indicate conformance with adopted codes and standards. The construction documents shall be approved prior to the start of system installation. 6. The construction documents submitted with the application for permit shall be accompanied by a site plan showing to scale the size and location of new construction and existing structures on the site, distances from lot lines, the established street grades and the proposed finished grades and it shall be drawn in accordance with an accurate boundary line survey. In the case of demolition, the site plan shall show construction to be demolished and the location and size of existing structure and construction that are to remain on the site or plot. 7. Prior to submittal of building permits, design documents for proposed fire service features, such as fire apparatus access road(s), premise identification, and fire protection water supplies shall be submitted to the fire department for review and approval. a. Where fire apparatus access roads or a water supply for fire protection are required to be installed, such protection shall be installed and made serviceable prior to and during the time of construction except where approved alternative methods of protection are 34 P23-0112, Conditions of Approval Page 4 provided. Temporary street signs shall be installed at each street intersection where construction of new roadways allows passage by vehicles. b. Construction documents for proposed fire apparatus access, location of fire lanes, security gates across fire apparatus access roads and construction documents and hydraulic calculations for fire hydrant systems shall be submitted to the fire department for review and approval prior to construction. 8. Prior to issuance of building permits, the owner or owner’s authorized agent shall be responsible for the development, implementation, and maintenance of an approved written site safety plan approved by the fire code official in accordance with Section 3303. 9. Prior to issuance of building permits, the fire code official shall have the authority to require construction documents and calculations for all fire protection and life safety systems and to require permits be issued for the installation, rehabilitation or modification of any fire protection and life safety systems. Construction documents for fire protection and life safety systems shall be submitted for review and approval prior to system installation. 10. Fire apparatus access roads shall be approved by the fire code official, installed and maintained in accordance with CFC Section 503 and Appendix D. a. Approved fire apparatus access roads shall be provided for every facility, building or portion of a building hereafter constructed or moved into or within the jurisdiction in accordance with adopted codes and standards at time of building permit application. i. Traffic calming measures (bollards, speed cushions, humps, undulations, etc.) are required to be approved by the fire code official prior to installation. ii. Should a security gate(s) be planned to serve the facility, they shall be approved by the fire code official prior to installation. b. Required Fire Department access roads shall be signed “No Parking – Fire Lane” per current Fire Department standards and California Vehicle Code (CVC) Section 22500. 11. Construction site plans shall detail existing/proposed fire apparatus access roadway grades, surfacing, load capacity, inside and outside turning radii, etc. from the public way. 12. It appears a fire apparatus access turnaround will be required at B41 site based on location on site for the proposed install. 13. Each site location will be required to be permitted individually per parcel. 14. The following are a list of submittal items that are required by the Fire Department and shall be submitted directly to the Fire Department, additional items may be called out based on subsequent reviews: a.
