ORDINANCE NO. 1266-2000
AN ORDINANCE AMENDING T1TLE 8, CHAPTER 8.54 OF THE SOUTH
SAN FRANCISCO MUNICIPAL CODE ENTITLED COMMUNITY
PRESERVATION ORDINANCE TO AUTHORIZE SUMMARY ABATEMENT
OF IMMEDIATE DANGERS TO HEALTH AND SAFETY
The City Council of the City of South San Francisco does ORDAIN as follows:
Section 1. Title 8, Chapter 8.54 is hereby amended to the South San Francisco Municipal Code
entitled, "Community Preservation Ordinance," by adding Section 8.54.150 as follows:
"TITLE 8 HEALTH AND WELFARE
Chapter 8.54 Community Preservation Ordinance
ABATEMENT PROCEDURE
Section 8.54.150: SUMMARY ABATEMENT OF IMMEDIATE DANGERS.
(a) Whenever any condition on or use of property causes or constitutes or
reasonably appears to cause or constitute an imminent or immediate danger to the health or safety
of the public, the condition or use may be summarily abated by the city without notice or hearing.
(b) When summary abatement is necessary, it shall be ordered only by the city
manager or the person performing the duties of city manager pursuant to Section 2.36.020 of this
code.
(c) Summary abatement shall be limited to those actions necessary to
eliminate the immediate threat to the public health and safety.
(d) Notice of the summary abatement shall be provided to the owner(s) as
soon as practical in accordance with provisions of Section 8.54.110 covering service in person or by
certified mail.
(e) The costs and expenses of a summary abatement shall be made a lien on
the property and shall be collected pursuant to the Recovery of Costs provisions set forth in this
Chapter at Section 8.54.200 et seq.

Section 2. PUBLICATION AND EFFECTIVE DATE.
This ordinance shall be published once, with the names of those City Council members voting for
and against it, in the San Mateo Times, a newspaper of general circulation in the City of South San
Francisco, as required by law, and it shall become effective thirty (30) days from and after its
adoption.
Section 3: SEVERABILITY
In the event any section or portion of this ordinance shall be determined invalid or
unconstitutional, such section or portion shall be deemed severable and all other sections or
portions hereof shall remain in full force and effect.
Introduced and adopted at a regular meeting of the City Council of the City of South San
Francisco, held the 22nd day of March, 2000, by the following vote:
