The regular meeting ofthe Redevelopment Agency is held on the second Wednesday of each month
at 7:00 p.m. in the Municipal Services Building, Community Room, 33 Arroyo Drive, South San
Francisco, California.
Public Comment: For those wishing to address the Board on any Agenda or non-Agendized item,
please complete a Speaker Card located at the entrance to the Community Room and submit it to
the Clerk. Please be sure to indicate the Agenda Item # you wish to address or the topic of your
public comment. California law prevents Redevelopment Agency from taking action on any item
not on the Agenda (except in emergency circumstances). Your question or problem may be
referred to staff for investigation and/or action where appropriate or the matter may be placed on a
future Agenda for more comprehensive action or a report. When your name is called, please come
to the podium, state your name and address for the Minutes. COMMENTS ARE LIMITED TO

WHEREAS, 4-H is a community of young people learning leadership, citizenship
and life skills; and,
WHEREAS, 4-H is one of the largest youth development organizations in
California and the largest in the nation with 6.5 million young people; and,
WHEREAS, 4-H in California claims 130,000 youth members and 20.000 adult
volunteers, while San Mateo County's 4-H program numbers more than 500 members
and more than 250 volunteers; and,
WHEREAS, 4-H as part of the University of California Agriculture and Natural
Resources is a program where youth learn through hands-on experiences in science,
engineering and technology, healthy living and citizenship projects, events and activities;
and,
WHEREAS, 4-H has been providing youth with the innovative research and
resources from our nation's 106 land-grant universities and colleges for more than 100
years;
NOW, THEREFORE, J, RICHARD A. GARBARINO, Mayor of the City of South
San Francisco, on behalf of City Council, do hereby proclaim October 2007 as: National
4-H Month in the City of South San Francisco.

A RESOLUTION SUMMARILY VACATING A 10-FOOT WIDE PUBLIC
SERVICE EASEMENT LOCATED BETWEEN HEMLOCK AND LARCH

RECOMMENDA TION
It is recommended that the City Council adopt a resolution vacating a to-foot wide public
service easement located on Hemlock and Larch Avenues adjoining four residential properties.
BACKGROUND/DISCUSSION
In 1949, the City acquired a 10-foot wide public service easement located between four certain
properties, 80 I Hemlock A venue, 753 Hemlock Avenue, 728 Larch Avenue, and 726 Larch Avenue
in the City of South San Francisco, County of San Mateo, State of California, more particularly
described in Exhibit A. The City's Public Services Department closed off the easement from public
use approximately forty-two years ago due to complaints from the adjoining property owners
regarding trash, trespass, and noise. One property owner approached the City recently about the need
for the property, which caused staff to confer with all four property owners who connect to this
easement as to their desire for ownership. All are in favor of the city vacating to them a 10- foot
wide public service easement.
Pursuant to Section 15061 (b) (3) of the California Environmental Quality Act (CEQA) Guidelines,
vacation of this public service easement is not a project within the meaning of the CEQA because it
has no potential for causing a significant effect on the environment.
Per the California Streets and Highways Code Section 8333, (I) the easement proposed for vacation
has not been used for the purpose for which it was acquired for five consecutive years immediately
preceding the proposed vacation; and (2) there are no other public facilities located within the
easement.

City staff has informed the residents that it will not remove the concrete stairs or fences at either end.
Staffwill only remove the locks from the gates. The City will be responsible only for the paperwork
and recording of documents and it will be up to the property owners to make improvements in the
future, if they so desire.

Sufficient funds are available to cover the costs to prepare and record the proper documents in the
office of the County Recorder of the County of San Mateo. No funds will be collected from the
residents, as no sale will take place.
CONCLUSION
Approval of this resolution vacating a IO-foot wide public service easement will resolve a long
standing problem for both the City and the adjoining four property owners. It will relieve the City of
future maintenance and liability, while allowing the property owners use of otherwise non-functional
land. From the date the vacation is recorded, the easement shall no longer constitute a public service
easement.

WHEREAS, in 1949, the City acquired a ten-foot wide public service easement
between four certain properties commonly described as 801 Hemlock Avenue, 753
Hemlock Avenue, 728 Larch A venue, and 726 Larch Avenue in the City of South San
Francisco, County of San Mateo, State of California, more particularly described In
Exhibit A attached hereto and incorporated by this reference (the "Easement"); and
WHEREAS, the Easement was closed off from public use by the City's Public
Services Department approximately forty-two years ago due to complaints from
adjoining property owners regarding trash, trespass and noise; and
WHEREAS, the City Council hereby finds, pursuant to Section 15061 (b)(3) of
the California Environmental Quality Act (CEQA) Guidelines, that vacation of this
public services easement is not a project within the meaning of the CEQA because it has
no potential for causing a significant effect on the environment; and
WHEREAS, the City Council hereby finds, pursuant to California Streets and
Highways Code Section 8333, the following: (I) the Easement proposed for vacation has
not been used for the purpose for which it was acquired for five consecutive years
immediately preceding the proposed vacation; and (2) there are no other public facilities
located within the Easement.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
South San Francisco as follows:
1. The foregoing recitals are true, correct, and incorporated herein by reference.
2. The Easement described above and in Exhibit A is hereby vacated pursuant to
Section 8333 of the California Streets and Highways Code.
3. The City Clerk is directed to cause a certified copy of this resolution, attested
by the Clerk under seal, to be recorded in the office of the County Recorder of
the County of San Mateo.
4. From and after the date of this resolution is recorded, the Easement shall no
longer constitute a public service easement.

WHEREAS, Roy Benton Varney retiredfrom the City of South San Francisco on
August 3, 2007; and
WHEREAS, the retirement celebration honoring Lieutenant Varney on October 19, 2007,
at the South San Francisco Conference Center, will commemorate his thirty-one years as a member
of the South San Francisco Police Department; and
WHEREAS, Roy began his working career with the South San Francisco Police
Department on February 13, 1976 as a police officer and served as K-9 Handler in January 1980;
he rose through the ranks and appointed sergeant in 1984 and lieutenant in 1987; he served as
Personnel and Training Manager for two years, Communications Bureau Commander for four
years and Criminal Investigations Bureau Commander jor jive years; and
WHEREAS. during a distinguished law enforcement career, Roy's accomplishments have
included serving as a K-9 Unit Coordinator, receiving a 1992 Chief's Award and numerous letters
and Certificates of Appreciation from law enforcement agencies and community organizations for
canine training and demonstrations; recognition from Domestic Violence Prevention organizations
and instrumental in modifYing the San Mateo County Domestic Violence Protocols to simplifY the
process ofnotifjJing domestic violence advocates for emergency assistance to victims; and
WHEREAS, Roy's professional affiliations have included: secretary and treasurer of the
South San Francisco Police Association; Belmont Little League Board of Directors; Ci~v of South
San Francisco Employee Recognition Committee; president of the San Mateo County Training
Managers Association; Board of Directors of both the South San Francisco Boys and Girls Club
and the South San Francisco Police Athletic League; bargaining representative of South San
Francisco Public Safety Managers; Legal Process Committee of the San Mateo County Task Force
on Violence Against Women; and
WHEREAS, committed to his profession, Roy's participation includes the South San
Francisco Police Association. International Police Officers Association, California Police Officers
Association, California Reserve Officers Association, East Bay Regional Park District Volunteer,
AKC Canine Good Citizen Evaluator and the California Mounted Officers.
NOW, THEREFORE, the City Council of the City of South San Francisco hereby issues this
proclamation in honor of the retirement of Lieutenant Roy Benton Varney for his dedicated and
exemplmy service from February 13, 1976 to August 3, 2007. and recognizes his outstanding
efforts in the protection of life and property in this community.
