Box 711 (City Hall, 400 Grand Avenue) South San Francisco, CA File Number: 24-593 Enactment Number: ORD 1657-2024 ORDINANCE AMENDING TITLE 2 OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE TO DECREASE THE POTENTIAL NUMBER OF MEMBERS SERVING ON THE CULTURAL ARTS COMMISSION FROM ELEVEN MEMBERS TO NINE MEMBERS. WHEREAS, in 2020, the City adopted Municipal Code Chapter 8.76 - Public Art Requirement, which dedicated new funding resources for the arts; and WHEREAS, at the September 27, 2023 South San Francisco City Council meeting, the Council adopted the City's first Public Art Master Plan ("Plan"); and WHEREAS, Recommendation #10 of the Plan is to "Clarify the roles and responsibilities of the Cultural Arts Commission," which acknowledges the role of the Cultural Arts Commissioners since its inception in 1994 where members have assumed multiple roles, including supporting events and coordinating artist selection, which are roles that would normally be coordinated by staff and adjudicated by peer panels; and WHEREAS, the current membership of the Cultural Arts Commission ("Commission") is eleven members; and WHEREAS, given the new funding resources made available by the adoption of the Public Art Requirement, there are now more financial resources available for staff to provide event support; and WHEREAS, staff recommends the change in the number of membership of the Commission from eleven members to nine members as part of a shift to reduce the responsibilities of volunteerism from the commissioners to a role more heavily focused on advising on art policy and programs; and WHEREAS, the new membership number of nine commissioners will take effect upon the expiration of the term for the first two respective commissioners; and WHEREAS, in the event that a vacancy occurs prior to the end of a current term, the number of membership shall be reduced accordingly until another member is appointed to bring the number of commissioners back to nine; and WHEREAS, based on all of the information presented at the May 22, 2024 City Council meeting, both written and oral, including without limitation the public comment, staff reports, minutes, and other relevant materials (hereafter the "Record"), the City Council finds that under CEQA Guidelines Sections 15378 and 15061(b)(3), this Ordinance amendment does not constitute a project under CEQA as it is an organizational structure change that will not result in any direct or indirect physical change in the environment and therefore review under CEQA is not required pursuant to CEQA Guidelines Section 15060. City of South San Francisco File Number: 24-593 Enactment Number: ORD 1657-2024 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Incorporation of Recitals. The City Council of South San Francisco finds that all Recitals are true and correct and are incorporated herein by reference. SECTION 2. Amendments. Title 2 of the South San Francisco Municipal Code is hereby amended with additions in double underline and deletions in str4kethfough. Sections and subsections that are not amended by this ordinance are not included below and shall remain in full force and effect. E. Revise Chapter 2.80 "Cultural Arts Commission" as follows: § 2.80.010. Cultural arts commission established. The South San Francisco arts commission is established, consisting of up to eleven nine members who are residents of the city. The city council shall appoint the commissioners. (Ord. 1142 § 1, 1994; Ord. 1573 § 2, 2019; Ord. 1596 § 2, 2020) § 2.80.045. Limitation of terms -Vacancies. Commission members shall be limited to three consecutive terms. For purposes of calculating consecutive terms, service of at least two years plus one day during a term shall be counted as a complete term; all prior continuous service of existing commission member shall be counted. Upon serving the maximum number of consecutive terms, a commissioner shall not be eligible for re -appointment to the cultural arts commission for a period of two years. If a vacancy occurs on the commission, the city council shall appoint an individual to serve the remaining unexpired term of the former incumbent. During any vacancies, the number of membership shall be reduced accordingly until another member is appointed to bring the number of commissioners back up to nine members.( Ord. 1395 § 8, 2008; Ord. 1573 § 2, 2019) At a meeting of the City Council on 6/12/2024, a motion was made by Councilmember Nagales, seconded by Vice Mayor Flores, that this Ordinance be adopted.
