Box 711 (City Hall, 400 Grand Avenue) City Council South San Francisco, CA • Ordinance: ORD 1658-2024 File Number: 24-609 Enactment Number: ORD 1658-2024 ORDINANCE AMENDING CHAPTER 2.12 OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE AND PROVIDING FOR A SALARY INCREASE FOR THE MEMBERS OF THE CITY COUNCIL. WHEREAS, the City Council finds that California Government Code Section 36516 provides that a city council may enact an ordinance providing that each member of the city council shall receive a salary based on the population of the city; and WHEREAS, the compensation schedule set forth under Government Code Section 36516(a)(1) has not been adjusted since 2017; and WHEREAS, Ordinance No. 1536, adopted in 2017, provided for a salary of $1,000 per month for members of City Council pursuant to Government Code Section 36516; and WHEREAS, on June 29, 2023, the California Legislature passed SB-329, which amended Government Code Section 36516 to increase the maximum amounts of salary that can be approved by city ordinance in order to account for inflation and support diversity in city councils; and WHEREAS, Government Code Section 36516(a)(2)(A) as amended in 2023 now provides that councilmember salaries for cities over 50,000 up to and including 75,000 in population, may be up to and including one thousand six hundred dollars ($1,600) per month; and WHEREAS, according to the most recent U.S. Census data, as of July 1, 2022, the population estimate for the City is 63,484; and WHEREAS, the City finds that adjusting councilmember salaries is needed to account for inflation and maintain and enhance diversity in city council membership because increased compensation can help individuals from across different income levels and with different financial needs receive sufficient income for their service; and WHEREAS, the City now desires to adjust City Council member salaries from $1,000 per month to $1,400 per month. NOW THEREFORE, the City Council of the City of South San Francisco does ordain as follows: SECTION 1. Findings The City Council finds that the foregoing recitals are true and correct and are incorporated into the Ordinance by this reference. Amendments to Section 2.12.020 of Chapter 2.12 (City Council Compensation) of the South San Francisco Municipal Code The City Council hereby amends Section 2.12.020 of Chapter 2.12 (City Council Compensation) of the South San Francisco Municipal Code to read as follows, with additions in underline and deletions in str-ikethfeugh: Section 2.12.020 Salaries. Each member of the city council of the city shall receive as salary the following: (a) The sum of r:<� one thousand dollars per month; s po r-ibea in said Se tie 36516 of the Govemment Code for- eities over- fifty thousand UP to and ineluding seventy five thousand i population, which shall be payable at the same time and in the same manner as salaries are paid to other officers and employees of the city, until the increase in subsection (b) goes into effect. (b) The city council salary shall be increased to one thousand four hundred dollars per month for all members of the city council, as prescribed in Section 36516 of the Government Code for cities over fifty thousand up to and including seventy five thousand in population at such time as one or more members become eligible for a salary increase by virtue of beginning a new term of office after the November 204924 general election, pursuant to Government Code Section 36516.5. SECTION 3. Amendments to Section 2.12.030 of Chapter 2.12 (City Council Compensation) of the South San Francisco Municipal Code The City Council hereby amends Section 2.12.030 of Chapter 2.12 (City Council Compensation) of the South San Francisco Municipal Code to read as follows, with additions in underline and deletions in str4ketlfet : Section 2.12.030 Increase or decrease. The salaries provided in this chapter may be increased or decreased as follows: (a) Following any new and later estimate of population made by the Department of Finance, placing the city in a population group other than that set forth in Section 2.12.020, the salary payable to each member of the council may be increased or decreased by ordinance of the city council to equal the sum prescribed for that population group in Section 36516 of the Government Code, as amended. (b) An amount equal to five percent for each calendar year from the operative date of the last adjustment of the salaries in effect, in accordance with Government Code Section 36516 and as approved by city council ordinance. (c) An amount equal to inflation since January 1 2024 based on the California Consumer Price Index, not to exceed ten percent per calendar year, in accordance with Government Code Section 36516 and as approved by city council ordinance. (ed) In accordance with Government Code Section 36516, by a majority of the electors voting at any municipal election. City of South San Francisco Printed on 6/13/24 File Number: 24-609 Enactment Number: ORD 1658-2024 (de) The salaries as so increased or decreased shall become payable only on and after the date upon which one or more members of the council becomes eligible therefore by virtue of beginning a new term of office following a general municipal election held in the city. SECTION 4. Amendments to Section 2.12.050 of Chapter 2.12 (City Council Compensation) of the South San Francisco Municipal Code The City Council hereby amends Section 2.12.050 of Chapter 2.12 (City Council Compensation) of the South San Francisco Municipal Code to read as follows, with additions in underline and deletions in str-il oug: Section 2.12.050 Operative Date. The ordinance codified in this chapter shall become operative only on and after the date upon which one or more members of the council of the city becomes eligible for the salary prescribed in this section by virtue of beginning a new term of office following the general municipal election next succeeding its effective date, and prior to said operative date, councilmembers' salaries shall be ri..� one thousand four hundred dollars per month. SECTION 5. Severability. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed the Ordinance, and each and -every section, subsection, sentence, clause, or phrase not declared invalid or unconstitutional without regard to whether any portion of this Ordinance would be subsequently declared invalid or unconstitutional. SECTION 6. Publication and Effective Date. Pursuant to the provisions of Government Code Section 36933, the City Attorney shall prepare a summary of this Ordinance. At least five (5) days prior to the Council meeting at which this Ordinance is scheduled to be adopted, the City Clerk shall (1) publish the Summary, and (2) post in the City Clerk's Office a certified copy of this Ordinance. Within fifteen (15) days after the adoption of this Ordinance, the City Clerk shall (1) publish the summary, and (2) post in the City Clerk's Office a certified copy of the full text of this Ordinance. At a meeting of the City Council on 6/12/2024, a motion was made by Councilmember Nagales, seconded by Vice Mayor Flores, that this Ordinance be adopted. The motion passed.
