RECOMMENDATION
It is recommended that the City Council consider the attached citizen applications for
appointment to the open seats on the respective Board, Commission or Agency applied for;
and that at the May 21, 2008 Special Meeting of the City Council, Council interview each
citizen. It is further recommended that upon completion of interviews for the positions,
Council move to appoint Commissioners to respective full terms on the Conference Center
Authority, Cultural Arts Commission, Housing Authority and San Mateo County Flood
Control District and that Council move to appoint persons to fill the vacancies on the Parks
and Recreation Commission, Historic Preservation Commission and Housing Authority
through the remainder of the respective resignee's term.
PRELIMINARY DISCUSSION PERTAINING TO PENDING ORDINANCE NO. 1395-2008
REGARDING TERMS AND TERM LIMITS FOR THE CITY'S BOARD AND COMMISSION
MEMBERS.
Pending Ordinance 1395-2008 (attached) is not effective until June 13,2008. Thus, it is not
applicable to the present proceedings. However, with the exception of the appointees to the
Housing Authority, all appointees will be subject to the Ordinance on its effective date.
Accordingly, this Staff Report includes a calculation of terms served, as defined pursuant to the
pending Ordinance, for the three (3) affected individuals applying for reappointment. As set forth
below, the calculations demonstrate that none of the individuals would be prohibited from
serving another term if these proceedings were held after the effective date of the Ordinance.
BACKGROUND/DISCUSSION
A. Positions Recruited by the City Clerk's Office.
On April 7, 2008, due to expiration of terms and resignations, the City Clerk's Office initiated
recruitment for the following Boards and Commissions:
a. Parks and Recreation Commission- Vacancy (P. Gonzalez). The appointee will serve the
remainder of Commissioner Gonzalez's tell11 to expire December 31, 2008.

b. Cultural Arts Commission- Vacancies (Fourie and A. Gonzalez). Two (2) appointees n1ay fill
the vacated seats on the Cultural Arts COl11111ission.
c. Historic Preservation Commission- Vacancy (D 'Angelo). The appointee will serve the
rel11ainder ofMr. D'Angelo's term to expire Decel11ber 31,2010.
d. Housing Authority- Vacancy (Commissioner Oborne). The appointee will serve the remainder
of Mrs. Oborne's tern1 to expire March 31, 2009.
e. Housing Authority-Expiration of Terms (Comrnissioner Nicolas and Tenant Commissioner
Britt). The Con1lnissioner appointee will serve a four (4) year tenl1 to expire March 31, 2012.
The Tenant COl111nissioner appointee will serve a two (2) year tenl1 to expire March 31, 2010.
Ms. Britt did not apply for reappointment to the Tenant COlnmissioner position.
f San Mateo County Flood Control District- Expiration of Term (Damonte). The appointee will
serve a four (4) year term to expire March 31,2012. Mr. Damonte did not apply for
reappointment.
The City Clerk's Office posted the attached Notice of Tenl1 Expirations and Vacancies on Monday,
April 7, 2008 at City Hall, the Municipal Services Building, City I--Iall Annex, West Orange Library and
the Grand Avenue Library. A statement announcing the vacancies and identifying the application
deadline including a link to the application has been on the City's website homepage during most of the
recruitment period. Notification was sent to the Agenda Distribution list 111aintained by the City Clerk's
Office as well as to current Board and Commission Mel11bers. The Notice was also published in the San
Mateo County Times on April 12, 2008. A brief announcement of the term expirations and vacancies
was posted on the Con1munity Channel until Thursday, May 15,2008 at 5:00 p.lli. The City Clerk's
Office also sent letters to individuals who had submitted applications to serve on the affected entity
within the past year and a half, but whose applications had expired due to submission over one (l) year
ago.
The City Clerk's OffIce accepted applications until 5:00 p.m. on Thursday, May 15, 2008.
B. Positions Recruited by the Executive Director of the South San Francisco Conference Center.
a. Hotel Representative- Two (2) Term Expirations (Ortiz and Herbert). The appointees will
respectively serve tlu'ee (3) year terms to expire March 27, 2011. According to the records
maintained by the City Clerk's Office upon the Clerk's installation to Office on December 4,
2007, Mr. Ortiz will have completed one (1) full term as defined pursuant to pending
Ordinance No. 1395-2008 and will thus be eligible to serve additional consecutive terms. Mr.
Herbert has not applied for reappointment due to out of state relocation.

b. South San Francisco Business or Resident Representative- Tlvo (2) Term Expirations (da
Cunha and Metz). The appointees will respectively serve tlu'ee (3) year tenl1S to expire March
27, 2011. According to the records n1aintained by the City Clerk's Office upon the City
Clerk's installation to Office on Decen1ber 4, 2007, Mr. da Cunha will have cOl11pleted tlu'ee
(3) full terms as defined pursuant to pending Ordinance No. 1395-2008 and will thus be
eligible to serve one (1) additional three (3) year tern1. Mr. Metz will have completed one (1)
full tern1 pursuant to pending ordinance nUl11ber 1395-2008 and will thus be eligible to serve
additional consecutive tenl1S.
SUMMARY OF MEETING TIMES, TERM LENGTHS/LIMITS AND AGENCY PURPOSE
The Conference Center Authority meets on the first Monday of every other month, at 4:45 p.m. at the
South San Francisco Conference Center. Commissioners are appointed to three (3) year terms. The
purpose of the Authority is to manage, operate, l11arket, l11aintain, and pr01110te the South San Francisco
Conference Center.
The Parks and Recreation Commission n1eets on the fourth Thursday of every month at 7:00 p.l11. in
the Municipal Services Building located at 33 Arroyo Drive in South San Francisco. Conunissioners are
appointed to four (4) year tenl1S. The C0l11111ission advises the Council on matters pertaining to public
recreation, including parks and playgrounds. The Coml11ission also assists in the plmming of a cOl11plete
recreation program and in the planning of a department budget.
The Cultural Arts Commission meets on the third Thursday of every l110nth at 7:00 p.l11. in the Betty
Weber Room of the Municipal Services Building located at 33 Arroyo Drive in South San Francisco.
Commissioners are appointed to continuous terms. However, upon the effective date of pending
Ordinance No. 1395-2008, Commissioners would be subject to prospective four (4) year terms. The
C0l11111ission encourages and pron10tes cultural arts activities within the community and acts as an
advisory body to the City Council on l11atters pertaining to the arts and cultural affairs.
The Historic Preservation Commission meets on the second Thursday of every month at 7:30 p.m. in
the Conference Room at City Hall located at 400 Grand Avenue in South San Francisco.
Commissioners are appointed to four (4) year ten11S. The Commission designates historic resources;
reviews applications for altering or del110lishing historic resources; disseminates information to the
public concerning structures, sites and areas deemed worthy of preservation; and considers and
recommends to the City Council methods for encouraging and achieving historical or architectural
preservation.
The Housing Authority l11eets on the second Monday of each l110nth at 6:00 p.m., at 350 C Street in
South San Francisco. Commissioners are appointed to four (4) year terms. Tenant Commissioners are
appointed to two (2) year terms and must be renting their living space in the property governed by the
Authority. The Authority approves the awarding of bids for any work to be done in the Authority (e.g.,
painting, tree trimming, and landscape maintenance), changes to all policies, lease agreements, and
contracts.

The San Mateo County Flood Control District ("SMCFCD") n1eets quarterly on the second Tuesday
of the last l110nth in the qumier at 3 :00 p.l11. at South San Francisco City Hall. Mel11bers are appointed to
a four (4) year tenl1. The SMCFCD oversees financing of flood control projects in San Mateo County.

AN ORDINANCE AMENDING TITLE 2 OF THE SOUTH SAN
FRANCISCO MUNICIPAL CODE REGARDING TERMS AND
TERM LlMITS FOR MEMBERS OF THE CITY'S BOARDS
AND COMMISSIONS
NOW THEREFORE, the City Council of the City of South San Francisco does hereby
ORDAIN as follows:
SECTION 1.
LIBRARY BOARD AMENDMENTS
The City Council hereby a111ends South San Francisco Municipal Code Section 2.52.040,
regarding ten11lin1its for the Library Board as follows:
2.52.040 Board of trustees-Limitation of terms-Vacancies.
Trustees shall be lil11ited to four consecutive terms. For purposes of calculating consecutive
terms, service of at least eighteen months plus one day during a telID shall be counted as a
complete tenl1; all prior continuous service of existing Trustees shall be counted. Upon serving
the l11aximul11 number of consecutive terms, a Trustee shall not be eligible for re-appointn1ent to
the Library Board of Trustees for a period of two years.

PLANNING COMMISSION AMENDMENTS
The City Council hereby an1ends South San Francisco Municipal Code Section 2.56.030,
regarding term limits for the Planning Commission as follows:
2.56.030 Limitation of terms-Vacancies.
Commissioners shall be lil11ited to three consecutive terms. For purposes of calculating
consecutive terms, service of at least two years plus one day during a tenl1 shall be counted as a
complete tenl1; all prior continuous service of existing COl11missioners shall be counted. Upon
serving the maximum number of consecutive terms, a Commissioner shall not be eligible for re-
appointment to the Planning Commission for a period of two years.
SECTION 3.
HISTORIC PRESERVATION COMMISSION AMENDMENTS
The City Council hereby amends South San Francisco Municipal Code Section 2.58.050,
regarding term limits for the Historic Preservation Commission as follows:

2.62.030 Limitation of terms-Vacancies.
Board n1el11bers shall be limited to three consecutive terms. For purposes of calculating
consecutive terms, service of at least two years plus one day during a tenn shall be counted as a
complete term; all prior continuous service of existing Board members shall be counted. Upon
serving the n1axill1ul11 nun1ber of consecutive terms, a Board l11ember shall not be eligible for re-
appointment to the Personnel Board for a period of two years.
SECTION 6.
PARKING PLACE COMMISSION
The City Council hereby amends South San Francisco Municipal Code Section 2.64.030,
regarding term limits for the Parking Place Comlnission as follows:
2.64.030 Limitation of terms-Vacancies.
Comll1issioners shall be limited to four consecutive terms. For purposes of calculating
consecutive terms, service of at least eighteen months plus one day during a term shall be
counted as a complete term; all prior continuous service of existing Commissioners shall be
counted. Upon serving the maximul11 number of consecutive terms, a COll1missioner shall not be
eligible for re-appointment to the Parking Place Commission for a period of two years.

SECTION 7.
CONFERENCE CENTER AUTHORITY AMENDMENTS
The City Council hereby an1ends South San Francisco Municipal Code Section 2.78.040,
regarding tern1S and tern1 lil11its for the Conference Center Authority as follows:
2.78.040 Term.
The tern1 of each lnen1ber of the cOl11n1ission shall be as follows:
(a) City Council l11embers shall serve two-year tenl1S. No Councihl1en1ber shall continue to
serve as a Councilmember/Con1111issioner after his/her tenn on the city council expires.
(b) All remaining Con11nissioners shall serve four-year staggered tenl1S. Initial appointn1ents
l11ay be n1ade for less than a full tell11 to assure that they are appropriately staggered.
Commissioners who are not City Councihl1el11bers shall be lil11ited to three consecutive terms.
For purposes of calculating consecutive tern1s, service of at least two years plus one day during a
tenl1 shall be counted as a complete term; all prior continuous service of existing Con1111issioners
shall be counted. Upon serving the l11aximul11 nun1ber of consecutive tell11s, a C0111missioner
shall not be eligible for re-appointn1ent to the Conference Center Authority for a period of two
years.
(c) The City Manager's position on the cOl11lnission shall be coterminous with his/her
employment with the city.
SECTION 8.
CULTURAL ARTS COMMISSION AMENDMENTS
The City Council hereby aIl1ends .South San Francisco Municipal Code Section 2.80.030,
regarding appointn1ent of the Cultural AIis Commission, aIl1ends section 2.80.040, regarding
tenl1S for the Cultural Arts COl11n1ission, adds section 2.80.045, regarding tell11 lil11its for the
Cultural Arts Commission, aIl1ends section 2.80.080 regarding compensation for the Cultural
Arts Commission, and deletes section 2.80.090, regarding removal of Cultural Arts Con1l11ission
men1bers, as follows:
2.80.030 Composition and appointment.
The Cultural Arts COl11mission shall consist of ten members until the voluntary resignation of
anyone l11ember, after which time the Cultural Arts COll1mission shall consist of up to nine
mel11bers. COll1mission members shall be appointed by a majority of the city council. All
l11embers shall, at their till1e of appointment and continuously through their incUll1bency, reside
within the city.
2.80.040 Term of members.
The term of each member of the Cultural Arts Commission shall be four years and until a
successor is appointed and qualified. Terms shall be staggered and shall expire in even-numbered
years.
2.80.045 Limitation of terms-Vacancies.

Con1mission n1en1bers shall be limited to three consecutive tell11S. For purposes of calculating
consecutive tenl1s, service of at least two years plus one day during a tenl1 shall be counted as a
cOl11plete tell11; except that tin1e served prior to the effective date of this section, June 13, 2008,
shall not be counted. Upon serving the l11axil11um nlul1ber of consecutive tenl1s, a Con1missioner
shall not be eligible for re-appointn1ent to the Cultural Arts Con1n1ission for a period of two
years.
2.80.080 Minutes of meetings and compensation.
Minutes of n1eetings of the Cultural Alis COll1n1ission shall be kept for all l11eetings and copies
thereof shall be delivered by the secretary of the con1n1ission to the City Clerk for filing and
distribution to l11el11bers of council within fifteen days of the COl11lnission's approval.
COl11111issioners shall receive for their services cOll1pensation in the an10unt of fifty dollars for
each regular l11eeting actually attended.
SECTION 9.
SEVERABILITY
In the event any section or portion of this ordinance shall be determined invalid or
unconstitutional, such section or portion shall be deen1ed severable and all other sections or
portions hereof shall ren1ain in full force and effect.
SECTION 10.
PUBLICATION AND EFFECTIVE DATE
Pursuant to the provisions of Government Code Section 36933, a SUl11111ary of this Ordinance
shall be prepared by the City Attorney. At least five (5) days prior to the Council meeting at
which this Ordinance is scheduled to be adopted, the City Clerk shall (1) publish the Sumn1ary,
and (2) post in the City Clerk's Office a certified copy of this Ordinance. Within fifteen (15) days
after the adoption of this Ordinance, the City Clerk shall (1) publish the sumn1ary, and (2) post in
the City Clerk's Office a certified copy of the full text of this Ordinance along with the nml1es of
those City Council mel11bers voting for and against this Ordinance or otherwise voting. This
ordinance shall become effective thirty days fr0111 and after its adoption.

The Historic Preservation Con1n1ission lTIeets on the second Thursday of every
month at 7:30 p.n1. in the Conference Roon1 at City Hall located at 400 Grand
Avenue in South San Francisco. COlTImissioners are appointed to four-year terms.
The Con1mission designates historic resources; reviews applications for altering or
demolishing historic resources; disselTIinates infonTIation to the public concerning
structures, sites and areas deen1ed worthy of preservation; and considers and
reCOlTIlTIends to the City Council methods for encouraging and achieving historical
or architectural preservation.
The Cultural Arts COlTIn1ission meets on the third Thursday of every month at 7:00
p.n1. in the Betty Weber Room of the Municipal Services Building located at 33
Arroyo Drive in South San Francisco. COlTImissioners are appointed to continuous
tenTIs. The COlTIlTIission encourages and promotes cultural arts activities within
the comn1unity and acts as an advisory body to the City Council OnlTIatters
peliaining to the arts and cultural affairs.
The Parks and Recreation Con1mission n1eets on the fourth Thursday of every
n10nth at 7:00 p.m. in the Municipal Services Building located at 33 AITOYO Drive
in South San Francisco. Commissioners are appointed to four-year terms. The
Con1mission advises the Council on matters pertaining to public recreation,
including parks and playgrounds. The COlTImission also assists in the planning of
a cOlTIplete recreation progran1 and in the planning of a department budget.
The San Mateo County Flood Control District ("SMCFCD") n1eets quarterly on
the second Tuesday of the last lTIonth in the quarter at 3 :00 p.lTI. at South San
Francisco City Hall. Members are appointed to a four-year term. The SMCFCD
oversees fil1ancing of flood control projects in San Mateo County.

REQUIREMENTS
To be considered for appointlnent, persons must be registered to vote in the City
of South San Francisco. Applicants should also be n10tivated to serve the public
and have sufficient tin1e available to devote to day or evening lneetings and the
requisite preparation.
Sublnission of an application pursuant to the process set forth below and
appearance before the City Coul1cil for a public interview at a Special Meeting on
Wednesday, May 21, 2008 beginning at 6:30 p.ln. are also required.
