RESOLUTION NO. 73-2008
CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION AWARDING THE SOUTH AIRPORT
BOULEVARD BRIDGE APPROACH PAVEMENT REPAIR
PROJECT NO. 51-13231-0704 TO URETEK USA. INC.
WHEREAS, staff recolnlnends that the City Council award the contract for the South
Airport Boulevard Bridge approach pavenlent repair to the sole bidder, Uretek USA, Inc., in the
aInount not to exceed $60,516; and
WHEREAS, the South Airport Boulevard Bridge approach has settled nun1erous tin1es
over the last eight or nine years requiring the Public Works asphalt crew to installlnultiple layers
of asphalt to Inaintain suitable driving conditions; and
WHEREAS, California Public Contract Code Section 3400(b) pel1nits general law cities
to suspend cOInpetitive bidding and to n1ake sole source purchases of products or equipInent in
order to n1atch other products in use on a particular iInprovement either cOInpleted or in the
course of completion or to obtain a necessary iteln that is only available fron1 one source; and
WHEREAS, the repair of said bridge involves injecting high density lightweight
polyurethane foan1 deep under the paveInent to stabilIze the soil; and
WHEREAS, Uretek USA, Inc. holds the U. S. Patent on this product and service,
therefore n1aking then1 a sole source vendor for this work; and
WHEREAS, after thoroughly reviewing and studYing the Inaterials available froln
conlpanies that specialize in high density lightweight polyurethane fomn for repair of pavement,
staff has determined that only one product Ineets the City's needs and COnCe111S with respect to
durability, heal~h and safety and available wananties; and
WHEREAS, after thoroughly reviewing and studying the available data, Public Works
Depmin1ent has detel1nined that the purchase of the product patented by Uretrek USA, Inc. is
crucial for maintenance and repair of the South Airport Boulevard Bridge Approach; and
WHEREAS, this project is included in the City of South San Francisco's Fiscal Year 2008-
2009 Capital Improvement Program in the amount of $62,000.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San
Francisco that the City Council hereby finds that all of the recitals set forth above are true and
conect to the best of its knowledge, and based on said finding, detel1nines that the City Manager
is authorized to execute a contract for the South Airport Boulevard Bridge approach paveInent
project to Uretek USA, Inc., in an amount not to exceed $60,516 in accordance with the Public
Contract Code Section 3400 exception for con1ponents available frOIn a sole source.

the City Council of the City of South San Francisco at a regular nleeting held on the 9th day
of July 2008 by the following vote:
