HomeMy WebLinkAboutReso 19-2001RESOLUTION NO. 19-2001 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION MAKING DETERMINATION OF PROPERTY TAX EXCHANGE PURSUANT TO PROVISIONS OF CHAPTER 282, SECTION 59, PART .05, IMPLEMENTATION OF ARTICLE XIIIA OF THE CALIFORNIA CONSTITUTION COMMENCING WITH SECTION 95, DIVISION 1, OF THE REVENUE AND TAXATION CODE WHEREAS, state law requires that the City of Brisbane and the City of South San Francisco negotiate a property tax exchange relating to the proposed reorganization involving detachment of property from the City of Brisbane and annexation to the City of South San Francisco; and WHEREAS, the Cities have agreed there is no exchange of property tax because the property is not assessed; and WHEREAS, the subject determination has been made prior to and as a condition precedent to the Executive Officer of the Local Agency Formation Commission issuing the Certificate of Filing on said proposal; and WHEREAS, it has been agreed that not property tax revenue will be transferred from the City of Brisbane to the City of South San Francisco. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco does hereby determine and order as follows: 1. No property tax shall be transferred from the City of Brisbane to the City of South San Francisco and, in accordance with Section 3a f Article XIIIB of the State Constitution, the appropriation limit of the City of South San Francisco shall not be increased based on this agreement. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a Regular meeting held on the 14th day of March ,2001 bythe following vote: AYES: Councilmembers Pedro Gonzalez, Karvl Matsumoto and John R. Penna, Mayor Pro Tem Eugene Mullin and Mayor Joseph A. Fernekes NOES: None. ABSTAIN: None. ABSENT: None. ATTEST: City Clerk
