HomeMy WebLinkAboutReso 89-2000RESOLUTION NO. 89-00 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION APPROVING AN AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT BETWEEN CITY OF SOUTH SAN FRANCISCO AND MEYERS, NAVE, RIBACK, SILVER AND WILSON AND APPROVING A LITIGATION BUDGET FOR CONDEMNATION OF 201 GRAND WHEREAS, the City and Meyers-Nave entered into a professional services agreement in March 1994; and WHEREAS, the parties desire to amend said agreement to modify the compensation provided to Meyers-Nave consistent with the recently approved budget; and WHEREAS, the Redevelopment Agency recently approved a Resolution of Necessity to acquire the property at 201 Grand. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of South San Francisco that the City Council: Approves an Amendment to the Professional Services Agreement as set forth in Exhibit A hereto; Authorizes the City Manager to sign said agreement; Approves an amendment to the 2000-2001 Operating Budget (No. 01-3) to add $70,000 to the City Attorney's budget for litigation and expert witness expenses for the acquisition of 201 Grand Avenue with funding from the Downtown Central Redevelopment fund. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 12 day of July , 2000 by the following vote: AYES: Councilmembers Pedro Gonzalez, Eugene R. Mullin, and John r. Penna, Mayor Pro Tem Joseph A. Fernekes and Mayor Karyl Matsumoto NOES: None ABSTAIN: None. ABSENT: None. ATTEST: eputy City Clerk EXHIBIT A AMENDMENT NO. 6 TO THE PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF SOUTH SAN FRANCISCO AND MEYERS, NAVE, RIBACK, SILVER AND WILSON The City of South San Francisco and Meyers-Nave do hereby agree as follows: 1. Section 4 "Compensation - Basic Services" is hereby amended to read as follows: "City shall compensate Law Firm for all Basic Services described in Section 1 hereof Thirty Thousand Dollars ($30,000) per month effective July 1, 2000. In addition to Basic Services compensation, Law Firm shall also be paid for cost recovery matters involving major developments at the rate of $170 per hour for shareholders and $150 per hour for associates with the City's costs reimbursed by the development applicant. For purposes of this section a "major development" is one where more than 20 residential units are proposed or where more than 10,000 square feet of commercial, retail or industrial development is proposed. In addition to the Basic Services compensation, Law Finn shall also be reimbursed up to $24,341 on an annual basis for secretarial services provided in the South San Francisco City Attorney's office and for photocopy costs incurred at the Law Firm' s San Leandro office. City shall also reimburse Law Firm for the actual costs paid by Law Firm for messenger services and document requests. 2. The first sentence of Section 5 "Compensation - Special Services" is hereby amended to read as follows: "City shall compensate Law Firm for special services described in section 2 hereof and which are authorized by action of the City Council on an hourly basis at the rate of $185 dollars per hour for shareholders, $160 dollars per hour for associates and $85 dollars per hour for paralegals." Except as expressly provided herein, all other terms and conditions of the Professional Services Agreement between the City and Meyers-Nave shall remain in full force and effect for the term of this Agreement.
