HomeMy WebLinkAboutReso 111-2000RESOLUTION NO. 111-2000 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION APPROVING A REVISION TO THE PRECISE PLAN (PP-99-005 (MOD 1)) TO ALLOW DESIGN CHANGES TO THE APPROVED FULL-SERVICE HOTEL ON A VACANT SITE LOCATED IN THE OYSTER POINT MARINA PARK IN THE EAST OF 101 AREA. WHEREAS, Corporex Oyster Point, L.L.C. has submitted a request to the City of South San Francisco for approval of a revision to the Precise Plan to allow design changes to the approved full- service hotel in the Oyster Point Marina Specific Plan District. WHEREAS, the City Council of the City of South San Francisco held a duly noticed public hearing on September 27, 2000; and WHEREAS, the City Council of the City of South San Francisco reviewed the Addendum to the approved Mitigated Negative Declaration MND-99-005 in Exhibit B, held during the public hearing on September 27, 2000; and NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of South San Francisco, as required by the Oyster Point Marina Specific Plan District (SSFMC Chapter 20.59.020 (f) and 20.59.080), has determined that the following findings are made in support of the request for approval of a revision to the Precise Plan to allow design changes to the approved full-service hotel located on a vacant lot at the west end of the Oyster Point Marina Specific Plan District, based on all evidbnce, materials and testimony in the record which include, but are not limited to, the site plan and elevation drawings prepared by Corporex Oyster Point LLC, Inc. and the minutes of the Design Review Board meeting held on July 18, 2000: 1) The proposed use will not be adverse to the public health, safety, or general welfare of the community, nor unreasonably detrimental to surrounding properties and improvements. Because all such impacts and potential impacts have been mitigated by project design, project location or Conditions of Approval. 2) The proposed revisions to the design of the hotel is consistent with the development and construction standards of the Oyster Point Marina Specific Plan District since the project will maintain a high-quality design and use high quality materials in the construction. 3) The proposed revisions to the design of the hotel is consistent with the joint powers agreement since the hotel use is consistent with the land use and development objectives of the joint powers agreement. 4) The proposed revisions to the design of the hotel, as designed and conditioned, is consistent with General Plan and the Design Element in the East of 101 Area Plan since the project will maintain a high-quality design and use high quality materials. 5) The original full service hotel received approval by the Harbor District Board and the use has not changed. 6) The Addendum to the adopted Mitigated Negative Declaration MND-99-005 has been prepared, in accordance with the provisions of CEQA, since only minor technical changes or additions are necessary and none of the conditions described in CEQA, Section 15162 calling for the preparation of a subsequent negative declaration have occurred. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City of South San Francisco City Council: 1) Approve the revision to Precise Plan, PP-99-005 (MOD 1) to allow design changes to the full-service hotel located at the west end of the Oyster Point Marina Specific Plan District in the East of 101 Area subject to the Conditions of Approval in Exhibit A. I hereby certify that the foregoing resolution was adopted by the City Council of the City of South San Francisco at the regular meeting held on the 27th day of September, 2000 by the following vote: AYES: Councilmembers Pedro Gonzalez, Eugene R. Mullin and John R. Penna, Mayor Pro Tem Joseph A. Fernekes and Mayor Karyl Matsumoto NOES: None. ABSTAIN: None. ABSENT: None. ATTEST: City Clerk Exhibit A PROPOSED CONDITIONS OF APPROVAL Precise Plan: PP-99-005 (MOD 1) (September 27, 2000) Planning Division requirements shall be as follows: The project shall comply with all conditions outlined in the Conditions of Approval for Precise Plan: PP-99-005, approved by the City Council on April 28, 1999. The project shall be constructed substantially as indicated on the site plan and elevation drawings presented to the City Council on September 17, 2000 by Corporex Oyster Point, LLC., Inc., except as otherwise modified by the City Council during the public hearing. The applicant shall submit shall provide a materials and color scheme for the entire facility that is subject to the approval of the Chief Planner. Building materials and colors shall be indicated on the plans submitted for building permit and color and material samples shall be submitted for review and approval by the Chief Planner prior to issuance of a building permit.. Pursuant to General Plan Pohcy 2-1-12, prior to issuance ora Certificate of Occupancy the applicant shall pay a fair share amount for a community childcare facility in South San Francisco, the amount to be determined pursuant to the Study prepa~ed by South San Francisco to establish a childcare fee payable by development applicants'.
