HomeMy WebLinkAboutReso 109-2008RESOLUTION NO. 109-2008 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH ROTARY PLAZA TO TR~~NSFER OWNERSHIP AND RELOCATE THE DUPLEX CURRENTLY LOCATED AT 323 MILLER AVENUE IN THE D-C DOWNTOWN COMMERCIAL ZONE DISTRICT TO THE ROTARY PLAZA SITE AT 433 ALIDA WAY. WHEREAS, on May 14, 2008, the City Council approved Planning Application 07-0137 to allow the Miller Avenue Parking Garage to be constructed a.t ~~23 Miller Ave; and WHEREAS, the existing duplex located at 323 Miller Ave, in the D-C Downtown Commercial Zoning District, is considered by the City of South San Francisco as a Potentially Historic Resource; and WHEREAS, Mitigation Measure 2 of the Mitigated ZJegative Declaration for the Miller Avenue Garage project requires preparation and implementation of a Preservation Plan that will require either relocation of the duplex or salvage and re-us~~ of the historical materials in the structure. This Mitigation Measure ensures that the historical character of the structure will not be lost; and WHEREAS, in June 2008 the City advertised the availability of the duplex relocation to the general public, with the understanding that the City would cover basic relocation costs and provide a basic foundation; and WHEREAS, City staff received two viable applicati~~ns, of which only the application received from Rotary Plaza, Inc. proposed relocation within the city limits; and WHEREAS, Rotary Plaza, Inc. submitted a request to relocate the duplex to a large landscaped area on the southeast corner of its site at 433 Alid~i Way, with the intent to convert the duplex to a single dwelling to house the resident manager, which would free up the manager's current apartment for another senior household; and WHEREAS, the existing Rotary Plaza senior residential use was originally approved in 1970 (Use Permit - 101), at which time the use complied with all applicable development standards. WHEREAS, due to subsequent zoning ordinance and €;eneral plan amendmen~s, the use no longer complies with two current development regulations, pertaining to density and parking. 1. Density. The current density of the Rotary Plaza development is 53.55 units/acre. General Plan Implementing Policy 2-I-18 states that "`Sc;nior Citizen housing prof ects may be allowed to be constructed to a maximum density of 50 units/acre and off-street parking may be provided at a ratio lower that that which is otherv~rise required." 2. Parking. The original project was approved with 65 parking spaces for the 181 residential units. Under current regulations, a Senior Citizen Residential use would have a parking requirement in the range of 0.5-1.25 spaces per unit as determined by the Planning Commission, resulting in a requirement of 91 - 226 parking spaces. WHEREAS, the relocation of the duplex to this site ,will increase the density of the site by approximately one-half of one percent (0.5%) to 53.85 units pE;r acre; and WHEREAS, City staff performed a parking survey at a range of times and days to determine current parking intensity at the site. Of the 65 existing spaces, a minimum. of 13 spaces and a maximum of 32 spaces were available for parking; and WHEREAS, in October 2008 Rotary Plaza, Inc. ("App icant"), applied to the City to allow the relocation of the duplex at 323 Miller Avenue to the Rotar~~ Plaza site at 433 Alida Way, in the R-3-L Multi-Family Residential Zoning District; and WHEREAS, the City Council finds that the proposed project is categorically exempt from review under the California Environmental Quality Act (CE(ZA), pursuant to CEQA Guidelines Section 15301 Class 1 Existing Facilities, Section 15303 New (:onstruction or Conversion of Small Structures and Section 15332 In-fill Development Projects; and WHEREAS, on November 12, 2008, the City Council conducted a properly noticed public hearing on the proposed agreement with Rotary Plaza to transfE;r ownership and relocate the duplex currently located at 323 Miller Avenue. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City ~f South San Francisco adopts the following findings based on the entire rE;cord, including without limitation, the Applicant's plans submitted on October 30, 2008, the South San Francisco General Plan, the City Council Staff Report dated November 12, 2008, and the testimony and materials submitted at the City Council meeting on November 12, 2008: A. The proposed duplex relocation area on the 3.38 acre Rotary Plaza site is suitable for the existing building. In contrast to other propo;~ed locations, relocating the potential historic building to the Rotary Plaza site would allow the building to remain as a residential use and be located within an area where it is aesthetically compatible with the appearance of the residential uses in the immediate vicinity to the west of the project site, which is zoned Rural Estate District and located in unincorporated San Mateo County. The relocated building will also be tied in with the existing walkways and landscaping of the Rotary Plaza development; and B. The relocation of the duplex would create an additional senior residential unit in the existing Rotary Plaza development, in keeping with General Plan policies that encourage the development of housing for the elderly, as specifically stated in the Housing Element Special Needs section: Special Needs Policy 3-1 -The City shall continue to give special attention in housing programs to the needs of special €;roups, including the disabled, large families, the elderly, and families with low incomes. Special Needs Policy 3-2 -The City shall en~:,ourage the development of housing for elderly. C. The relocation of the duplex will further important public interests, including presentation of a potentially significant historic resource and provision of additional senior housing. While relocation will result iri a one-half of one percent (0.5%) increase in the density of the site, in light of the important public interests served, and the de minimis nature of the increase, the City Council finds this to be an acceptable expansion of the existing non-conforming densil:y, and therefore compatible with the objectives and policies of the South San Francisco General Plan and zoning ordinance, and is an appropriate continuation of a legal nonconforming use of .. residential use. D. The relocation of the duplex will preserve a building that has been deemed a "Potentially Historic Resource" by the City. E. The relocation of the duplex will not be adverse 'to the public health, safety or general welfare of the community, or unreasonably detrimental to surrounding properties or improvements. NOW, THEREFORE, BE IT FURTHER RESOLVED that based on the findings above the City Council of the City of South San Francisco finds that this relocation is an appropriate continuation of a legal nonconforming use and hereby authorizes the City Manager to enter into an agreement with Rotary Plaza, Inc. to transfer ownership and relocate the duplex currently located at 323 Miller Ave to the Rotary Plaza site at 433 Alida Way. * * * ~ I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 12th day of November, 200$ by the following vote: AYES: Councilmembers Mark N.
