HomeMy WebLinkAboutReso 124-2000 RESOLUTION NO. 124-2000 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA RESOLUTION APPROVING PROPERTY AGREEMENT AND SIGN RELOCATION AGREEMENT BETWEEN MYERS PENINSULA COMPANY, ELLER MEDIA AND SOUTH SAN FRANCISCO REGARDING THE ACQUISITION OF RIGHT OF WAY, CONVEYANCE OF PROPERTY AND REMOVAL OF SIGNS IN CONNECTION WITH OYSTER POINT INTERCHANGE/HOOK RAMP PROJECT PHASE III WHEREAS, CITY and MYERS have agreed to exchange certain property interests to facilitate construction of the Oyster Point Interchange/Hook Ramp Project Phase III, including certain adjacent roadway and utility improvements; and WHEREAS, in order to facilitate the construction of the necessary improvements, MYERS is willing to grant to CITY a temporary construction easement; a temporary construction trailer easement; a temporary utility easement and fee title to right of way required to widen Bayshore Boulevard to accommodate construction of the Hook Ramps; and WHEREAS, CITY owns a portion of the Terrabay Development site that is no longer required for completion of Phase II and Phase III and is willing to convey the property in fee to MYERS; and WHEREAS, there is currently located within the proposed Bayshore right of way four signs owned and maintained by Eller Media Company; and WHEREAS, to facilitate the acquisition of the right of way required to widen Bayshore Blvd., Eller and the City have prepared a Sign Relocation Agreement that requires the removal of all four structures located in the proposed right of way; and WHEREAS, in consideration for removing the signs, the City is willing to allow Eller to add two sign faces to existing structures and to modify the structures to accommodate the new faces; and WHEREAS, the City finds that removing four sign structures from the Bayshore Blvd. area and adding second faces to existing structures enhances the visual character of the area by reducing the number of square footage available for advertising displays; and WHEREAS, the Sign Relocation Agreement provides that Eller will obtain all necessary permits for the construction and removal of the signs at no cost to the City; and WHEREAS, approval of the Property Agreement and Sign Relocation Agreement will allow the City to proceed with construction of the Oyster Point Flyover/Hook Ramp Project Phase II and Phase III without unreasonably delaying the Project; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that the City Council hereby authorizes the execution of a Property Agreement and Sign Relocation Agreement between the City of South San Francisco, Myers Peninsula Company and Eller Media and authorizes the City Manager to execute the certificates of acceptance. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a Regular meeting held on the 1 lth day of October ,2000 by the following vote: AYES: NOES: Councilmembers Pedro Gonzalez, Eugene R. Mullin and John R. Penna, Mayor Pro Tem Joseph A. Fernekes and Mayor Karvl Matsumoto None. ABSTAIN: None. ABSENT: None.
