HomeMy WebLinkAboutReso 10-2009RESOLUTION NO. 10-2009 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION CONSENTING TO THE WITHDRAWAL OF A MISTAKEN BID BY INTERSTATE GRADING & PAVING, INC., AND REJECTING ALL BASE AND ALTERNATE BIDS FOR THE HILLSIDE BOULEVARD AND FORBES BOULEVARD DIG-OUTS PROJECT WHEREAS, on November 24, 2008 and December 1, 2008, staff advertised the notice to invite sealed bids for the project; and WHEREAS, on December 17, 2008, ten bids were received and Interstate Grading and Paving Inc. ("Interstate") was the lowest responsible bidder for the amount of $113,153.50; and WHEREAS, on December 22, 2008, staff received a letter from Interstate requesting that its bid be rejected as it contained mathematical and clerical errors; and WHEREAS, the City Council finds that Interstate's bid contained clerical errors, and consents to withdrawal of the bid; WHEREAS, pursuant to Public Contract Code Section 20166, a public entity retains the discretion to reject all bids it receives on a given project; and WHEREAS, staff recommends re-advertising for bids as one combined bid package; and WHEREAS, funding for the project is included in the City of South San Francisco's 2008-2009 CIP and sufficient funds have been allocated. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of South San Francisco that the City Council hereby: 1. Consents to the withdrawal of Interstate Grading and Pa~~ing, Ines bid on the grounds of mistake. 2. Rejects all bids for the Hillside Boulevard and Forbes Boulevard Dig-outs Project and directs staff to re-advertise for bids. * * ~ ~ I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 28th day of January, 2009 by the following vote: AYES: Councilmembers Pedro Gonzalez, Richard A.
