CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
RESOLUTION AUTHORIZING AN INCREASE IN THE
PENALTY FOR PARKING VIOLATIONS WITHIN THE CITY
OF SOUTH SAN FRANCISCO TO INCORPORATE COURT
CONSTRUCTION FEES INCREASED BY SENATE BILL 1407
WHEREAS, parking violation fines are considered a civil penalty and may be set by the
governing body of a local jurisdiction pursuant to California Vehicle Code section 40200 et seq.;
and
WHEREAS, SB 1407, effective January 1, 2009, amended Government Code Section
70372(b) to increase the amount the State can withhold from the City for each parking citation
acid to provide that the City must pay $4.50 per citation to the County Treasurer for State court
construction projects; and
WHEREAS, pursuant to Government Code 76100 and a resolution adopted by the Board
of Supervisors of the County of San Mateo ("County"), the County withholds an additional $L50
from each local parking citation fee for debt service for the local courthouse construction fund,
bringing the total withheld amount from each local parking citation fee for local and State court
construction to $6.00; and
WHEREAS, under California Vehicle Code section 40203.5, to the extent possible,
issuing agencies within a county must standardize penalties; and
WHEREAS, South San Francisco's parking violation fines currently fall within the mid-
point of the range of fine schedules adopted by neighboring cities in San Mateo County; and
WHEREAS, this fine schedule increase will help the City maintain and/or increase its
revenue stream by recouping redirected funds, meeting its rising expenses and keeping the rates
more consistent with that of nearby cities.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San
Francisco that the City Council hereby:
1. Authorizes an increase in the penalty for parking violations as defined in
11.56.040 of the South San Francisco Municipal Code as follows:(a) fines for
parking violations that are currently under $30 will be increased to $35; (b) fines
for parking violations that are currently $30 and above will be increased by
$10.00; and (c) fines for parking in a red zone will be increased from $25 to $40.
2. Modifies the Master Fee Schedule to reflect the increased parking violation fines
specified in the staff report.
I hereby certify that the foregoing Resolution was regularly introduced and adopted by
the City Council of the City of South San Francisco at a regular meeting held on the 11th day of
March, 2009 by the following vote:
AYES: Councilmembers Pedro Gonzalez, Richard A. Garbarino, and Kevin Mullin,
Vice Mayor Mark Addieg_o and Mayor Karma Matsumoto
