A RESOLUTIONS APPROVING THE NUISANCE
ABATEMENT COST REPORT AND CERTIFYING SPECIAL
ASSESSMENTS FOR COLLECTION OF DELINQUENT
ABATEMENT COST'S AMOUNTING TO $8,430.35 AGAINST
109 ARROYO DRIVE, SOUTH SAN FRANCISCO, APN 010-
397-020
WHEREAS, 109 Arroyo Drive in South San Francisco, California, APN 010-397-020
("Premises") has been the subject of Code Enforcement action since October 29, 2007 following
multiple complaints from neighbors and notice from San Mateo County Mosquito Abatement of
mosquito abatement issues on the Premises;
WHEREAS, Code Enforcement staff has conducted several inspections both from the
street and on the property pursuant to a warrant and identified multiple public nuisance
conditions, including accumulated hitter, debris, and dead and dying trees and overgrown weeds
and vegetation, all of which are unsiightly, hazardous to utility service and emergency personnel,
likely to harbor rats and other vermin, and detrimental to neighboring property or property
values;
WHEREAS, staff multiple letters and notices explaining advised actions between July of
2008 and April of 2009 to property owner Raquel Brown ("Owner") requesting code compliance
on the Premises;
WHEREAS, staff granted tree Owner an extension for the abatement of the Premises on
October 17, 2008, and the Owner• did not repair, rehabilitate, or abate nuisance conditions
identified by the City by the extended compliance date; and
WHEREAS, on October 21, 2008, staff mailed the Owner a Notice to Abate, and
WHEREAS, a noticed administrative hearing was held on December 8, 2008, pursuant to
South San Francisco Municipal Cocle ("SSFMC") Section 8.54.115 to ascertain whether a public
nuisance existed at the Premises acid whether there was sufficient cause to rehabilitate, above,
remove, or repair the same, but tree Owner neither appeared nor provided the City with any
response; and
WHEREAS, the overall condition on the Premises continued to deteriorate and code
violations continued to increase; anti
WHEREAS, on February 17, 2009, a dead seventy foot pine tree on the Premises lost
several large branches in a storm; and
WHEREAS, staff abated the dead pine tree on February 24, 2009, due to pending storms
and the extreme hazard the condition of the tree posed; and
WHEREAS, pursuant to an abatement warrant issued by the San Mateo County Superior
Court, staff and contractors abated nuisance conditions described heretofore on other portions of
the Premises on April 14, 2009; and
WHEREAS, in pursuing compliance and abating the nuisance condition and conducting
the activities described in the staff report relating to this matter, the City incurred costs related to
identifying, documenting and abating the nuisance conditions at the Premises; and
WHEREAS, the City is entitled to recover its costs of nuisance abatement pursuant to
and in accordance with state law and SSFMC Chapter 8.54; and
WHEREAS, the nuisance abatement activities undertaken by the City and as described
herein were carried out to protect the health, safety and welfare of the community; and
WHEREAS, the City gave due and proper notice of the costs of abatement activities and
advised the Owner of the Premises, of her right to object to said costs, and of the City's intention
to recover costs by special assessment pursuant to Government Code Section 38773.5; and
WHEREAS, an additional noticed administrative hearing was held on May 5, 2009,
providing the Owner with an opportunity to contest the total abatement costs, as reflected on the
Cost Report attached as Exhibit A, and the Owner failed to appear;
NOW, THEREFORE, BE IT RESOLVED, the South San Francisco City Council hereby:
1. Finds that Raquel Brown had proper notice of both public hearings, which were provided
in accordance with applicable laws.
2. Approves the Cost Report attached as Exhibit A and finds that it truly and accurately
reflects actual costs incurred by the City in abating the nuisance conditions existing at the
Premises.
3. Finds that the costs incurred by the City in this matter are reasonable and were necessary
for the health, safety and welfare of the community.
4. Orders that the delinquent abatement costs attached as Exhibit A, and amounting to
$8,430.35, be collected as special assessments against the respective property located at 109
Arroyo Drive, South San Francisco, CA, APN 010-397-020.
5. Directs staff to record a copy of this Resolution in the Office of the County Recorder of
the County of San Mateo, and the amounts chargeable to each parcel of land as indicated in the
Exhibit A shall constitute special assessments against the respective parcels in accordance with
California Government Code Section 38773.5 and South San Francisco Municipal Code Section
8.54.305.
6. Directs staff to deliver a copy of this Resolution to the San Mateo County Controller's
office before August 1, 2009, to secure payment of abatement costs by special assessment and
collection on the County's property tax roll pursuant to Government Code § 38773.5(c).
