CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION MAKING FINDINGS AND ADOPTING THE
MITIGATED NEGATIVE DECLARATION (ND08-0002) FOR
THE SOUTH: SAN FRANCISCO GENERAL PLAN HOUSING
ELEMENT UPDATE (P08-00271)
WHEREAS, Government Code Section 65580 of the State Planning and Zoning Law
requires every city to adopt a housing element; and
WHEREAS, in accordance with Section 65583 of the California Government Code,
"Housing element content," the City of South San Francisco has prepared a General Plan
Housing Element Update, which provides detailed background information, an assessment of
housing needs, an analysis of adequate sites, resources, and constraints for residential
development, an analysis of special needs housing, an analysis of housing for the homeless, and
the description of goals and policies for the creation of new residential development and the
preservation of the existing housing stock; and
WHEREAS, the South San Francisco General Plan Housing Element Update policies are
internally consistent with the policies contained in each of the South San Francisco General Plan
elements; and
WHEREAS, the City presented the Housing Element Update to the Airport Land Use
Committee / C/CAG and, in accordance with their feedback, is recommending the following
policy be added to the Housing Element Update to further ensure that the project will not result
in a safety hazard or noise problem for persons using the airport or residing or working in the
project area: Program 4-4A -Ensure that applications for new residential land use proposed
within the 65 to 69 CNEL aircraft noise contour include an acoustical study, prepared by a
professional acoustic engineer, that specifies the appropriate noise mitigation features to be
included in the design and construction of the new units, to achieve an interior noise level of not
more than 45 dB, based on measured aircraft noise events at the land use location; and
WHEREAS, in accordance with the California Environmental Quality Act, Public
Resources Code, sections 21000, et seq. (CEQA), the City prepared the attached Initial
Study/Mitigated Negative Declaration and distributed the document to the State Clearinghouse,
appropriate responsible agencies and interested parties on May 15, 2009 fora 30-day public
review period; and,
WHEREAS, the Planning Commission held a properly noticed public hearing on June 18,
2009, to consider and evaluate the Mitigated Negative Declaration and General Plan Housing
Element Update, and recommended, by resolution, that the City Council adopt both the
Mitigated Negative Declaration and General Plan Housing Element Update;
WHEREAS, the Planning Commission requested that the opportunity sites be
renumbered in the Mitigated Negative Declaration to be consistent with the correct site
numbering in the Housing Element; and,
WHEREAS, the City Council held a properly noticed public hearing on June 24, 2009, to
consider and evaluate the Mitigated Negative Declaration and General Plan Housing Element
Update; and,
WHEREAS, the custodian of the record is the City's Chief Planner, and the Initial
Study/Mitigated Negative Declaration, Mitigation Monitoring and Reporting Program, and the
General Plan Housing Element Update, as well as other materials comprising the record for these
proceedings, are available and may be reviewed at the offices of the South San Francisco
Planning Division, City Hall Annex, 315 Maple Avenue, South San Francisco, 94080.
NOW, THEREFORE BE IT RESOLVED that based on the entirety of the record, which
includes without limitation, the South San Francisco General Plan and General Plan EIR; the
South San Francisco General Plan Housing Element Update, Initial Study/Negative Declaration
and Mitigation Monitoring and Reporting Program; all comments and testimony received at
stakeholders interviews and public workshops; all reports, testimony, and transcripts for the May
30, 2009, Airport Land Use Commission hearing; all reports, testimony, and transcripts prepared
for the May 18, 2009, Planning Commission meeting; all reports, testimony, and transcripts
prepared for the June 18, 2009, Planning Commission meeting; and all reports, testimony, and
transcripts prepared for the June 24, 2009, City Council meeting, the City Council of the City of
South San Francisco hereby finds as follows:
1. The foregoing Recitals are true and correct, and incorporated herein by reference.
2. The City Council has considered the Initial Study/Mitigated Negative Declaration for the
South San Francisco General Plan. Housing Element Update, attached to this Resolution as
Exhibit A and incorporated herein by reference, as well as all comments received on the Initial
Study/Mitigated Negative Declaration.
3. The attached Initial Study/Mitigated Negative Declaration reflects the City Council's
independent judgment and analysis.
4. There is no substantial evidence that the project will have a significant effect on the
environment.
BE IT FURTHER RESOLVED that the City Council of the City of South San Francisco
hereby adopts the Initial Study/Mitigated Negative Declaration, including the Mitigation
Monitoring and Reporting Program, for the South San Francisco General Plan Housing Element
Update.
