CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION APPROVING A MODIFICATION TO USE PERMIT 88.
842/MOD 3 IMPOSING ADDITIONAL CONDITIONS ON
ENTERTAINMENT USES AT THE SHANGRI-LA RESTAURANT
WHEREAS, the Planning Commission approved Use Permit Modification 88-842/MOD 3 on
March 19, 1998 allowing entertainment at the Shangri-La Restaurant, situated at 3963 Callan Boulevard,
South San Francisco; and
WHEREAS, Use Permit Modification 88-842/MOD 3 required that the security personnel meet
the requirements set forth in the South San Francisco Municipal Code Title 6 (Business Regulations); and
WHEREAS, staff recommended that the Planning Commission modify Use Permit 88-842/MOD 3
due to violations of the conditions; and
WHEREAS, on September 17, 1998, the Planning Commission conducted a duly noticed
evidentiary hearing on the recommended modification at which time any person interested in the matter
was given a full opportunity to be heard and to present evidence; and
WHEREAS, the Planning Commission reviewed and considered the staff report and all written and
oral evidence presented to the Planning Com~nission in support of and in opposition to staff's
recommendation to modify Use Permit Modification 88-842/MOD 3; and
WHEREAS, the Planning Commission determined that the restaurant operator violated the
conditions of approval of Use Permit Modification 88-842/MOD 3 regarding entertainment and requiring
that security personnel meet the requirements set forth in Municipal Code Title 6 (Business Regulations) as
follows:
(a)
On at least three separate occasions entertainment events were conducted at the Shangri-La
Restaurant and hosted by radio station KMEL, a violation of condition of approval 3 (b);
and
(b)
On at least two occasions when the facility was utilized for dancing, the permit holder failed
to have properly registered security guards, a violation of condition of approval 3 (b).
WHEREAS, the Planning Commission adopted Resolution 2528 which recommended that the
City Council modify the Use Permit 88-842/MOD 3 to add additional conditions of approval; and
WHEREAS, the City Council held a duly noticed public hearing to consider the proposed
modifications;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco
that it hereby makes the following findings:
(a)
approval:
That the Use Permit 88-842/MOD 3 shall be modified to add the following conditions of
(1) The South San Francisco Police Department shall be notified of every
entertainment event that is scheduled for the facility a minimum of thirty (30) calendar days
in advance of the planned event. The applicant shall submit to the Police Chief of the
South San Francisco Police Department form SSFPD-SD-02-954 for each entertainment
event. All entertainment events shall be subject to the review and approval by the City's
Police Chief.
(2) The Use Permit as modified shall be subject to review by the Planning Commission
for compliance with all of its terms and conditions. The review shall occur on or about
April 15, 1999, approximately slx months from the date of adoption of this resolution.
I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City
Council of the City of South San Francisco at asDee, meeting held on the 10tt'tlay of November,
1998 by the following vote:
AYES: Councilmembers James L. Datzman,
Karyl Matsumoto and Mayor Eugene
