HomeMy WebLinkAboutReso 66-1999 DraftDRAFT v. so tmo CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO, ' STATE OF CALIFORNIA . ~. t 470~ DEVELOPMENT ~REAS, the existing Terrabay Specific Plan, Chapter 20.63 of the Municipal Code and the Terrabay Development Agreement allow development of the Terrabay project (together the "existing entitlements"), subject to certain further approvals and entitlements; and WHEREAS, the Terrabay project is divided into three separated phases, the first of which, Phase I, is currently under construction and nearing completion; and WHEREAS, the existing entitlements provide for development of 432 units of single family dwelling and condominiums, an 18,000 sq ft health club, a 400 room hotel, 268,800 technology center, three restaurants and a 57,500 square foot condominium office building; and WHE~S, in July 1997 the owner of Phase H and ffl, SunChase G.A. Inc. ("Apphcant"), applied to the City to modify the Terrabay Specific Plan, amend the Chapter 20.63 of the Municipal Code to modify the Phase H development and approve a vesting tentative map and a precise plan for Phase H (the "proposed entitlements"); and WHEREAS, the proposed entitlements for Phase II would provide for development of a total of 289 residential dwelling units, divided between two neighborhoods (Woods and Point), consisting of 135 single family detached units, 154 duplex and triplex units; and WHEREAS, the Applicant modified the proposed entitlements by requesting that the Commons Neighborhood not be developed; and WHEREAS, a Supplemental Environmental Impact Report has been prepared, which together with the Environmental Impact Report prepared in 1982 and the 1996 Supplemental Environmental Impact Report, analyze the anticipated environmental effects of the proposed Phase 1I development; and WffE~AS, the Applicant has filed copies of the proposed vesting tentative map and all those statements required under Municipal Code Chapters 19.40 and 19.50, including copies of the proposed Covenants, Conditions and Restrictions (CC&Rs); and WHEREAS, pursuant to Municipal Code section 19.40.080, copies of the proposed vesting tentative map have been distributed to City staff and public agencies; and WHEREAS, on March 18, 1999, following a properly noticed public heating, the Planning Commission recommended that the City Council adopt the proposed amendment to the Terrabay Specific Plan approve the Vesting Tentative Map and approve the Precise Plan for Phase II of the Terrabay Development; and WHEREAS, on April 14, 1999 the City Council held a properly noticed heating to consider the Planning Commission recommendation. NOW, TI-m. REFORE, BE 1T RESOLVED that the City Council of the City of South San Francisco does herebY find that: he The proposed amendment to the Terrabay Specific Plan, the proposed vesting tentative map and the proposed precise plan for Phase H of the Terrabay Development are consistent with the goals, policies and implementing programs set forth in the General Plan, specifically General Plan Planning Area g4, General Plan Policy 4-1, General Plan Goal #1 and Policies lC and 3C. This finding is based upon all evidence in the record as a whole, including, but not limited to the following: the City Council's independent review of relevant sections of the 1982 ~IR and the 1996 Supplemental EIR and the entire 1999 SEIR and the General Plan, as well as the proposed amendment to the Terrabay Specific Plan, the proposed vesting tentative map and the proposed precise plan, as further explained by the February 25, 1999 and March 18, 1999 Staff Reports to the Planning Commission. Bo The proposed vesting tentative map and the proposed precise plan are consistent with the amended Specific Plan for Phase II. This finding is based upon all evidence in the record as a whole, including, but not limited to the following: the proposed development is residential and the Specific Plan prescribes residential development for Phase Il. The Specific Plan and the proposed development provide for open space to be dedicated to San Bruno Mountain, for common areas and for residential development and associated infrastructure. The proposed development meets the density standards prescribed in the Specific Plan and other development standards including but not limited to the quantity, size and location of parking, building setbacks, design and height. The site is suited for type, density and location of residential development in that all the mitigation measures applicable to Phase II identified in the 1982 EIR, 1996 S~IR and 1999 SEIR are incorporated into the mitigation monitoring program for Phase II as adopted by the City Council. Proper environmental documentation has been prepared on the proposed Do ao F° amendment to the Terrabay Specific Plan, the proposed vesting tentative map and the proposed precise plan for Phase II of the Terrabay Development in accord with the California Environmental Quality Act. This finding is based upon all evidence in the record as a whole, including, but not limited to the following: the City Council's independent review of the proposed amendment to the Terrabay Specific Plan, the proposed vesting tentative map, the proposed precise plan and, the SEIR and relevant sections of the 1982 EIR and the 1996 Supplemental FIR and the entire 1999 SEIR which demonstrate that any threats to public health or safety from the proposed development have either been avoided or mitigated to a level of less than significance; and that the proposed development will finance circulation improvements, provide needed housing stock, and further implement the long-term strategy for managing the environmental, aesthetic and recreational resources of San Bruno Mountain. The development and/or construction standards in the proposed precise plan for Phase II of the Terrabay Development are designed to achieve compliance with the development and/or construction standards of the Terrabay Specific Plan. This finding is based upon all evidence in the record as a whole, including, but not limited to the following: testimony from City staff in the Staff Report for the February 25, 1999 and March 18, 1999 hearing and in oral testimony that development and/or construction standards in the proposed precise plan meet or exceed those required by the Specific Plan. The Phase H site is physically suitable for the proposed type and density of development. This finding is based upon all evidence in the record as a whole, including, but not limited to the following:. The site is suited for type, density and location of residential development in that all the mitigation measures applicable to Phase 1I identified in the 1982 EIR, 1996 SEIR and 1999 SEIR are incorporated into the mitigation monitoring program for Phase 1I as adopted by the City Council. Recreation opportunities are provided for the residents of the development in addition to the City as a whole in the project area, including the Terrabay Recreation Center and access to San Bruno Mountain The design and improvements proposed for Phase H of the Terrabay development are not likely to cause serious health problems substantial environmental damage or substantially and unavoidably injure fish or wildlife in their habitat. This finding is based upon all evidence in the record as a whole, including, but not limited to the following: the 1999 Supplemental Environmental Impact Report, together with the Environmental Impact Report prepared in 1982 and the 1996 Supplemental Environmental Impact Report, analyze the anticipated environmental effects of the proposed Phase II development and together with the adopted mitigation monitoring program demonstrate that the project will either avoid or mitigate impacts of the project that are likely to cause serious public health problems, to cause substantial environmental damage, or to cause substantial and avoidable injuries to fish, wildlife or their habitat. Go The design and type of improvements will not conflict with public easements for access through or use of the property within the proposed Phase H of the Terrabay development. This finding is based upon all evidence in the record as a whole, including, but not limited to the following: City Council's independent review of the proposed vesting tentative map. Residential development of the Commons is not proposed and would not therefore, conflict with any easements to maintain the power transmission lines. Ho The Phase II of the Terrabay development provides to the extent feasible, future passive or natural heating or cooling oppommities. This finding is based upon all evidence in the record as a whole, including, but not limited to the following: the 1999 Supplemental Environmental Impact Report, together with the Environmental Impact Report proposed in 1982 and the 1996 Supplemental Environmental Impact Report, analyze the energy impacts of the project and by means of the adopted mitigation monitoring program provide to the extent feasible future passive or natural heating or cooling opportunities. NOW, THEREFORE, BE IT FURTIIER RESOLV~D that the City Council of the City of South San Francisco does hereby: Adopt the portions applicable to Phase II and residential development only of the proposed amendment to the Terrabay Specific Plan attached hereto as Exhibit IA and incorporated herein by reference. Bo Approve the proposed Vesting Tentative Map attached hereto as Exhibit 3A, including the CC&Rs, attached thereto, and incorporated herein by reference subject to the conditions of approval attached hereto as Exhibit A and incorporated herein by this reference. Co Adopt the proposed Precise Plan attached hereto as Exhibit 4A and incorporated herein by reference subject to the conditions of approval attached hereto as Exhibit A and incorporated herein by this reference.
