A RESOLUTION AWARDING A CONTRACT TO BAUMAN
LANDSCAPE, INC. IN AN AMOUNT NOT TO EXCEED $871,125.65
FOR THE AVALON PARK RENOVATION PROJECT
WHEREAS, the City desires to award the construction contract to the lowest responsible
bidder, Bauman Landscape, Inc. in an amount not to exceed $871,125.65; and
WHEREAS, sufficient funds will be included in the 1999/2000 Capital Improvement
Program Budget to complete this project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San
Francisco that the City Council based on the findings attached hereto as Exhibit "A" hereby
awards a ~onstmction contract to Bauman Landscpae, Inc. in an amount not to exceed
$871,125165 for the Avalon Park Renovation Project.
I hereby certify that the foregoing Resolution was regularly introduced and adopted by the
City Council of the City of South San Francisco at a Requl ar meeting held on the 78
_ day of duly ,1999 by the following vote:
AYES: Councilmembers Joseph A. Fernekes, Eugene R. Mullin and John
R. Ponna, and Mayor ,]amoq I. BatTman

PROPOSED FINDINGS OF FACT REGARDING IRREGULARITY
CONTAINED IN BAUMAN LANDSCAPE, INC.'S BID FOR
AVALON PARK BALL FIELDS RENOVATION CONTRACT
1. Bauman Landscape, Inc's failure to provide the telephone numbers of the
subcontractors is a minor irregularity that does not affect the time, price, or quality of
the work to be supplied;
2. waiving the irregularity would not promote bid-shopping, misuse of public funds,
fraud, corruption, or other potential abuses that bidding requirements are designed to
prevent;
3. bids were first solicited by advertisement on July 3, 1999, and again on July 8, 1999;
4. bids were due on July 21, 1999, giving contractors an 18-day period from the time the
project was first advertised to gather the information necessary to complete the bids;
5. because contractors had an 18-day period in which to collect and analyze information
and subcontractors' quotes necessary for the bid, small differences in the amount of
time available to various contractors do not constitute unfair competitive advantages;
6. the amount of time that it would have taken Bauman Landscape, Inc. to supply the
subcontractors' phone numbers is not significant in light of the 18-day bid period;
7. Bauman Landscape, Inc.'s failure to provide the subcontractors's phone numbers and
waiver of this bid irregularity do not provide Bauman Landscape, Inc. with any unfair
competitive advantage, even if the omission gave Watkin & Bortolussi, Inc. 15 fewer
minutes in which to complete its bid;
8. Bauman Landscape, Inc.'s bid was responsive; and
9. awarding the contract to Bauman Landscape, Inc., the lowest responsible bidder, is in
the public interest
