NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that pursuant to the requirements of Health & Safety Code §17958.7 and Government Code §50022.4, the City Council finds and determines there is a need to adopt the following changes or modifications to the Uniform Building Code 1994 Edition, (Municipal Code Chapter 15.08), by reason of local conditions: 1. Administrative Changes. Section 103.1, Violations, is restated and Section 103.2, Penalties, is added in light of Government Code ~50022.4 to conform with other Municipal Code provisions with regard to penalties by specifying that violations are infractions rather than misdemeanors; to streamline enforcement procedures by facilitating non-judicial enforcement, and to increase compliance levels and encourage voluntary compliance. Section 109.7, Certificate of Occupancy, is modified to reflect the City's organizational and personnel structure and, specifically, the Fire Marshal's role as Chief Building Official. Similarly, Appendix Section 3320, Liability, is modified to restrict the City's exposure to potential liability in connection with this Code's application, as authorized by provisions of the California Health and Safety Code. Appendix Tables i-A, A33-A, and A33-B are deleted and replaced by provisions allowing greater conformity with other locally imposed fees. Appendix Section 3311, Bonds and Insurance, is amended in accordance with local security requirements and practices related to high local construction costs and property values. These changes are administrative rather than technical in nature. 2. Climatic, Geological, and Topographical Changes. Modifications are made to section 1924.1, Minimum Slab Thickness, in an attempt to better prevent leakage and dampness due to the City's frequently wet climate and soil conditions, and to prevent possible foundation damage in earthquakes, due to the City's proximity to the San Andreas Fault. The most significant change is that requiring a waterproof membrane under the slab floor. Similarly, Section 1402.5, Weather-Resistive Barriers, is amended due to local weather conditions, particularly rain, salt air, wind and dampness. Grading and drainage requirements have been expanded. Section 1804.7.1, Foundation Investigation, is amended due to wet conditions caused by the City's wet and rainy climate. Section 1806.5.1, Footings, is amended to require steel reinforcement of footings due to earthquake risks caused by the City's proximity to the San Andreas Fault. Section 3305, Excavation and Grading, is amended to impose specific requirements as to hours of grading operations, transportation routes, and rainy season restrictions, due to potential drainage problems associated with the City's rainy climate and hilly topography. Appendix Section 3307, Hazards, and Section 3309.3, Grading Permit Requirements, are modified to expand on requirements found in the Uniform Building Code in light of local soil types such as clay strata, and local hilly terrain. c. Matters Not Addressed in Uniform Building Code. Since the Uniform Building Code does not address moving buildings, a provision identified as Section 3404.1 has been added, since the City's proximity to the San Andreas Fault and consequent earthquake risk limit the length of time before a permanent foundation must be installed in order to ensure public safety. Section 3319, Restriction of Work During Rainy Season, has been added to address local weather conditions, specifically the City's frequently rainy climate. 3. Uniform Building Code Provisions Deleted. The fee provisions in Appendix Tables A33-A and A33-B are more appropriately covered in the City's master fee schedule and are therefore deleted. BE IT FURTHER RESOLVED that the City Clerk is hereby directed to cause a copy of this resolution, together with the ordinance making the changes or modifications to the Uniform Building Code and Uniform Building Code Standards, 1994 Editions, to be filed with the State Department of Housing and Community Development. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a special meeting held on the 18th day of December , 1996 by the following vote: AYES: Councilmembers Eugene R.
