A RESOLUTION FINDING AND DETERMINING THE NEED FOR
CHANGES OR MODIFICATIONS TO THE NATIONAL ELECTRICAL
CODE, 1993 EDITION
WHEREAS, Section 17958 of the Health & Safety Code requires the adoption
by the City of South San Francisco of regulations imposing the requirements of
certain uniform industry codes as specified in Health & Safety Code §17922; and
WHEREAS, Health & Safety Code §17958.5 permits a city to make such changes
or modifications to the uniform codes as deemed reasonable because of local
climatic, geological, or topographical conditions; and
WHEREAS, Government Code §50022.4 provides that when a code is adopted by
reference, penalty clauses are not deemed adopted by reference but may be enacted
only if set forth in full in the adopting ordinance.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San
Francisco that pursuant to the requirements of Health & Safety Code §17958.7 and
Government Code §50022.4, the City Council finds and determines there is a need
to adopt the following changes or modifications to the National Electrical Code
1993 Edition, (Municipal Code Chapter 15.20) by reason of local conditions:
1. Administrative Changes.
Section 204, Violations, and Section 205, Penalties, are added in
light of Government Code §50022.4 to be consistent with other
Municipal Code provisions concerning penalties by specifying that
violations are infractions rather than misdemeanors; to streamline
enforcement procedures by facilitating non-judicial enforcement;
and to increase compliance levels and encourage voluntary
compliance. Table 3-A of the administrative provisions for the
National Electrical Code is deleted, and replaced by fee provisions
from the Uniform Administrative Code, in order to conform to other
fee provisions in the Municipal Codes by providing a single fee
source for all codes.
2. Climatic, Geological, and Topographical Changes.
Provisions on wiring systems are added in Article 324, Wiring
Methods, to clarify that approved electrical metallic tubing
or rigid metallic conduit are required in all but a few
instances in order to reduce potential electrical line
problems, especially as a result of earthquakes due to the
City's proximity to the San Andreas Fault.
An amendment to Article 334-23, Metal-Clad Cable, is needed to
clarify that internal grounding conductors must be provided in
each metal clad cable because the existing wording simply
refers to an "adequate path." This amendment is necessitated
by the increased earthquake risk caused by the City's
proximity to the San Andreas Fault.
It is appropriate, as reflected in amendments to Article 336-
3, Nonmetallic-Sheathed Cable, and Article 336-4, Uses Not
Permitted, to limit the use of Type NM and type NMC cables to
certain residential structures and not permit such cables in
industrial and commercial buildings. This revision, too, is
necessitated by the increased earthquake risk caused by the
City's proximity to the San Andreas Fault.
BE IT FURTHER RESOLVED that the City Clerk is hereby directed to cause a
copy of this resolution, together with the ordinance making the changes or
modifications to the National Electrical Code, 1993 Edition, to be filed with the
State Department of Housing and Community Development.

adopted by the City Council of the City of South San Francisco at a
special meeting held on the 18th day of December , 1996
