CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION FINDING AND DETERMINING THE NEED FOR
CHANGES OR MODIFICATIONS TO THE UNIFORM FIRE CODE,
1994 EDITION
WHEREAS, Section 17958 of the Health & Safety Code requires the adoption
by the City of South San Francisco of regulations imposing the requirements of
certain uniform industry codes as specified in Health & Safety Code §17922;
and
WHEREAS, Health & Safety Code §17958.5 permits a city to make such
changes or modifications to the uniform codes as deemed reasonable because of
local climatic, geological, or topographical conditions; and
WHEREAS, Government Code §50022.4 provides that when a code is adopted
by reference, penalty clauses are not deemed adopted by reference but may be
enacted only if set forth in full in the adopting ordinance.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South
San Francisco that pursuant to the requirements of Health & Safety Code
§17958.7 and Government Code §50022.4, the City Council finds and determines
there is a need to adopt the following changes or modifications to the Uniform
Fire Code, 1994 Edition (Municipal Code Chapter 15.24) by reason of local
conditions:
1. Administrative Changes.
Section 103.4.2, Violations and Penalties, is amended in light of
Government Code §50022.4 to streamline enforcement procedures by
facilitating non-judicial enforcement; to increase compliance levels and
encourage voluntary compliance; and to be consistent with other
Municipal Code provisions with regard to penalties by specifying that
violations are infractions rather than misdemeanors. Section 105.9,
Permit Fees, is added to conform to other fee provisions in the
Municipal Codes by providing a single fee source for all codes.
2. Climatic, Geological, and Topographical Changes.
Section 1303.3.5.3.3, Fire Drills, is amended due to increased local
fire risk caused by South San Francisco's proximity to the San Andreas
Fault and its frequently windy climate. Section 1103.3.6.3, Abatement
of Fire or Panic Hazards, is amended due to increased local fire risk
caused by the City's proximity to the San Andreas Fault and its windy
climate, as well as the relative old age, wooden construction, and
narrow design of many buildings, streets and alleys in the City.
Section 1003.2.2.2, Buildings Greater Than Four Stories But Less Than 75
Feet, is amended in light of the City's increased fire risk due to its
proximity to the San Andreas Fault, frequently windy climate, and high
density of occupants. Section 1103.2.2, Containers and Removal, is
amended to impose specific container requirements due to the density of
much local housing, the relative old age of many structures within the
City, the presence of many narrow alleys and streets, and the City's
frequently windy climate.
BE IT FURTHER RESOLVED that the City Clerk is hereby directed to cause a
copy of this resolution, together with the ordinance making the changes or
modifications to the Uniform Fire Code, 1994 Edition, to be filed with the
State Department of Housing and Community Development.
I hereby certify that the foregoing Resolution was regularly introduced
and adopted by the City Council of the City of South San Francisco at a
special meeting held on the 18th day of December ,
